Your property is in violation regarding an expired building permit
from 2007. I have tried to contact you via letters explaining that you need to
take care of this as soon as possible. I then received a letter from you
without a phone number where you state you do not believe you have a
violation.
It really doesn't matter who built the deck, it still needs to comply and
it is the owner of record that is responsible. As to what the real estate broker
said to you, they are not code certified when it comes to the NYS building
code.
The bottom line here is that you opened a permit in July of 2007 and
was denied because you did not have enough side yard setback for the
structure. You were sent a denial notice and failed to follow through.
Now it is 2013 and you need to re-open this permit and apply for a
variance or remove the deck. This will be my last communication by letter.
If I do not here from you within 5 business days a summons shall be issued in
order to compel you to comply.
