Please recall that the owner/applicant, Mr. Patrick Farley appeared before your Board on August 26, 2013 to discuss the proposed zone change, at which time the Board was in favor of making the proposed change. Since that time, Mr. Farley purchased the property and is now pursuing formal zone change of the parcel so that he may relocate his business of nearly 20 years to the existing house on the property. There is an existing dwelling located on the west side of the property, and an existing driveway central to the site from Myers Comers Road. Municipal sewer serves the existing building, and a private well serves as the water supply. Parcels directly to the north (across Myers Comers Road) are located within the municipal boundary of the Village of Wappingers Falls within the CB Central Business District. Parcels to the east and south are located within the Town of Wappinger in the R-20 One -Family Residence District, and the parcel to the west is located within the Town of Wappinger in the CC Conservation Commercial District. The proposal would extend the CC District to include the subject parcel which would bring the CC District to Losee Road, which would provide a consistent commercial zone from Route 9 along both sides of Myers Corners Road up to Losee Road where the residential districts would commence. The existing improvements to the parcel permits the proposed use of the site as described in the attached owner's statement with little site work required. Based on the size of the parcel and the fact that there will be little to no physical alteration to the existing parcel, we believe that the project would be classified as an Unlisted action in accordance with SEQR and WEQR and would typically necessitate the preparation of a short Environmental Assessment Form (EAF); however, in accordance with the Town's Zone Change application, Parts 1 & 2 of the full EAF have been prepared and provided with this submittal. We are now formally requesting this item be placed on the next available agenda, at which time we would be happy to appear before the Board to discuss this proposal further and to discuss the steps moving forward.
