DRAGO FOR AN EXTENSION OF THE UNITED WAPPINGER SEWER DISTRICT TO THE TOWN BOARD OF THE TOWN OF WAPPINGER c/o Town Hall 20 Middlebush Road Wappingers Falls,New York 12590 it The undersigned, being owners of all taxable real property situate in the proposed Extension Area hereinafter described and proposed to be established in the Town of Wappinger, Dutchess County, New York (the "Town"), and aggregating 100% of the assessed valuation of all taxable real property in the proposed Extension Area to the United Wappinger Sewer District, as shown upon the latest assessment roll of said Town, according to the latest completed assessment roll,do hereby Petition the Town Board as follows: 1. Petitioners propose,pursuant to Article 12 of the Town Law,that the Town Board of the Town of Wappinger(hereinafter the "Town") extend the United Wappinger Sewer District (hereinafter "UWSD") in the Town of Wappinger, to include the following identified parcel of �I property: 1.1 Property identified by real property tax grid no. 6257-02-851938 owned by Michael E. Drago and Martha L. Drago, and more particularly !''.. described in a certain deed dated April 5, 2011 and recorded on April 8, .. 2011 in the Dutchess County Clerk's Office as document# 02 2011 1702, II a copy of which is attached hereto as Exhibit"A", 2. Attached hereto and made a pan hereof as Exhibit "B" is a Map, Plan and Report dated April 2014 containing a map of the boundaries of the existing United Wappinger Sewer District, together with the Extension Area to the United Wappinger Sewer District, as well as the location of all proposed sewer main extensions and other appurtenances to be located within said Extension Area, as well as the extension of the sewer facilities to the above referenced parcel (the"Map, Plan and Report"), 3. The Map Plan and Report was prepared by Morris Associates Engineering Consultants, PLLC, with offices located at 9 Elks Lane, Poughkeepsie, New York 12601, competent engineers, duly licensed by the State of New York, 4. The undersigned intend to construct all improvements within said Extension Area, in accordance with the Map, Plan and Report above described and attached as Exhibit "B' hereto, wholly at their own cost and expense and at no cost to the District, and to transfer title thereto and any needed easements to the Town on behalf of the UWSD, free and clear of encumbrances. 5. The proposed Extension Area will provide sewer service to the parcel described in paragraph 1 above. 6. The estimated maximum amount proposed to be expended for the construction and installation of the above described Sewer improvement is Ten Thousand Dollars ($10,000.00), the cost of which shall be paid for by the undersigned at no cost to the District. 7. The expense of Operation and Maintenance(O&M)of said District, following the expansion, shall be assessed, levied and collected from the owners of the parcel of land within the proposed District, as extended, so much upon and shall be determined in accordance with the '.... Operation and Maintenance formula previously established by the Town Board for UWSD. 8. The undersigned acknowledge that upon completion of the construction and installation of the sewer pipes and appurtenances associated with the instant Extension Area,that the above referenced parcel will be assigned benefit units for the purposes of levying benefit assessments for the repayment of existing capital bonded indebtedness previously incurred by the UWSD. In addition, the above referenced parcel will also be charged, quarterly, for O&M expenses based in accordance with the rates established by the To" Board and as the same may be amended from time to time hereafter. (See Exhibit"E"to Map, Plan and Report) 9. The proposed valuation of all taxable real property situate in the proposed Extension Area of the UWSD set forth in paragraph I above, as such valuations appear in the latest completed assessment roll of the Town of Wappinger is$282,600.00. WHEREFORE, the undersigned Petitioners respectfully request that the Town Board of the Town of Wappinger establish an Extension Area to the United Wappinger Sewer District hereinabove proposed and described and that a public hearing thereon be held according to law. Drago 1.0 PURPOSE This map, plan and report describes the facilities associated with the proposed extension to the United Wappinger Sewer District to provide municipal sewer service to the property at 237 All Angels Hill Road. This map, plan and report was prepared pursuant to the request of Michael E. Drago and Martha L. Drago, owners of the subject site. 2.0 MAP (AREA TO BE SERVED) The lot to be served by the proposed United Wappinger Sewer District extension is more particularly described as tax map parcel #6257-02-851938, consisting of 0.87 acres of land, located on the east side of All Angels Hill Road, in an R-20 zoning district. The subject property is currently not served by public sewer and is not located within the approved service area of the existing United Wappinger Sewer District. The parcel is currently developed and contains a residential house. The house to be served by public sewer shall not exceed a total of 320 gallons usage per day. Figure 1 shows the entire Town of Wappinger and the existing United Wappinger Sewer District, along with the Michael E. Drago and Martha L. Drago parcel (proposed to connect to the District). Figure 2 is based on the tax parcel map and shows the proposed extension of the United Wappinger Sewer District to include the Michael E. Drago and Martha L. Drago parcel (proposed to connect to a sewer main in the District). 3.0 PLAN 3.1 Proposed connection to United Wappinger Sewer District Municipal sewer service to the Michael E. Drago and Martha L. Drago parcel will be supplied via a connection to the existing 8" inch diameter sewer trunk service line along the rear (northerly) property line at an existing manhole in the sewer easement on tax map parcels 857960 and 875956. Service to the subject site does not entail the acquisition of any land or an easement. 3.2 Proposed On-Site Sewer Collection Systems The owners (Michael E. Drago and Martha L. Drago) of the residential property shall be responsible for the design and construction of the on-site sanitary sewer collection system consisting of: a 4" gravity sewer from the residence to a proposed new pump station on the Drago parcel and a 2" force main from the pump station connecting to the 8" sewer at an existing manhole in the easement along the rear of the Drago parcel. The proposed on-site sewer collection system shall be subject to review and approval by the Town of Wappinger (CAMO). Installation of the sanitary sewer infrastructure will involve standard earthwork, piping, and construction techniques. Also included (Exhibit G) is a copy of the plan prepared for the Drago's by Matthew A. Noviello showing the proposed water and sewer service connections. 4.0 REPORT Michael E. Drago and Martha L. Drago are the owners of the lot to be served and have petitioned the Town of Wappinger to extend municipal sewer service from the established United Wappinger Sewer District to the subject site. The Town, on behalf of Michael E. Drago and Martha L. Drago, has requested permission from the Tri- Municipal Sewer Commission to connect to the Tri-Muni sewer trunk line (Exhibit A). The Tri-Municipal Sewer Commission which handles wastewater from the Town at the Commission's wastewater treatment plant in Poughkeepsie has authorized the connection (Exhibit B). Michael E. Drago and Martha L. Drago shall be billed benefit assessments on an annual basis in accordance with the method and rate established for residential parcels in the United Wappinger Sewer District and the Benefit Formula (Schedule A). Payments are based on benefit, which is expressed as 100 benefit units for a residential property. The total payment to the United Wappinger Sewer District is as follows: • The benefit units for the United Wappinger Sewer District (UWSD) are determined in accordance with the Benefit Formula (Schedule A). A residential property is assigned 1.0 Benefit Units. • As noted in the attached letter dated 2013-12-26 and revised 2014-1-7 from the Town Assessor (Exhibit C), the Michael E. Drago and Martha L. Drago parcel (proposed to connect to the District) would be billed $293.60 (the sum of the Wappingers Transfer/Treatment #1 and 2 District and the United Wappinger Sewer District (the United Wappinger Sewer District now includes the former Wappingers Transfer/Treatment #1 and 2 Districts but the assessor's letter shows the charges computed separately for the old and new portions of the district)) for the assigned 1.0 Benefit Units. • The property will also incur a one-time buy in fee of $15.00 per gallon of daily usage, or 15 $/gal * 320 gal = $4800.00 That charge is noted in a memo from the Town of Wappinger Water/Sewer billing clerk, dated 2014-4-17 (Exhibit E). The charge is in accordance with the Wappinger Town Code Chapter 236, §236-6 (see Exhibit F). • Annual O&M charge is $125 per quarter/$500 per year for a single family home. That charge is noted in a memo (Exhibit E) from the Town of Wappinger Water/Sewer billing clerk, dated 2014-4-17. The costs for the Michael E. Drago and Martha L.
