RESOLUTION AUTHORIZING REFUND OF UNUSED ESCROW FUNDS FOR
131 OSBORNE HILL ROAD
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess
County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New
York, on the 12a' day of September, 2005, at 7:30 P.M.
The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll
being called, the following were present:
PRESENT: Supervisor- Joseph Ruggiero

The following Resolution was introduced by Mr. Bettina and seconded
by Mr. Valdati
WHEREAS, on or about November 25, 2003 Timothy Fogarty of Rehabilitation
Support Services deposited Seven Thousand Five Hundred,,and 00/100 ($7,500.00) with
the Town of Wappinger for drainage on 131 Osborne Hill Road, and
WHEREAS, Timothy Fogarty has requested a refund in the amount of Seven Thousand
Five Hundred and 00/100 ($7,500.00) and has been recommended by George Kolb,
Director of Code Enforcement to the Town of Wappinger, in his letter dated August 24,
2005 to the Town Board Members.
NOW, THEREFORE, BE IT RESOLVED, as follows:
The recitations above set forth are incorporated in this Resolution as if fully
set forth and adopted herein.
2. Payment is approved in the amount of Seven Thousand Five Hundred dollars
and 00/100 ($7,500.00) made payable to Timothy Fogarty, Account Number
2002-0024, for the refund of the unused escrow funds deposited for the
property located at 131 Osborne Hill Road.
The foregoing was put to a vote which resulted as follows:

On November 24, 2003 RSS participated in a teleconference with town officials including
yourself, engineer Jay Paggi, Town Highway Superintendent Graham Foster, and Town Attorney
Al Roberts, to discuss conditions the town set forth for the issuance of a Certificate of Occupancy
for the above captioned property. That same day RSS engaged contractor E.R. Baisley who
immediately began corrective drainage work per the engineer's directive.
On November 25, 2003 the town issued a Certificate of Occupancy when RSS hand
delivered to the town a bank check for $7,500.00 from Key Bank. This money was held in escrow
by the town, and was intended to cover costs the town may incur to correct drainage problems at the
construction site, should RSS fail to satisfactorily address the problems.
Nine months have passed since we delivered the escrow money. Wappinger experienced a
particularly wet spring and summer. During this time drainage from our site was successfully and
satisfactorily directed, per the engineer's design. We have had nocomplaints from adjacent
neighbors or the county highway department regarding drainage discharging to their properties.
Furthermore, we have had no complaints from town officials or designees regarding our drainage.
At this time it appears we have satisfactorily met the criteria for drainage discharge that the
Town of Wappinger set forth. I ask that our $7,500.00 placed in escrow be returned to us as soon as
possible. Please send a bank check payable to Rehabilitation Support Services, Inc. to my attention

you, engineer Jay Paggi, Town Highway Superintendent Graham Foster, and Town Attorney Al
Roberts, to discuss conditions the town set forth for the issuance of a Certificate of Occupancy for
the above captioned property. That same day RSS engaged contractor E.R. Baisley who
immediately began corrective drainage work per the engineer's directive.
On November 25, 2003 the town issued a Certificate of Occupancy when RSS hand
delivered to the town a bank check for $7,500.00 from Ke} Bank. 111 smoney was field un escrow
by the town, and was intended to cover costs the town may incur to correct drainage problems at the
construction site, should RSS fail to satisfactorily address the problems.
Subsequent to this RSS has worked with, our site engineer Lawrence Paggi and landscape
contractor E.R. Baisley to meet the acceptable criteria that the town of Wappinger engineer Jay
Paggi set forth. Last month Jay Paggi advised our site engineer that the drainage requirements were

This office has performed multiple site observations during the construction of the drainage
improvements for the above referenced project. In addition, we have reviewed the as -built plan
and centerline profile prepared by Oswald & Gillespie (copy attached).
The swale along the southerly property line appears to effectively collect runoff from the
majority of the paved driveway that discharges toward the south entrance, as well as the overland
runoff from the sewage disposal area, and discharges this runoff to the easterly wetland area. It
appears that this runoff is contained within this swale at the southwest corner of the site, at the
location where stormwater previously discharged toward Osborne Hill Road and the adjacent
southerly properties.
The portion of the swale along the northerly property line that drains toward the west has been
graded to achieve a continuous pitch from the culvert at Osborne Hill Road back to a high point
near the corner of the new garage. The swale has been constructed slightly lower than the
adjacent property. By copy of this letter, we are notifying RSS of the importance of maintaining
this swale by keeping it free of debris over its entire length to the culvert. This includes
preventing snow from being deposited in the swale as a result of driveway plowing operations.
The portion of the swale along the northerly property line that drains toward the east has also
been graded to achieve a continuous pitch toward the wetland from the same high point near the
corner of the new garage. A small berm has also been constructed below the easterly most
portion of the swale along the adjacent owner's property to further protect that adjacent owner
from runoff generated by the project site.
Finally, the storm water pump station appears to effectively collect and discharge footing and
roof drain water to the easterly wetland.
Based upon the above outlined information as well as our periodic observations, it is the opinion
of this office that the drainage improvements have been constructed in conformance with the
general design intent of the approved plans.
