Resolution Authorizing The Settlement Of The Tax Certiorari Proceeding Regarding Elizabeth Battiston
At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County,New York, held
at Town Hall, 20 Middlebush Road, Wappingers Falls,New York, on December 14, 2015.

The following Resolution was introduced by Councilman Kuzmicz and seconded by Councilman Beale.
WHEREAS, there is now pending in the Dutchess County Supreme Court a tax certiorari proceeding
commenced in 2012, 2013, 2014 and 2015 by Hanson Associates/Elizabeth Battistoni regarding real property
located at Tow Path, Wappingers Falls, Grid #6265-01-111809, Tow Path, Wappingers Falls, Grid #6256-01-
114830, Tow Path, Wappingers Falls, Grid #6256-01-124850 and Smithtown Road, Wappingers Falls, Grid #
6256-02-920781 seeking a reduction in the 2013, 2014 and 2015 tax assessments for their respective tax roll;
and
WHEREAS, the Town Assessor and Special Counsel have recommended a settlement of this tax
review proceedings; now, therefore be it
RESOLVED, that the Town Board of the Town of Wappinger hereby approves a settlement on behalf
of the Town of Wappinger of the tax review proceedings for the year 2012, 2013, 2014 and 2015, as it pertains
to:
