RESOLUTION: 2013-263
Resolution Adopting "Local Law No._ of the Year 2013, Amending Chapter 166 of the
Town of Wappinger Code Known as the Noise Code"
WHEREAS, a Resolution was duly adopted by the Town Board of the Town of Wappinger
introducing proposed Local Law No. of the Year 2013, Amending Chapter 166 of the
Town of Wappinger Code known as the Noise Code; and
WHEREAS, the Public Hearing was duly advertised in the Poughkeepsie Journal and the
Southern Dutchess News, the official newspapers of the Town; and
WHEREAS, the Public Hearing was held on November 25, 2013, and all parties in
attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed
Local Law or any part thereof; and
WHEREAS; the Town Board made a Negative Declaration of Significance pursuant to
SEQRA and the Town's Environmental Quality Review Law with respect to the adoption of this
Local Law; and
WHEREAS, the Town Board of the Town of Wappinger after due deliberation finds that
it is in the best interest of the Town to adopt said Local Law; and
WHEREAS, said Local Law has been on the desks of the members of the Town Board
of the Town of Wappinger for at least seven (7) days exclusive of Sunday prior to the adoption
of this Resolution.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board of the Town of Wappinger hereby adopts Local Law No.
of the Year 2013, Amending Chapter 166 of the Town of Wappinger Code known
as the Noise Code, a copy of which is attached hereto and made part of this
Resolution.3.
3. The Town Clerk is directed to enter said Local Law in the minutes of this meeting
into the Local Law book for the Town of Wappinger and shall file the Local Law
with the Secretary of State of New York as provided by law.
4. This Local Law shall become effective immediately upon filing with the
Secretary of State as provided by law.

Resolution Adopting Certificate of Base Percentages, Current Percentages, Current Base
Proportions and Certificate of Adjusted Base Proportions from the New York State Office
of Real Property Services
WHEREAS, the Town has received a Certificate of Base Percentages, Current
Percentages, Current Base Proportions and Certificate of Adjusted Base Proportions for the 2013
Assessment Roll from the New York State Office of Real Property Services, dated November 22,
2013 (hereinafter "Certificate"); and
WHEREAS, the Town CAP Assessor has attested to the accuracy of the aforementioned
Certificate which has been prepared pursuant to RPTL Article 19 and shall be used for the levy
of taxes on the 2013 Assessment Roll, a copy of said Certificate is attached hereto as Exhibit
«1„
NOW, THEREFORE, BE IT RESOLVED, as follows:

forth and adopted herein.
2. The Town of Wappinger hereby accepts and adopts the base percentages, current

2. Coucilman Kuzmicz
Councilman Kuzmicz invited the residents to attend the Christmas Tree Lighting on December
1St. He then asked the Town Engineer and Highway Superintendent about the progress they had made
about possibly putting a stop sign at Edgehill and Brothers. Graham Foster, Highway Superintendent
responded that he and Engineer to the Town, Robert Gray, had gone out and examined the intersection.
Mr. Foster stated that the intersection should have a stop sign, but a local law would be required for the

sign to be put up. Town Attorney, Albert Roberts explained that he would need a report from the engineer
and Highway Superintendent so that he could begin writing up the law.
Councilwoman Czarniecki
Councilwoman Czarniecki asked Mr. Foster about the possibility of putting a stop sign up in
Quite Acres. Mr. Foster asked where she would like the sign. Councilwoman Czarniecki said that she
would Me his opinion on where it should go.
Councilman Bettina
Councilman Bettina asked to wave the 30 day waiting period for the liquor license for TMDCS
for 146 Osborne Hill Road. Supervisor Gurtler asked the Town Clerk for some clarification on what the
30 day waiting period was for. Town Clerk, Michael Leonard,. explained that the thirty day waiting period
is just a formality. Supervisor Gutlzer asked if it was going to be a sports bar. The owner stated that it was
going to be a restaurant. Councilman Bettina asked the Highway Superintendent for and update on
drainage problems on Ronsue Dr. Robert Gray said that he had been out there to look at it and he said that
there are some things that can be done. Mr. Gray explained the process by which water drains to Barbara
Lane. He said that the slope where the water drains has been eroded away. Mr. Gray said that there are
some things that can be done without tearing the whole thing out. Mr. Bettina said he wanted a timeline of
when it would be fixed. Mr. Gray said that if the weather holds he hoped to be out there soon.

Supervisor Gutzler
Supervisor Gutzler explained that there are problems with the level of heat in the Town server
room. It gets too hot in there and the door has to be left open which is a security issue. She has looked
into installing a small air conditioner so the door could be kept closed. RFP's when out and were opened.
Mr. Gray said that AMI Services Inc. was the lowest bid which was significantly lower than the next
lowest bid. Supervisor Gutzler said that she had estimated that the job would cost around
$10,000.Resident Bill Dengler asked the Supervisor for an update some issues on Rt. 9. Supervisor
Gutzler said that she sent a letter to the state about traffic light timing on Route 9. She explained that she
has seen the problem herself.
Supervisor Gutzler recognized a member of the audience. The resident asked what was being
built where Pizza Hut was. Supervisor Gutzler explained that it was going to be a diner. Another resident
asked about a building on Osborne Hill that was possibly going to be a bar because it was right behind his
house. Councilman Bettina said that the building was properly zoned and had been a bar and restaurant
before. Supervisor Gutzler said that she thought the resident was talking about a different house.
