Resolution to Authorize Entry into Dog Control Housing Agreement with Dutchess County

At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on January
22nd, 2007.
The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll being
called, the following were present:

The following Resolution was introduced by Councilwoman McCarthy and seconded by
Councilman Paoloni.
WHEREAS, the Town Dog Control Officer is empowered to seize dogs in accordance
with the provisions of Agriculture and Markets Law § 118; and
WHEREAS, dogs seized by the Town Dog Control officer are required to be properly
sheltered, fed and watered during the redemption period according to Agriculture and Markets
Law § 118 (3); and
WHEREAS, the Dutchess County Society for the Prevention of Cruelty to Animals
(hereinafter DCSPCA) maintains a kennel for boarding of dogs and other animals at its office
located at 636 Violet Avenue, Hyde Park, New York 12538; and
WHEREAS, in accordance with Agriculture and Markets Law §115(2), the Town Board
wishes to contract with DCSPCA to provide shelter for dogs seized by the Town Dog Control
Officer; and
WHEREAS, the Town Board wishes to enter into a Dog Control Housing Agreement
with DCSPCA to shelter, water, feed and provide necessary veterinary services for dogs and
other animals seized by the Town; and
WHEREAS, DCSPCA has been presented the Town with a Dog Control Housing
Agreement dated January 1St, 2007, a copy of which is attached hereto, made a part hereof,
marked and designated as Exhibit "I"; and
WHEREAS, the Town determines that it is in the best interest of the Town to enter into
said Dog Control Housing Agreement as set forth in Exhibit "1 ".
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town of Wappinger hereby approves the Dog Control Housing Agreement
dated January 1St, 2007, in the form attached hereto as Exhibit "1" and made part hereof and
authorizes and directs the Supervisor to execute the agreement by and on behalf of the Town of
Wappinger.

Dog Control Housing Agreement
An agreement having been reached and established between the
Dutchess County SPCA and the Town of Wappingers on behalf of dogs seized
by Animal Control of the Town of Wappingers. The agreement is as follows:
EACH DOG WILL BE HELD FOR A MINIMUM OF 7 DAYS BEFORE ADOPTION WHEN NOT
IDENTIFIED AS PER STATE LAW. DOGS THAT ARE IDENTIFIED AS OUTLINED IN STATE
LAW WILL BE HELD FOR 11 DAYS.
ALL DOGS WILL BE EVALUATED AND IF DETERMINED TO BE ADOPTABLE WILL BE
PLACED FOR ADOPTION. THE SPCA RESERVES THE RIGHT TO HANDLE THE FINAL
DISPOSITION OF DOGS DEEMED UNADOPTABLE WITHIN THE MISSION STATEMENT OF
THE SPCA.
THE FEES FOR EACH DOG WILL BE AS FOLLOWS. A DOG NOT IDENTIFIED AND NOT
RECLAIMED, THE TOWN WILL BE CHARGED A FLAT RATE OF $155.00 DOLLARS. THIS
INCLUDES ALL BOARDING SHOTS AND ALTERATIONS.
THE FEES FOR AN IDENTIFIED DOG AND NOT RECLAIMED (11 DAY HOLD) WILL BE A
FLAT RATE OF $195.
A DOG THAT HAS BEEN SEIZED DUE TO A DANGEROUS DOG ORDER BY THE COURT
WILL INCUR AN ADDITIONAL FLAT FEE, OF $40. PAYABLE BY THE TOWN OR THE OWNER
UPON RECLAIM OR DISPOSITION OF THE CASE.
THE SPCA WILL DO RECLAIMS AFTER HOURS UNTIL 5PM, AND ON WEEKENDS UNTIL
5PM, vJHEN THE TOWN MALL IS CLOSED. THE I -OWN WILL DO ALL OTHER RECLAIMS,
THE PINK COPY OF THE DL18 WILL BE A RECIEPT OF RECLAIM FEE BEING PAID TO THE
TOWN AND THE OWNER WILL PAY ALL OTHER FEES AT THE SPCA. BREAKDOWN AS
FOLLOWS BOARDING,$25.00 PER DAY WITH ONE DAY MINIMUM, RABIES $25. INTACT
DOG SURCHARGE $10 FLAT FEE. ALL THESE FEES ARE TO BE PAID AT SPCA AT TIME
OF PRESENTATION OF RECIEPT FROM THE TOWN.
THE SPCA WILL PROVIDE KENNEL SPACE FOR ALL DOGS THAT ARE SEIZED AT ALL
TIMES. THE DCO WILL HAVE ACESS TO LEAVE DOGS AT ALL TIMES.
IN THE EVENT A DOG REQUIRES MEDICAL CARE THE SPCA WILL TRANSPORT AND
RENDER CARE TO THE DOG AND THE TOWN WILL BE BILLED FOR THAT SERVICE
BASED ON THE VETERINARIAN FEES INCURRED BY THE SPCA.
If the Town of Wappingers finds this agreement to be satisfactory, please
sign and return the copy of this letter.
