VI. Discussions
1. Motion To: Eagle Scout Project
Christopher Negri from Troop 26 came to address board. He explained that for his eagle scout
project he would be repairing the Town Hall recreation area excluding the Gazebo, i.e. leveling
and replacing items around the horse shoe pit, fixing the gravel and power washing the frame
around the bocce pit and shuffleboard surface. He expects to be finished in May. Councilman
Beale asked how long this would take. Mr. Negri responded he complete it in 4 weekends,
however he will need $500. The board agreed to fund it from the A -Fund Town Board
Contingency.

VII. Resolutions
RESOLUTION: 2017-83
Resolution Authorizing Supervisor Of Buildings And Grounds To Enter Into A Pest
Control Services Agreement And The Transfer Of Funds To Cover The Costs Therewith
WHEREAS, Steven Frazier, Supervisor of Buildings & Grounds, has recommended pest
control services for various Town buildings i.e. Town Hall, Emergency Services Building,
Highway Garage and Maintenance Barn located on 59 Montfort Road; and
WHEREAS, the Supervisor of Buildings & Grounds solicited for proposals for pest
control services as required by the Town's Procurement Policy and has recommended that
Empire Pest Control is the lowest responsible proposal; and
WHEREAS, the cost for the pest control services for each of the above-mentioned
buildings are more fully described in the letter agreement from Empire Pest Control, a copy of
which is affixed hereto; and
WHEREAS, pest control services for each of the above-mentioned buildings will be paid
from the budget lines as follows:
Town Hall and Emergency Services Building - A.1620.454
Highway Garage - A.5132.400
Maintenance Barn (Montfort Road) - A.7110.0408
WHEREAS, the transfer of funds between various budget lines is required to pay for the
costs associated with the pest control services.
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth
and adopted herein.
2. The Town Board hereby authorizes Steven Frazier, Supervisor of Buildings &
Grounds, to enter into an agreement with Empire Pest Control for pest control services as more
fully described in their letter agreement, a copy of which is affixed hereto.
3. The Town Board hereby further authorizes the payment of the pest control
services to be paid from the budget lines as follows:

RESOLUTION: 2017-84
Resolution Introducing Local Law No. 2 Of 2017 Which Would Repeal Chapter 117,
Environmental Quality Review, Of The Town Code
WHEREAS, the Town Board is considering the adoption of Local Law No. 2 of 2017 which
would repeal Chapter 117, Environmental Quality Review, of the Town Code; and
WHEREAS, the Town Board has determined that the Proposed Action is an Unlisted action
pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as
"SEQRA") and pursuant to Chapter 117 of the Town Code (the Wappinger Environmental Quality
Review (WEAR) Law which establishes locally designated Type I actions); and
WHEREAS, the Town Board has determined that the proposed Local Law is an action for
which there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead
Agency for this action.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:

1. The Town Board hereby adopts and incorporates the recitations and statements set forth
above as if fully set forth and resolved herein.
2. The Town Board hereby introduces for consideration of its adoption proposed Local Law No. 2
of 2017 in the form annexed hereto.
3. The Town Board hereby schedules a Public Hearing regarding the adoption of the annexed
proposed Local Law No. 2 of 2017 for 7:30 PM on the 24th day of April, 2017 and the Town
Clerk is hereby directed to post the notice of the Public Hearing in the form annexed hereto
and to publish same in the Southern Dutchess News and the Poughkeepsie Journal not
less than ten (10) days prior to said Public Hearing date.
4. The Town Board hereby directs the Town Clerk to act as follows with respect to the proposed
Local Law:
a. To serve a copy of this resolution, the annexed proposed Local Law, and the public
hearing notice to the municipal clerk of each abutting municipality not less than ten
(10) days prior to said public hearing;
b. To serve a copy of this resolution, the annexed proposed Local Law, and the public
hearing notice to the Dutchess County Department of Planning and Development for
advisory review in accordance with Section 239 of the New York State General
Municipal Law; and
C. To distribute a copy of this resolution, the annexed proposed Local Law, and the public
hearing notice to the Town of Wappinger Planning Board for its review and
recommendation prior to said public hearing.

RESOLUTION: 2017-85
Resolution Awarding Bid For Mid Point Park Sewer Collection System Improvements
WHEREAS, by Resolution No. 2017-81 adopted by the Town Board on March 13,
2017, the Town Board authorized the issuance of $280,000 Bonds to pay the cost of capital

improvements in connection with the establishment of the Mid Point Park Sewer District,
consisting of improvements to the Mid Point Park Sewer Collection System; and
WHEREAS, bids and specifications were prepared by Robert J. Gray, P.E. of Morris
Associates Engineering & Surveying Consultants, PLLC, Engineers to the Town, for the work
required for the improvements to the Mid Point Park Sewer Collection System; and
WHEREAS, bids were duly solicited for the work to be done and only one bid was
received on March 22, 2017 from Arold Construction Co., Inc., 51 Powder Mill Bridge Road,
Kingston, New York 12401, in the base bid amount of $161,000; and
WHEREAS, by letter dated March 24, 2017 from Robert J. Gray, P.E. of Morris
Associates Engineering & Surveying Consultants, PLLC, Engineers to the Town, have
determined that the bid they received from Arold Construction Co., Inc. is reasonable and, based
on past experiences with this company, recommends that Arold Construction Co., Inc. should be
awarded the contract in the amount of $161,000 all as set forth in the aforementioned
recommendation letter, a copy of which is affixed hereto.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town of Wappinger hereby awards the bid for the improvements to the Mid
Point Park Sewer Collection System to Arold Construction Co., Inc., 51 Powder Mill Bridge
Road, Kingston, New York 12401, in the base bid amount of $161,000.
In accordance with the authorized bid specifications, the Town Board hereby authorizes the
Supervisor to execute the contract documents as prepared by Morris Associates, including the
Notice of Award and Notice to Proceed and forward a copy to Arold Construction Co., Inc., after
the Attorney to the Town has confirmed that Arold Construction Co., Inc. has duly executed the
contract documents, has supplied the necessary Performance Bond, Payment Bond and provided
insurance certificates all as otherwise required by the bid specifications.

VIII. Items for Special Consideration
Councilman Fenton suggested we re -visit solar systems on the roof as is done in the Village of
Rhinebeck.

Councilman Ciccarelli asked about the water leaks from roof and why a new roof would leak.
Supervisor Jiava and Engineer Gray explained that this was a unique situation. The details of
roof design was discussed.

This is a friendly reminder that per NYS Highway, Law 319, the Town of Wappinger Highway
Department has no liability in replacing or repairing mailboxes or other fixtures in the Town
right of ways. During the course of snow maintenance operations such items may be unintentionally
damaged. We regret that this may happen from time to time, but road safety and maintenance
is our priority and utmost importance. At times visibility may not be possible due to the weather
conditions or other extenuating circumstances. The Office of the Highway Superintendent, Dutchess
County DPW and NYS Department of Transportation have an obligation to keep the roads passable
for emergency and public use. Snow removal and snow storage are an incident of that use. There
is no statutory or legal authority which grants a property owner or resident any right to place a mailbox
in a road or highway right of way.

plowing operations during snow removal. Highway Departments are not responsible by New York
State Highway Law to replace mailboxes. The Town of Wappinger Highway Superintendent will
replace the box at no cost, as a courtesy to the Town resident.

(Per NYS Vehicle and Traffic Law 1219) Residents are prohibited by placing any debris in the road
which does include basketball hoops,.and trash cans. The.placement of snow in the road by residents
shoveling or snow blowing, including their plow contractors, is a violation of the law. Residents can be
issued a summons and may also be subject to arrest. Residents also may not park vehicles in the
road during snow operations and are also subject to summons and their vehicle being towed at their
expense. The Highway Department is also not responsible for removing snow and / or shoveling the
entrances of residential or commercial entrances.
Thank you for your assistance in following the laws. Please understand that safety is the Highway
Departments utmost priority.

LOCAL LAW No. 2 OF THE YEAR 2017
BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section 1: Title
This Local Law shall be known and cited as "Local Law No. 2 of 2017, for the Purpose of
Repealing Chapter 117, Environmental Quality Review, of the Town Code."
Section 2: Legislative Intent
The Town Board believes that it is reasonable and appropriate to repeal Chapter 117,
Environmental Quality Review, of the Town Code. This local law is determined to be an exercise
of the police powers of the Town to protect the public health, safety and welfare of its residents.
Section 3: Repeal of Chapter 117, Environmental Quality Review, of the Town Code
Chapter 117, Environmental Quality Review, of the Town Code is hereby repealed.
Section 4: Ratification, Readoption and Confirmation
Except as specifically modified by the amendments contained herein, the Code of the Town of
Wappinger as adopted and amended from time to time thereafter is otherwise to remain in full force
and effect and is otherwise ratified, readopted and confirmed.
Section 5: Numbering for Codification
It is the intention of the Town of Wappinger and it is hereby enacted that the provisions of this
Local Law shall be included in the Code of the Town of Wappinger; that the sections and subCD

sections of this Local Law may be re -numbered or re -lettered by the Codifier to accomplish suchco Ui
intention; that the Codifier shall make no substantive changes to this Local Law; that the word �-
"Local Law" shall be changed to "Chapter," "Section" or other appropriate word as required for
codification; and that any such rearranging of the numbering and editing shall not affect the validity
of this Local Law or the provisions of the Code affected thereby.
Section 6: Separability
The provisions of this Local Law are separable and if any provision, clause, sentence, subsection,
word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or
circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall not affect or
impair any of the remaining provisions, clauses, sentences, subsections, words or parts of this
Local Law or their application to other persons or circumstances. It is hereby declared to be the

legislative intent of the Town Board of the Town of Wappinger that this Local Law would have been
adopted if such illegal, invalid or unconstitutional provision, clause, sentence, subsection, word or
part had not been included therein, and if such person or circumstance to which the Local Law or
part thereof is held inapplicable had been specifically exempt therefrom.
Section 7: Effective Date
This Local Law shall take effect immediately upon filing with the Secretary of State as provided by
the Municipal Home Rule Law.

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Wappinger will conduct a
Public Hearing on the 241h day of April 2017, at 7:30 PM at the Town Hall, 20 Middlebush Road,
Wappingers Fall, New York, at which time all parties in interest and citizens shall have an opportunity
to be heard as to whether the Town Board of the Town of Wappinger should adopt Local Law No. 2 of
2017 which would repeal Chapter 117, Environmental Quality Review, of the Town Code.
PLEASE TAKE FURTHER NOTICE that the Town Board has reserved its right to make its
Determination of Significance pursuant to SEQRA at the conclusion of the Public Hearing to be held
on the adoption of the proposed Local Law.

Dear Supervisor Jiava and Town Board:
On March 22, 2017, one bid for the above referenced project was received. The bid results
are as follows:
Contractor Base Bid Price
Arold Construction Co., Inc.
This office reviewed the bid of the apparent low bidder, Arold Construction Co., Inc. This
office has previously worked with this firm on a nUrnber of projects and this was the only firm to
submit a bid. Arold Construction Co., Inc. has worked on a number of similar sewer
rehabilitation projects in the past and is qualified to complete the work required for this project.
It is 'there -fore recornmended that the Base Bid contract be awarded to Arold Construction
Co., Inc. in the contract amount of $161,000. A copy of the bid proposal received from Arold
Construction Co.. Inc. has been included with this letter.

partnership or corporation to submit or not to submit a bid for the purpose of restricting
competition.
A Nd shall not be considered for award nor shall any award be made where (1), (2) and (3)
above have not been complied with; provided however, that if in any case the bidder cannot
make the foregoing certification, the bidder shall so state and shall furnish with the bid a
signed statement which sets forth in detail the reasons there -fore. Where (1), (2) and (3)
above have not been complied with, the bid shall not,be considered for award nor Shall any
award be made unless the 'Town Clerk of the Municipality to which the bid is made, or,
l"iWher desigrmee, determines that such diSCiOSUre was not made for the purpose of
restricting competition.
(4) The fact that a bidder (a) has published price lists, rates, or tariffs, covering items being
procured, (b) has informed prospective customers of proposed or pending publication of
new or revised price lists for such items, or (c) has sold the same iterns or other customers
at the carne prices being bid, does not constitute, without more, a disclosure within the
meaning of subparagraph (1).
Any bid hereafter made to any pUblic authority or to any official of any pUblic authority
created by the.State or any political subdivision, by a corporate bidder for work of services
performed or -to be performed or goods sold or to be sold wherry COMIDetitive bidding is
required by statute, rule, regulation, or local lamr, and where such bid contains the
certification referred to in the lead paragraph of this section, shall be deerned to have been
authorized bythe board of directors, of the bidder and such authorization shall be deemed to
include, the signing and submission of the bid and the inclusion therein of tl-le certificate as
to non -collusion as the act and deed of the corporation.
