Resolution Authorizing The Settlement Of The Tax Certiorari Proceeding Regarding John Sokol
At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New
York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on November 14, 2016.
The meeting was called to order by Lori A. Jiava, Town Supervisor, and upon roll being called,

The following Resolution was introduced by Councilman Fenton and seconded by Councilman
Beale.
WHEREAS, there is now pending in the Dutchess County Supreme Court a tax certiorari
proceeding commenced in 2015 by John Sokol regarding real property located at 101 Old Post Road,
Grid 4135689-6157-04-604495 seeking a change in classification for the 2015 tax assessment for its
respective tax roll; and
WHEREAS, the Town Assessor and Special Counsel have recommended a settlement of this
tax review proceedings; now, therefore be it
RESOLVED, that the Town Board of the Town of Wappinger hereby approves a settlement on
behalf of the Town of Wappinger of the tax review proceedings for the year 2015 for Grid 4135689-
6157-04-604495 to reclassify the land use class from "475-commercial: miscellaneous services: junk
yards" to "484 - one story small structure" and to further reclassify the parcel tax code from "100% N:
Non-Homestead" to "N: Non-Homestead 25% and H: Homestead 75%"; and be it further
RESOLVED, that the Town Supervisor, Town Assessor and Scott L. Volkman, Esq., Special
Counsel to the Town of Wappinger, are hereby authorized to take all action necessary and appropriate to
effectuate the terms of this Resolution.
The foregoing was put to a vote which resulted as follows:
