2013 Petition STATE OF NEW YORK, COUNTY OF DUTCHESS TOWN OF WAPPINGER --------------------------------------------------------------------- x PETITION OF PROPERTY OWNER FOR ESTABLISHMENT OF A LIGHTING DISTRICT In the Matter of the Establishment of REGENCY AT WAPPINGER LIGHTING DISTRICT Petitioner. ------------------------------------------------------- x TO THE TOWN BOARD OF THE TOWN OF WAPPINGER IN THE COUNTY OF DUTCHESS, STATE OF NEW YORK Toll Land V Limited Partnership ("Petitioner") having an office at 60 Merritt Boulevard, Fishkill, New York 12524 being the sole owner of the taxable real property in said proposed Lighting District as shown upon filed plat number 11070B fined in the Dutchess County Clerk's Office on August 27, 2013, does hereby petition the Town Board of the Town of Wappinger to establish a Lighting District known as the HILLTOP LIGHTING DISTRICT, as follows: 1. Petitioner is the sole owner of certain property more particularly described in Appendix "A" of the Engineer's Report made a part hereof. 2. The subdivision has received final subdivision approval from the Town of Wappinger Planning Board and said map is duly filed in the County Clerk's Office as filed plat number 1107B. The subdivision is located within the boundaries of the Town of Wappinger, outside of any incorporated Village or City, and is more particularly described in Appendix "A" to the Engineer's Report. 4. Petitioner proposes, pursuant to Article XII of the Town Law of the State of New York, that the Town Board of the Town of Wappinger establish a Lighting District in the Town of Wappinger, covering the entixety of the real property identified in Appendix "A" specifically all of the lots in the Subdivision known as "Regency at Wappinger (formerly Hilltop Village at Wappinger) Subdivision." 5. The proposed Regency at Wappinger Lighting District is proposed to be established at no cost to the Town of Wappinger and is proposed for the purposes of owning, operating and maintaining the lighting improvements constructed as part of the approved plans of the aforementioned Subdivision by the owner and developer of this Subdivision, the Petitioner herein. 6. The maximum amount to be expended by the Lighting District for the construction and acquisition of the improvements is zero ($0.00) dollars. 7. The Petitioner acknowledges that the Lighting District's annual expenses for the operation (including electricity costs), maintenance, repair or replacement of the lighting improvements shall approximate $25,144.15, resulting in a cost to the typical property therein, of $107.31 per lot, as set forth in the attached Map, Plan and Report prepared by Povall Engineering. 1373/03/445629vI 11/20/13 -2- . .. WHEREFORE, the Petitioner requests that the Town Board of the Town of Wappinger establish the Lighting District hereinabove proposed and described and that a Public Hearing thereon by held according to law.
