2. Resident Statement
Resident Mary Schmalz referenced the minutes of October 15,2013 asking if Resolution 221
meant that everyone in Chelsea would be able to have Wappinger water. Supervisor Gutzler
explained that it would go from the DEP site, down River Road, and into the Ha>nlet of Chelsea.
Mrs. Schmalz asked if there was anyone in Chelsea would be unable to receive Town water.
Supervisor Gutzler said. that individuals could contact the Town to find out. Mrs. Schmalz then
asked if the adoption of the Capital Budgets for O&M Charges for special improvement areas
would increase the United Wappinger Water District's rates. Supervisor Gutzler said that it
would remain the same. Mrs. Schmalz then asked for an explanation of why the Town would
have to pay property taxes on a property that had been acquired by the Town. Supervisor Gutzler
stated that it was adjacent to the Robinson Lane Recreation property. She then deferred the
question to the Town Attorney, Albert Roberts. Mr. Roberts explained that the reason the Town
had to pay the taxes on the property for this year is because the Town acquired the property after
the 2013 tax rolls had been set. Mrs. Schmalz then asked Councilman Beale a question about the
2014 Hughsonville Fire District Budget. Councilman Beale responded that he could not answer a
question about the Fire District's budget because as a Town Councilman, he is unable to serve as
a commissioner for the district.
Resident Gary Lindstrom congratulated the Town Board of the work they have done. He then
approached the Board with a comparison of what Town of Wappinger elected officials receive as
a salary versus the Town of Hyde Park. He believes the Town of Hyde Parks demographics to be
similar to the Town of Wappinger. He described that the officials in the Town of Wappinger
receive 34% more pay than the Town of Hyde Park. Mr. Lindstrom asked if the Town of
Wappinger Elected Officials if they would take a 20% pay cut. Supervisor Gutzler responded
that it is difficult to compare. She explained that the 'Town Supervisor in the Town of 1-lyde Park
recieves a part time salary. She also stated that it has been quite a long time since any of the
elected officials in Wappinger have received a raise. Mr. Lindstrom then explained the salaries of
the Council members in Hyde Park compared with the Town of Wappinger. Supervisor Gutzler
said that she really doesn't consider the Town of Wappinger comparable with Hyde Park. She
feels like Fishkill or East Fishkill would be more appropriate. Councilman. Beale stated he also

feels like Hyde Park is a totally different situation. He also pointed out that many people who run
for office and hold public office in the Towns and County do not have any sort of college. degree.
All of the members on the Town of Wappinger Town Board have at least one Master's degree, or
will have one within the next year. Mr. Lindstrom then asked why there was more commercial
development in the Town of Fishkill than there is in the Town of Wappinger. Supervisor Gutzler
said that she feels that some past Supervisors have been short sighted in terms of future
commercial development. She then said she is looking into ways to expand the Town of
Wappinger's commercial development. Discussion Continued.
Resident Bill Dengler, thanked the Board for the quick removal of their political signs after the
election.

Chapter 240, Zoning of the Town Code with Respect to Boardinghouses and Rooming
Houses
Attorney to the Town, Albert Roberts, explained that as of the last public hearing on the matter,
the law had been amended. The Local Law was previously restricted to Boardinghouses that
were in existence before 1963. The county Planning Department objected to that restriction. The
Local Law was amended to allow Boardinghouses in the proper zones. Mr. Roberts explained
that this new law made the land use for the Stone Gate property into compliance.

Resolution Adopting Capital Budgets, O&M Charges and Water/Sewer Rates and Rents
for Special Districts and Special Improvement Areas For Fiscal Year 2014
WHEREAS, on October 21, 2013, the Town Board, pursuant to and in accordance with the
provisions Sections 198 and 202 of the Town Law and other applicable provisions of law, scheduled a
Public Hearing on the Proposed Capital Budgets and Proposed O&M Charges Water/Sewer Rates and
Rents for Special Districts and Special Improvement Areas for Fiscal Year 2014; and
WHEREAS, the Town Board conducted a Public Hearing on November 7, 2013 at 7:30 p.m. and
all parties in attendance were permitted an opportunity to speak on behalf or in opposition to the proposed
Capital Budgets and proposed O&M Charges Water/Sewer Rates and Rents for Special Districts and
Special Improvement Areas for the fiscal year 2014; and
WHEREAS, the Town Board has taken into consideration the comments made by the public at
the Public Hearing.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. Pursuant to and in accordance with the provisions of Sections 198 and 202 of the Town
Law and other applicable provisions of law, the annexed detailed statement of the Capital
Budgets and O&M Charges Water/Sewer Rates and Rents for Special Improvement
Districts and Special Improvement Areas of the Town of Wappinger is hereby approved
and adopted as the Capital Budgets and O&M Charges Water/Sewer Rates and Rents of
the Town of Wappinger for the fiscal year beginning January 1, 2014.
3. The Town Clerk is hereby directed to enter the aforementioned budgets adopted herein in
the minutes of the Town Board.

Resolution Adopting Annual Budget for Fiscal Year 2014
WHEREAS, on October 21, 2013, the Town Board, pursuant to and in accordance with

the Preliminary Budget, by Resolution No. 2013-233; and
WHEREAS, in accordance with Resolution No. 2013-233, a Public Hearing on the
Preliminary Budget was held on November 7, 2013 at 7:30 p.m. and all parties in attendance
were permitted an opportunity to speak on behalf or in opposition to the proposed Annual
Budget for the fiscal year 2014; and
WHEREAS, the Town Board has taken into consideration the comments made by the
public at the Public Hearing.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. Pursuant to and in accordance with the provisions of Section 109 of the Town
Law and other applicable provisions of law, the annexed detailed statement of
expenditures and revenues of the Town of Wappinger is hereby approved and
adopted as the Annual Budget of the Town of Wappinger for the fiscal year
beginning January 1, 2014.

RESOLUTION: 2013-253
Resolution Authorizing Refund of Unused Escrow For Grace Bible Church Carport
(Account 13-3270)
WHEREAS, on or about March 27, 2013, Rev. Scott Harris, Pastor/Trustee of Grace Bible
Church (hereinafter the "Applicant") filed an application for Site Plan Approval under Application
Number 13-3270; and
WHEREAS, on or about April 18, 2013, the Applicant deposited One Thousand Dollars
($1,000.00) into an escrow account with the Town of Wappinger for payment of the fees of the Town's
professionals to review the application; and
WHEREAS, an additional deposit in the amount of One Thousand Seventy -Five 60/100 Dollars
($1,075.60) was made on July 8, 2013; and
WHEREAS, the application was approved and the Resolution of Site Plan Approval was signed
by the Planning Board Chairman on July 15, 2013; and
WHEREAS, all professional fees incurred during the review of the application have been paid
and a balance of Five Hundred Sixty -Seven Dollars ($567.00) remains in escrow account number 13-
3270 and Applicant has requested a refund of said unused escrow balances; and
WHEREAS, the Town Accountant has audited the escrow account and has verified the
amount due to the Applicant.
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth
and adopted herein.
2. The Town Board hereby authorizes a refund to the Applicant in the amount of Five
Hundred Sixty -Seven Dollars ($567.00) from escrow account number 13-3270,
representing the unused escrow balance for the above project.

Resolution Authorizing Change Orders Nos. 1&2 For UWWD Water Main Extension To
NYC DEP Shaft 6 Site Contract #12-007
WHEREAS, by Resolution adopted by the Town Board on February 25, 2013, the Town
Board awarded a bid to W. M. Shultz Construction, Inc. in the amount of $4,229,530.00 for the

installation and construction of a 12 inch water main from a point of connection with United
Wappinger Water District (UWWD) to the New York City Department of Environmental
Protection (NYC DEP) Shaft 6 site; and
WHEREAS, the Engineers to -the Town, Morris Associates Engineering Consultants,
PLLC, have approved two Change Orders as hereinafter set forth, which two Change Orders will
result in a new contract price of $4,197,562.25.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby approves Change Order No. 1 which decreases the
contract price by the amount of $39,308.70, resulting in a new contract price of
$4,190,221.30, a copy of which Change Order is attached hereto and made a part
hereof as Exhibit "I".
3. The Town Board further approves Change Order No. 2 which increases the
contract price by the amount of $7,340.95, resulting in a new contract price of
$4,197,562.25, a copy of which Change Order is attached hereto and made a part
hereof as Exhibit "2".

RESOLUTION: 2013-257
Resolution Adopting Local Law of 2013 Which Would Amend Chapter 240, Zoning,
of the Town Code with Respect to Boadinghouses and Rooming Houses
WHEREAS, a resolution was duly adopted by the Town Board of the Town of
Wappinger introducing a proposed Local Law entitled "Local Law #_ of 2013, for the Purpose
of Amending Chapter 240, Zoning, of the Town Code with Respect to Boardinghouses and
Rooming Houses" for consideration of adoption by the Town Board; and
WHEREAS, a Public Hearing was duly advertised in the Southern Dutchess News, the
official newspaper of the Town, and the Poughkeepsie Journal; and
WHEREAS, a Public Hearing was held on October 28, 2013 and all parties in attendance
were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law
or any part thereof; and
WHEREAS, for the purpose of Article 8 of the Environmental Conservation Law, Part 617
NYCRR (commonly known as "SEQRA") and pursuant to Chapter 117 of the Town Code (the
Wappinger Environmental Quality Review Law (WEQR) which establishes locally designated
Type I actions), the Proposed Action is the adoption of the proposed Local Law as well as Special
Permit and Site Plan Approvals of an existing boardinghouse; and
WHEREAS, the Town Board has determined that the Proposed Action is a Type I action
pursuant to SEQRA and WEQR; and
WHEREAS, after performing a designation of Lead Agency procedure in accordance with
SEQRA, the Planning Board became the Lead Agency for this action; and
WHEREAS, after considering the potential environmental impacts with respect to the
Proposed Action, the Planning Board, as Lead Agency, issued a Negative Declaration, thereby
finding that the Proposed Action will have no significant adverse impacts upon the environment,
and thereby ending the SEQRA process with respect to this matter; and
WHEREAS, the Town Board of the Town of Wappinger after due deliberation, finds
that it is in the best interest of the Town to adopt said Local Law; and
WHEREAS, said Local Law has been on the desks of the members of the Town Board
of the Town of Wappinger for at least seven (7) days, exclusive of Sunday, prior to the adoption
of this Resolution.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:

1. The Town Board hereby adopts and incorporates the recitations and statements set

specifically modified by the amendments contained therein, the Town Code, as
originally adopted and amended from time to time thereafter, is to remain in full
force and effect.
3. The Town Clerk is directed to enter said Local Law in the minutes of this meeting
into the Local Law book for the Town of Wappinger and to give due notice of the
adoption of said Local Law to the Secretary of State of New York.

X. Items for Special Consideration
1. Councilman Beale
Councilman Beale brought it to the Board's attention traffic light timing problems. He said that
the sensors at many of the lights on Route 9 are off. He then said that there was also a problem
with a manhole cover on Route 9 as well. He stated that the manhole level was unsafe.
Councilman Beale asked the "Town Supervisor to speak to the State about these issues.
Councilwoman Czarniecki asked if Supervisor Gutzler could ask about the light at Route 9 and
New Hackensack Road.
2. Councilman Bettina
Councilman Bettina said that since the speed limit change on Chelsea Road, he has been
hearing from residents that there is still a problem with people speeding on that road. He also
stated that he hasn't seen the speed device on the road. Ile recommended contacting the Sheriff's
office to see why this hasn't been done._
3. Councilman Kuzmicz
Councilman Kuzmicz thanked the residents and veterans for coming to the Town's Veteran's
day ceremony. He said that he also hopes that everyone comes to the Town's Christmas Tree
Lighting which is scheduled for December 1st. Councilman Kuzmicz then asked when the speed
trailers would be available because he had some places in his Ward where he would like them to
go. He asked the Highway Superintendent when they would be available. Highway
Superintendent Graham Foster said that he is hesitant to put the speed trailers out this time of
year because they can interfere with snow removal. Mr. Foster then suggested that when the
trailer is able to be used, there should also be Town Patrol available to aid in speed enforcement.
Councilman Kuzmicz then asked about the possibility of a stop sign at Edgehill and Brothers
Road. Mr. Foster then explained New York State's recolmnendations on the placement of signs.
1--1e referenced a manual .from the State that describes the recommendation on where and why to
put up signs. Discussion continued.
Councilman Kuzmicz then asked for an update on the possibility of changing the speed limit
on Route 376. Supervisor Gutzler said she did not have an update but would mention it when she
spoke to the State representatives.

Councilwoman Czarniecki informed the Highway Superintendent that she felt the staging area
