Resolution Authorizing The Settlement Of The Tax Certiorari Proceeding Regarding
Hansen Associates And Elizabeth Battistoni And Dale Saul

At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls,New York, on
September 14, 2015.

The following Resolution was introduced by Councilman Kuzmicz and seconded by
Councilman Ciccarelli.
WHEREAS, there is now pending in the Dutchess County Supreme Court a tax
certiorari proceedings commenced in 2012, 2013 and 2014 by Hansen Associates and Elizabeth
Battistoni and Dale Saul regarding vacant real property located at Lois Lane Grid #6256-01-
020831, Lois Lane Grid #6265-01-041873, Smithtown Road Grid #6256-01-136878, Lois Lane
Grid #6256-01-075916 and Old Route 9 Grid #6156-02-898635 seeking a reduction in the 2012,
2013 and 2014 tax assessments for their respective tax roll; and
WHEREAS,the Town Assessor and Special Counsel have recommended a settlement of
this tax review proceedings; now,therefore be it
RESOLVED, that the Town Board of the Town of Wappinger hereby approves a
settlement on behalf of the Town of Wappinger of the tax review proceedings for the year 2012
as follows:
