Resolution Introducing Local Law No._ of the Year 2014, Designating a Stop
Intersection of Edgehill Drive and Edgehill Spur Drive
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on February
24, 2014.
The meeting was called to order by Barbara Gutzler, Supervisor, and upon roll being
called, the following were present:

The following Resolution was introduced by Councilman Kuzmicz and seconded by
Councilwoman Czarniecki.
WHEREAS, at a recent Town Board meeting, a Council Member, in response to concerns raised
by Town residents, inquired about the possibility of installing a new stop sign at the northwest
intersection of Edgehill Drive and Edgehill Spur Drive; and
WHEREAS, the matter was referred to the Engineer to the Town and to the Town Highway
Superintendent for their investigation and recommendation; and
WHEREAS, the Town Board, after examination of the facts and circumstances, and the
recommendation of Highway Superintendent, Graham Foster, and Engineer to the Town, Robert J. Gray,
has determined that it is in the best interest of the citizens of the Town of Wappinger to revise the Town's
Vehicles and Traffic Code §230-43 "Schedule IX: Stop Intersections" and to designate a stop intersection
at the northwest intersection of Edgehill Drive and Edgehill Spur Drive; and
WHEREAS, this is a Type II action pursuant to 6 NYCRR 617.5 (c) (20) and is otherwise
exempt from environmental review pursuant to the New York State Environmental Quality Review Act
(SEQRA) or pursuant to Local Law No. 6 of 1992.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and
adopted herein.
2. The Town Board hereby introduces for adoption Local Law No._ of 2014 in the form
annexed hereto.
3. The Town Board hereby determines that the enactment of the aforementioned Local Law
is a Type II action as defined in 6 NYCRR 617.5 (c) (20) and, accordingly, the Town
Board hereby expressly determines that this action is not an action that requires review
pursuant to the provisions of New York State Environmental Quality Review Act
(SEQRA) or pursuant to Local Law No. 6 of 1992 or pursuant to 6 NYCRR Parts (17).
4. The Town Board hereby schedules a Public Hearing on the Proposed Adoption of Local
Law No._ of the Year 2014 to be held at Town Hall, 20 Middlebush Road, Wappingers
Falls, New York on the 24th day of March 2014, at 7:30 p.m., and that the Town Clerk
be directed to post and publish Notice of the Public Hearing in the form annexed hereto.

LOCAL LAW NO. OF THE YEAR 2014
A Local Law entitled "Local Law No. of the Year 2014, Designating A Stop Intersection at the
Northwest Intersection of Edgehill Drive and Edgehill Spur Drive."
BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section I: Title:
This Local Law shall be known and cited as Town of Wappinger "Local Law No. of the Year
2014, Designating A Stop Intersection at the Northwest Intersection of Edgehill Drive and Edgehill Spur
Drive", which shall amend the present Vehicles and Traffic Code, as set forth below.
Section II: Legislative Intent:
At a recent Town Board meeting, a Council Member, in response to concerns raised by Town
residents, inquired about the possibility of installing a new stop sign at the northwest intersection of Edgehill
Drive and Edgehill Spur Drive. The matter was referred to the Engineer to the Town and to the Town
Highway Superintendent for their investigation and recommendation.
The Town Board, after examination of the facts and circumstances, and the recommendation of
Highway Superintendent, Graham Foster, and Engineer to the Town, Robert J. Gray, has determined that it is
in the best interest of the citizens of the Town of Wappinger to revise the Town's Vehicles and Traffic Code
§230-43 "Schedule IX: Stop Intersections" and to designate a stop intersection at the northwest intersection
of Edgehill Drive and Edgehill Spur Drive as hereinafter described.
Section IlI: Stop Intersection:
The Town of Wappinger Code §230-43 is hereby amended by alphabetically inserting into Schedule
IX the following designated full stop intersection:

Section IV: Stop Sign:
The Town Board hereby directs the Highway Superintendent to place a stop sign as
follows:
• on Edgehill Spur Drive, at its northwest intersection with Edgehill Drive.
Section V: Numbering for Codification:
It is the intention of the Town of Wappinger and it is hereby enacted that the provisions of this Local
Law shall be included in the Code of the Town of Wappinger; that the sections and sub-sections of this Local
Law may be re-numbered or re-lettered to accomplish such intention; the Codifier shall make no substantive
changes to this Local Law; the word "Local Law" shall be changed to "Chapter", "Section" or other
appropriate word as required for codification; and any such rearranging of the numbering and editing shall
not effect the validity of this Local Law or the provisions of the Code effected thereby.
Section VI: Separability:
The provisions of this Local Law are separable and if any provision, clause, sentence, subsection,
word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or
circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall not affect or
impair any of the remaining provisions, clauses, sentences, subsections, words or parts of this local law or
their application to other persons or circumstances. It is hereby declared to be the legislative intent of the
Town Board of the Town of Wappinger that this Local Law would have been adopted if such illegal,
invalid or unconstitutional provision, clause, sentence, subsection, word or part had not been included
therein, and if such person or circumstance to which the Local Law or part thereof is held inapplicable
had been specifically exempt therefrom.
Section VI: Effective Date:
This Local Law shall take effect immediately upon adoption and filing with the Secretary of State
as provided by the Municipal Home Rule Law.

NOTICE OF PUBLIC HEARING
TOWN OF WAPPINGER
NOTICE IS HEREBY GIVEN that the Town Board of the Town of Wappinger will conduct a
PUBLIC HEARING on the day of , 2014, at 7:30 p.m. at the Town Hall,
Town of Wappinger, 20 Middlebush Road, Wappingers Falls, New York, at which time all parties in
interest and citizens shall have an opportunity to be heard as to whether the Town Board of the Town of
Wappinger shall adopt a proposed Local Law entitled "Local Law No. of the Year 2014, Designating
A Stop Intersection at the Northwest Intersection of Edgehill Drive and Edgehill Spur Drive."
PLEASE TAKE FURTHER NOTICE that the purpose and intent of the proposed Local Law is
to amend the Town's Vehicles and Traffic Code by designating a stop intersection and installing a new
stop sign at the northwest intersection of Edgehill Drive and Edgehill Spur Drive.
PLEASE TAKE FURTHER NOTICE that the Town Board has determined that pursuant to 6
NYCRR 617.5 (c) (20) the proposed adoption of the aforementioned Local Law is a Type II action not
requiring environmental review pursuant to the State Environmental Quality Review Act (SEQRA) or
pursuant to Local Law No. 6 of 1992 and, accordingly, no environmental review has been undertaken.
PLEASE TAKE FURTHER NOTICE that copies of the proposed Local Law No. of the
Year 2014 are available for review and inspection at the Office of the Town Clerk on
weekdays from 8:30 a.m. to 4:00 p.m., at the Town Hall, 20 Middlebush Road, Wappingers
Falls, New York.

9. 1'lrainage/Stromwater Management Facilities. The County shall inspect and maintain all of the
drainage culverts and storm water management facilities on; the WRSDRT on an annual basis and
shall undertake any necessary repairs or replacements.. The Town shall notify the County of any
potential drainage or storm water issues that are seen on their monthly inspections (or-reported at
any time) as soon as practical. ~~`""~"-"" "~~°`
10. Emergencies. Both the County and the Town shall have the right to close. any section of the
DCRT for emergency or safety purposes. The Town official who makes the decision to close the
any portion of the WRSDRT shall be responsible ft~r imcnediataly contacting the appropriate fire,:
police and/or rescue authorities, post a "WRSDRT closed" sign, and contact the County Parks
Duty Off cer {914-456-64Q3}.The following information should be provided when reporting a
closure: the nature and location of the incident, the end points of the closed portion of the
WRSDRT, the time and expected duration of the closures, anal what, if any, assistance is required
from the County. The County will also notify the Town should closure of the WRSDRT be
required. Town. shall desi ate those Town officials author?zed to close the WRSDRT and take

11. Police Presence (Towns of Poughkeepsie and East Fishkill only). The Town's responsibility
to maintain a paIice presence on the WRSDRT and associated parking areas shall consist of:
emergency responses, patrols by automobile or bicycle, and as mandated by the Towns of
Poughkeepsie and East Fishkill Police Chiefs. These patrols shall be coordinated by the Towns
with the County Sheriffs Office. The County's Sheriffs Office shall also provide patrols of the
WRSDRT. The Town Police Chiefs or their designee and County Sheriff staff shall meet to
discuss issues as they arise.
12. Police Presence (LaGrange and Wappinger). The Towns shall not be res onsible for

extent practical, for provi ng a pa ice presence on the WRSDRT and for addressing
unauthorized access or use of the WRSDRT.
