RESOLUTION ADOPTING SEWER RENT STRUCTURE FOR SEWER DISTRICTS
AND SEWER IMPROVEMENTS FOR THE 2006 CALENDAR YEAR
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on the 9th
day of January, 2006, at 7:30 p.m.
The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll being
called, the following were present:

ABSENT:
The following Resolution was introduced by Ms . McCarthy and seconded by
Mr. Paoloni
WHEREAS, the Town Board of the Town of Wappinger has examined the sewer budget
for all sewer districts and sewer improvements within the Town of Wappinger for the calendar
year 2006; and
WHEREAS, a Public Hearing was held on the 91h day of January, 2006 at 7:30 p.m. at
the Town Hall located at 20 Middlebush Road, Wappingers Falls, New York; and
WHEREAS, all property owners within sewer districts or improvements, as well as
members of the public had an opportunity to voice their opinions regarding the imposition of
sewer rents; and

WHEREAS, the Town Board has authorized to establish sewer rents as prescribed
pursuant to Town Law § 198.1 (i); and
WHEREAS, Article 14-F of the General Municipal Law authorizes sewer rents to be
established by resolution of the Town Board; and
WHEREAS, the Town Board hereby wishes to establish sewer rents for the various
sewer districts and sewer improvement areas in the Town.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby adopts the recitations and statements set forth above as if
fully set forth and resolved herein.
2. The Town Board hereby establishes and imposes sewer rents on all properties
located within the various sewer districts and sewer improvement areas as set forth on the
attached Schedule.
3. The sewer rents shall be billed and collected on a quarterly basis, in arrears,
retroactive to January 1, 2006 which sewer rents shall be collected by the Receiver of Taxes for
the Town of Wappinger.
4. A surcharge of ten percent (10%) shall be imposed for sewer rents and remaining
unpaid for more than five (5) days after the due date.

NOTICE OF PUBLIC HEARING
TOWN OF WAPPINGER
NOTICE IS HEREBY GIVEN that the Town Board of the Town of Wappinger will
conduct a PUBLIC HEARING on the 9th day of January, 2006, at 7:30 p.m. at the Town Hall,
Town of Wappinger, 20 Middlebush Road, Wappingers Falls, New York, at which time all
parties in interest and citizens shall have an opportunity to be heard as to the adoption of the
"Sewer Rent Structure for all Sewer Districts and Sewer Improvements in the Town of
Wappinger for the 2006 Calendar Year." A copy of the proposed sewer rent structure is attached
hereto.
PLEASE TAKE FURTHER NOTICE that the Town Board has determined that pursuant
to 6NYCRR §617.5 (c) (20) the proposed adoption of the aforementioned Local Law is a Type II
action not requiring environmental review pursuant to the State Environmental Quality Review Act
(SEQRA) or pursuant to Local Law No.6 of 1992 and, accordingly, no environmental review has
been undertaken.
PLEASE TAKE FURTHER NOTICE that copies of the proposed Sewer Rent
Structure for all Sewer Districts and Sewer Improvements in the Town of Wappinger for the
2006 Calendar Year are available for review and inspection at the Office of the Town Clerk on
weekdays from 8:30 a.m. to 4:00 p.m., at the Town Hall, 20 Middlebush Road, Wappingers
Falls, New York.

RESOLUTION SCHEDULING A PUBLIC HEARING FOR THE SEWER RENT
STRUCTURE FOR SEWER DISTRICTS AND SEWER IMPROVEMENTS FOR THE
2006 CALENDAR YEAR
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on the 19 day
of December, 2005, at 7:30 p.m.
The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll being
called, the following were present:

WHEREAS, the Town Board of the Town of Wappinger has examined the sewer budget
for all sewer districts and sewer improvements within the Town of Wappinger for the calendar
year 2006; and
WHEREAS, the Town Board has determined that the sewer rent shall be as set forth on
the attached schedule; and

WHEREAS, the Town Board has determined that the proposed adoption for the above
referenced sewer rents is a Type II action pursuant to 6NYCRR §617.5 (c) (20) and is otherwise
exempt from environmental review pursuant to New York State Environmental Quality Review
Act (SEQRA) and pursuant to Local Law No.6 of 1992 and accordingly no environmental
review has been undertaken.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board of the Town of Wappinger hereby determines that the proposed
adoption of the sewer rents hereinafter set forth is a Type II action as defined in 6NYCRR
§617.5 (c) (20) and accordingly the Town Board hereby expressly determines that this action is
not an action that requires environmental review pursuant to the provisions of the New York
State Environmental Quality Review Act (SEQRA) and pursuant to Local Law No.6 of 1992 and
accordingly no environmental review has been undertaken.
3. The Town Board hereby schedules a Public Hearing on the proposed adoption of
the sewer rent schedule as above set forth for all sewer districts and sewer improvements in the
Town of Wappinger for the 2006 calendar year, said Public Hearing to be held at the Town Hall,
20 Middlebush Road, Wappingers Falls, New York on the 91h day of January, 2006 at 7:30 p.m.
and the Town Clerk is directed to post a Notice of Public Hearing in the form annexed hereto and
to publish the same in the Southern Dutchess News and Poughkeepsie Journal as required by
law.
