Resolution Amending Escrow Refund for Lombardi Subdivision
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on
November 27th, 2006.
The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll being
called, the following were present:

The following Resolution was introduced by Councilwoman McCarthy and seconded by
Councilman Valdati.
WHEREAS, Resolution 2006-229 Authorized an escrow refund for the Lombardi
Subdivision, and
WHEREAS, Resolution 2006-229 incorrectly authorized the return of a $2,000 escrow,
and
WHEREAS, the Lombardi Subdivision should receive an escrow refund in the amount
of Five -Hundred Thirteen Dollars and 80/100 ($513.80)
NOW, THEREFORE BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. Resolution 2006-229 is hereby rescinded.
3. An escrow refund in the amount of Five -Hundred, Thirteen Dollars and 80/100
($513.80) is hereby authorized for the Lombardi Subdivision.

In the minutes of October 23, 2006, Resolution #2006-229 calls for the return of the
Robert Lombardi subdivision escrow in the amount of $2,000.00. The escrow analysis of
October 10, 2006 and the submitted paperwork indicate the Lombardi balance to be
$513.80 as well as the request for the return of the escrow balance. Resolution 92006-
229 should be repealed and a new one issued for refund of $513.80 for the Lombardi
subdivision escrow.

NOW, THEREFORE, BE IT RESOLVED, that Bob Sheridan, Town of Wappinger

RESOLUTION: 2006-240
Resolution of Support for Study of Turning Lane on Route 9 and MacFarlane Road In the
Town of Wappinger
WHEREAS, there is a large volume of traffic on Route 9 at the intersection of Route 9
and MacFarlane Road, and
WHEREAS, residents have expressed concerns about the safety of turning off of Route 9
traveling North onto MacFarlane Road, and
WHEREAS, Town Engineer Jay Paggi has stated in his letter dated October 23, 2006,
that a deceleration lane would provide safer access to MacFarlane Road off of Route 9.
NOW THEREFORE, BE IT RESOLVED as follows:
1. The recitations above set forth are incorporated in this Resolution as if
fully set forth and adopted herein.
2. The Town Board of the Town of Wappinger hereby requests that the New
York State Department of Transportation conduct a study of the safety of
traffic on Route 9 turning on to MacFarlane Road and requests that a
feasibility study be conducted to have a deceleration lane place on Route 9
turning onto MacFarlane Road.

Reference: MacFarlane Road/Route 9
Dear Joe:
I am in receipt of an e-mail from a constituent that travels MacFarlane Road
regularly to the New York State Department of Transportation (NYSDOT) regarding
the construction of a deceleration lane on Route 9 as it enters MacFarlane Road.
The NYSDOT responds back that the local municipality within which the area of
concern is located needs to submit an official resolution to the Department
requesting the above referenced situation be studied.
It is my opinion that a deceleration lane at this location would provide a more safe
access to the travelling public entering MacFarlane Lane. Therefore, the request
to the NYSDOT for this study this is warranted.
If there are any questions regarding the above, please do not hesitate to contact
this office.
