Walter Artus came to address the annual stormwater report that he had recently submitted. He
asked that the board endorse it. He added that the new training included Ms. Roberti and Ms.
Dao.
4. Shared Setvice Grants -Scott Williams
Scott Williams asked to come before the board to speak on the grant initiatives. These grants are
a similar to the Aeration grant applied for last year and received $500,000 over 3 years. This
year they are applying with Tri -Municipal again to look at ways that the town and village can
join their wastewater and water construction specifically at the Myers Corners interconnect for
drinking water and the long term plans for Wildwood, taking it through Woodhill Green. The
application is due May 18th.

VIII. Resolutions
RESOLUTION: 2017-93
Resolution Introducing Local Law No. 3 Of 2017 Which Would Amend Chapter 240,
Zoning, Of The Town Code By Adding New Principal And Accessory Uses Regarding The
Restoration And Sale Of Antique Vehicles, Respectively
WHEREAS, the Town Board is considering the adoption of Local Law No. 3 of 2017 which
would amend Chapter 240, Zoning, of the Town Code by adding new principal and accessory uses
regarding the restoration and sale of antique vehicles, respectively; and
WHEREAS, the Town Board has determined that the Proposed Action is a Type I action
pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR (commonly known as
"SEQRA"); and
WHEREAS, the Town Board has determined that the proposed Local Law is an action for
which there are no other Involved Agencies and that the Town Board is therefore, by default, the Lead
Agency for this action.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
The Town Board hereby adopts and incorporates the recitations and statements set forth
above as if fully set forth and resolved herein.
2. The Town Board hereby introduces for consideration of its adoption proposed Local Law No. 3
of 2017 in the form annexed hereto.
3. The Town Board hereby schedules a Public Hearing regarding the adoption of the annexed
proposed Local Law No. 3 of 2017 for 7:30 PM on the 12th day of June, 2017 and the Town
Clerk is hereby directed to post the notice of the Public Hearing in the form annexed hereto
and to publish same in the Southern Dutchess News and the Poughkeepsie Journal not
less than ten (10) days prior to said Public Hearing date.
4. The Town Board hereby directs the Town Clerk to act as follows with respect to the proposed
Local Law:
a. To serve a copy of this resolution, the annexed proposed Local Law, and the public
hearing notice to the municipal clerk of each abutting municipality not less than ten
(10) days prior to said public hearing;
b. To serve a copy of this resolution, the annexed proposed Local Law, and the public
hearing notice to the Dutchess County Department of Planning and Development for
advisory review in accordance with Section 239 of the New York State General
Municipal Law; and
C. To distribute a copy of this resolution, the annexed proposed Local Law, and the public
hearing notice to the Town of Wappinger Planning Board for its review and recommendation prior to

Proclamation: Taiwanese American Heritage Week 2017
WHEREAS, America has been continually renewed and enriched by the many different people
who choose to come here and become our fellow citizens; and
WHEREAS, each person brings a part of his or her own heritage, which over time becomes part
of our common heritage; and
WHEREAS, many generations of Asian Americans have helped make America the cultural
melting pot it is today; and
WHEREAS, there are over 500,000 Taiwanese Americans in the United States, with a significant
Taiwanese American population in the Town of Wappinger; and
WHEREAS, Taiwanese Americans have succeeded as successful and notable artists, Nobel
Laureate scientists, researchers, business leaders, human rights activists and community leaders; and
WHEREAS, Taiwanese Americans are very proud of their roots and of their vital role in the
continued growth of our nation; and
WHEREAS, Taiwan is a sovereign, independent country but continues to be illegitimately
claimed by the People's Republic of China as a renegade province; and
WHEREAS, Taiwan and the United States share a common commitment of the ideals of
democracy, freedom and human rights; and
WHEREAS, the United States provides safety and security guarantees to Taiwan for the
preservation of its democracy; and
WHEREAS, due to American support, Taiwan's voice is heard while it strives for participation in
international organizations, such as the World Health Organization and the United Nations; and
WHEREAS, Taiwanese American Heritage Week recognizes the longstanding friendship
between the United States and Taiwan; and
WHEREAS, Taiwanese American Heritage Week observance provides an opportunity for all
Americans to learn more about the contributions of men and women from Taiwan have made to our
nation and to the world at large.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Wappinger does
hereby recognize and proclaim May 14, 2017 through May 21, 2017 as "Taiwanese American Heritage
Week" and encourages all citizens to recognize our Taiwanese heritage and the many contributions
Taiwanese Americans have made to our country.

RESOLUTION: 2017-95
Resolution Approving Northeast Electrical Inspections, Llc As An Approved Electrical
Inspector For The Town Of Wappinger
WHEREAS, Chapter 114 of the Town Code of the Town of Wappinger requires all electrical
installations to be in conformity with the National Electrical Code and the New York State
Uniform Code; and
WHEREAS, Section 114-4. permits the Town Board to authorize and approve qualified
electrical inspection agencies to make inspections, re -inspections, and to approve or disapprove
any electrical installations within the Town of Wappinger to insure compliance with the National
Electrical Code and the New York State Uniform Code; and
WHEREAS, David Near, Steven D. Reynolds, Michael DiMenna and Daniel Valls are
certified residential electrical inspectors in the State of New York and have provided
certifications thereof, and
WHEREAS, David Near is a certified residential and commercial inspector; and
WHEREAS, David Near, Steven D. Reynolds, Michael DiMenna and Daniel Valls are
all duly employed by Northeast Electrical Inspections, LLC; and
WHEREAS, Northeast Electrical Inspections, LLC, has requested to be an approved
electrical inspection agency for the Town of Wappinger; and
WHEREAS, Susan Dao, Code Enforcement Officer for the Town of Wappinger has
reviewed the qualifications of David Near, Steven D. Reynolds, Michael DiMenna and Daniel
Valls in their capacity as residential and/or commercial electrical inspectors of Northeast
Electrical Inspections, LLC, to act as electrical inspectors for the Town of Wappinger and said
Susan Dao has determined that the aforesaid organization meets all criteria required by the
National Electrical Code to qualify as an electrical inspection agency and recommends that
Northeast Electrical Inspections, LLC be approved as an electrical inspection agency for the
Town of Wappinger for all electrical installations within the Town of Wappinger to insure
compliance with the National Electrical Code and the New York State Uniform Code.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. Northeast Electrical Inspections, LLC, acting by and through its residential
and/or commercial electrical inspectors David Near, Steven D. Reynolds, Michael DiMenna and
Daniel Valls, is hereby approved to be a qualified electrical inspector for the Town of Wappinger
and is hereby authorized to provide ministerial electrical inspection services for all electrical

installations within the Town of Wappinger to insure compliance with the National Electrical
Code and the New York State Uniform Code.
Northeast Electrical Inspections, LLC is further appointed as an agent of the Town of

installations made in the Town of Wappinger, in accordance with Chapter 114 of the Code of the
Town of Wappinger, provided it maintains the required liability insurance naming the Town of
Wappinger as a certificate holder thereof.

RESOLUTION: 2017-96
Resolution Authorizing Amendment To The Agreement For Operation Of Carnival, Rides,
Concessions And Amusements For Town Of Wappinger Community Day
WHEREAS, the Town of Wappinger Recreation Department sponsors the Town of
Wappinger Community Day; and
WHEREAS, the Town Board authorized the use of Schlathaus Park for the 42nd Annual
Town of Wappinger Community Day which is to be held on September 9, 2017; and
WHEREAS, the Town of Wappinger Community Day has always provided a number of
activities, including carnival rides, games and concessions for the attendees; and
WHEREAS, the Town entered into an Agreement with C & N Amusements, Inc., dated
March 3, 2017, to provide for the operation of carnival rides, games and concessions, all as set
forth in said Agreement; and
WHEREAS, after the signing of the Agreement it was decided to add an additional ride
at an additional cost to the Town, requiring an Amendment to the Agreement to reflect the
additional changes, a copy of which is affixed hereto.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
The Town Board hereby authorizes and directs the Town Supervisor to execute the
Amendment to Agreement between the Town of Wappinger and C & N Amusements,
Inc. in substantially the same form as affixed hereto.

RESOLUTION: 2017-97
Resolution Authorizing Budget Amendment To Cover Cost Of Schlathaus Park Roof
Repair
WHEREAS, Town Comptroller, Fredrick Awino, by email dated May 3, 2017, to Town
Supervisor, Lori A. Jiava, a copy of which is affixed hereto, requested budget amendments
between various line items to reflect the receipt of insurance proceeds in consequence of
damages to the roof of a building located at Schlathaus Park, which was covered by insurance.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby authorizes the following budget line increases:
a. an increase in the additional revenue to budget line A.0000.2680
Insurance Recoveries in the amount of $5,849.00 resulting from damages to the building located
at Schlathaus Park, which was covered by insurance; and
b. an increase in the additional expenditure to budget line A.7110.424 Schlathaus
Park in the amount of $5,849.00 to cover the cost of repair to the building at Schlathaus Park.
The foregoing was put to a vote which resulted as follows:

IX. Items for Special Consideration/New Business
Councilman Fenton asked about the recent vandalism at Quiet Acres Park. Councilman
Kuzmicz concerned about vandalism at many parks. Supervisor Jiava said there was vandalism
at Carnwath Park this past weekend. Councilman Kuzmicz said that there was talk about
cameras at the parks. Supervisor Jiava said we have cameras at some of the parks.
Councilman Ciccarelli asked about parking at boat launch to prepare a no parking local law in
that area. Steve Frazier talked about no parking zones. Councilman Beale suggested checking
with the attorney to verify property lines in that area. Attorney Roberts agreed to prepare a local
law and distribute it to the entire board.
Councilman Beale informed the board that the Town of Wappinger has submitted 'Forced
Account Labor' and'Forced Account Equipment' information storm related expenses for the
blizzard of March 14 and 15. The county is working with the municipalities and the state office
of emergency management and FEMA to gather all the information to reach the amount of
money to pursue re -imbursement. Dutchess County did meet that amount but the state may not.
1. Motion To: Palmatier Park
Councilman Beale informed the board that last year there were a couple of invoices not paid
having to do with the finalization of creating the Palmatier Park. He asked the board to approve
a past capital expense for the Palmatier Park in the amount of $4,315.05 to be paid out of the
Parkland Trust. No documentation was filed with the Town Clerk.

Councilman Beale informed the board that there is necessary landscaping work that needs to be
done at the Palmatier Park for the Memorial Day ceremony. He asked for $2,114 to come out of
account Town Board Contingency line item A1010.0405. He recommended using the same
contractor that built the park. No documentation was filed with the Town Clerk.

RESOLUTION: 2017-11
Resolution To Authorize The Town Supervisor, Town Highway Superintendent And Town
Board To Execute The Agreement For The Expenditure Of Highway Moneys
WHEREAS, pursuant to Section 284 of the Highway Law, the Town Board and the
Town Highway Superintendent are required to enter into a written Agreement stating the places
and manner in which the Highway fund appropriation for repairs and improvements are to be
expended; and
NOW, THEREFORE BE IT RESOLVED, that the Town Highway Superintendent and
the Town Board agree that the monies levied and collected in the Town for repair and
improvement of highways, and received from New York State for State Aid for the repair and
improvement of Highways shall be expended in accordance with the annexed Agreement for the
Expenditure of Highway Moneys; and
BE IT FURTHER RESOLVED, that the Supervisor and the Town Board are hereby
authorized and directed to execute the attached AGREEMENT FOR THE EXPENDITURES OF
HIGHWAY MONEYS in duplicate and file said agreement with the Town Clerk; and
BE IT FURTHER RESOLVED, that the Town Clerk is directed to forward one
executed Agreement to the Dutchess County Commissioner of Public Works in his capacity as
County Superintendent of Highways.

I have been a town resident for the past .50 years plus and have been,
involved in the towns recreation for some 40 years., as a recreation
director and several terms as a committee member. I am happy to
.say, I am pleased to see the enthusiasm and town board co-operation
under your leadership, whereby there have been many upgrades such as
Martz Field pavilion, playground equipment at Robinson Lane, upgrade
of the town hall., Schlathaus property and finally upgrading the State Police
/Ambulance building. Another major element that pleases me along with
many others is your fight on drugs and.being part of the, county coalition in
an attempt to stamp out drug use. I know.and feel that you will continue to
move the town in a more aggressive and positive direction and_I look

The ZBA is recommending that the Town Board increase the fees for residential
variance to remain at $250.00 for any variance of 10% or less. This is to be increased
to $500.00 for residential variance for anything over 10%. Commercial variance is to be
increased to $1,000.00.

BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section 1: Title
This Local Law shall be known and cited as "Local Law No. —of 2017, for the purpose of
amending Chapter 240, Zoning, of the Town Code by Adding New Principal and Accessory Uses
Regarding the Restoration and Sale of Antique Vehicles, Respectively."
Section 2: Legislative Intent
The Town Board believes that it is reasonable and appropriate to update and amend Chapter 240,
Zoning, of the Town Code with respect to the restoration and sale of antique vehicles. This local
law is determined to be an exercise of the police powers of the Town to protect the public health,
safety and welfare of its residents.
Section 3: Amendments to the Text of Chapter 240, Zoning
In the Schedule of Use Regulations – Nonresidential Districts referenced in Section
240-37:
a. Under the heading Automotive, the new use "Restoration of antique vehicles" shall
be added as a Special Permit Use (SPU) in the HB Highway Business, HM Hamlet
Mixed Use, NB Neighborhood Business, GB General Business, CC Conservation
Commercial, SC Shopping Center and Al Airport Industry zoning districts.
b. Under the heading Automotive, the new use "Sales of a maximum of seven antique
vehicles per year in connection with the restoration of antique vehicles" shall be
added as a Permitted Accessory Use (PA) in the HB Highway Business, HM Hamlet
Mixed Use, NB Neighborhood Business, GB General Business, CC Conservation
Commercial, SC Shopping Center and Al Airport Industry zoning districts.
2. The following new definition shall be added to Section 240-5:

Section 4: Ratification, Readoption and Confirmation
Except as specifically modified by the amendments contained herein, the Code of the Town of
Wappinger as adopted and amended from time to time thereafter is otherwise to remain in full force
and effect and is otherwise ratified, readopted and confirmed.
Section 5: Numberina for Codification
It is the intention of the Town of Wappinger and it is hereby enacted that the provisions of this
Local Law shall be included in the Code of the Town of Wappinger; that the sections and sub-
sections of this Local Law may be re -numbered or re -lettered by the Codifier to accomplish such
intention; that the Codifier shall make no substantive changes to this Local Law; that the word
"Local Law" shall be changed to "Chapter," "Section" or other appropriate word as required for
codification; and that any such rearranging of the numbering and editing shall not affect the validity
of this Local Law or the provisions of the Code affected thereby.
Section 6: Separability
The provisions of this Local Law are separable and if any provision, clause, sentence, subsection,
word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any person or
circumstance, such illegality, invalidity, or unconstitutionality, or inapplicability, shall not affect or
impair any of the remaining provisions, clauses, sentences, subsections, words or parts of this
Local Law or their application to other persons or circumstances. It is hereby declared to be the
legislative intent of the Town Board of the Town of Wappinger that this Local Law would have been
adopted if such illegal, invalid or unconstitutional provision, clause, sentence, subsection, word or
part had not been included therein, and if such person or circumstance to which the Local Law or
part thereof is held inapplicable had been specifically exempt therefrom.
Section 7: Effective Date
This Local Law shall take effect immediately upon filing with the Secretary of State as provided by
the Municipal Home Rule Law.

AGREEMENT FOR OPERATION OF CARNIVAL RIDES FOR
TOWN OF WAPPINGER COMMUNITY DAY
THIS AMENDMENT to the AGREEMENT FOR OPERATION OF CARNIVAL RIDES FOR
TOWN OF WAPPINGER COMMUNITY DAY dated March 3, 2017 is made this day of May,
2017, by and between,

a municipal subdivision with
its office located at Town Hall, 20 Middlebush Road,
Wappinger Falls, New York, 12590
(hereinafter referred to as the "TOWN")
and
C & N AMUSEMENTS, INC.
a New York corporation with
its principal offices at 209 Lakeside Road,
Newburgh, New York, 12590
(hereinafter referred to as "C&N")
WITNESSETH:
WHEREAS, the Town of Wappinger Recreation Department sponsors the Town of Wappinger
Community Day; and
WHEREAS, the Town Board authorized the use of Schlathaus Park for the 42nd Annual Town
of Wappinger Community Day which is to be held on September 9, 2017; and
WHEREAS, the Town of Wappinger Community Day has always provided a number of
activities, including carnival rides, games and concessions for the attendees; and

WHEREAS, the Town entered into an Agreement with C & N Amusements, Inc., dated March
3, 2017, to provide for the operation of carnival rides, games and concessions, all as set forth in said
Agreement; and
WHEREAS, after the signing of the Agreement it was decided to add an additional ride at an
additional cost to the Town.
NOW, THEREFORE, the above -referenced Agreement is amended as hereinafter set forth:
1. Recitations Incorporated. The recitations above set forth are incorporated in this
Agreement as if fully set forth and recited herein.
2. Amendments.
A. Paragraph 2.2 is amended to read as follows:
"The TOWN shall pay C & N the sum of Seven Thousand Four Hundred
Ninety -Nine Dollars ($7,499.00) for the operation of all amusement rides
provided in Paragraph 2.3 subject to the terms and conditions of this
Agreement."
B. Paragraph 2.3.1 is amended to read as follows:
"One Rock Wall
One Musical Chairs Swing Set
One 100 foot Slide
One Paratrooper"
6. Modification. Except as herein amended, the original Agreement between the TOWN
and C & N dated March 3, 2017 is otherwise ratified and confirmed.

Please find the revised 284 Agreement To Spend Highway Funds for your review and approval
The attached town roads are approximately 20 years plus and in need of paving. These roads
also vary in width and surface conditions.
I am recommending the resurfacing of Brothers Road, as it would be cost effective to complete
1.38 miles and would save on cost by not having to continually move the machinery.
The comptroller established the road cost profile of 1.47 miles based on 2016 costs.
Be advised, we do not have asphalt pricing or rental rates as of yet, for 2017.

Dutchess County, New York, and the undersigned members of the Town Board.
T-ursuant to the provisions of Section 284 of the Highway Law, we agree that moneys levied and
collected in the Town for the repair and improvement of highways, and received from the State for
State Aid for the repair and improvement of Highways, shall be expended as follows:
1. GENERAL REPAIRS. The sum of $ 1,119,265 shall be set aside to be expended for primary
work and general repairs upon _100 miles of town highway, including sluices, culverts and
bridges having a span of less than five feet and boardwalks or the renewals thereof.
