1. Motion To: Open Public Portion
Resident Lindstrom asked a two-part question. One dealt with the process of a water tanker and
why the apparatus was not transferred to another chassis put on a trailer or put in a large dump

truck and used as needed. The other dealt with the term rent versus lease. Superintendent
Bettina explained that the tank was great, but a lot of the valves needed repair and the truck
could still be used as a rack truck. He answered part 2 by stating that it was a lease not a one or
two-day rental.
Resident Schmalz asked about the location of the Wappinger Farms Athletic field. She added
that pop warner always used the school fields and that it was not necessary to spend taxpayer's
money for programs that are not entirely for Town of Wappinger residents.

VII. Discussions
1. Recognition - George Silvestri/Terry Glass (Jiava)
Superintendent Bettina praised his two retiring employees, George Silvestri and Terry Glass. He
pointed out that they have a combined 74 years, 44 for George and 30 for Terry.
2. Recycle Center Report from DEC (Jiava)
Superintendent Bettina reported the DEC findings at the recycle center and its compliance with
no violations. Councilman Beale thanked the Superintendent for his work at the recycle center.
3. Water Truck Rental(Jiava)
Superintendent Bettina explained the details of the need to lease the water truck. Mr. Bettina
explained that the tank was great, but a lot of the valves needed repair and the truck could still be
used as a rack truck. He stated that it was a lease not a one or two-day rental.
4. Motion To: Start the Process for the Ridges drainage district
Attorney Roberts spoke and explained the 8 lot subdivision project off Old Hopewell Estates.
He noted that the developer is paying all the costs. Petition have been filed with Town Clerk
Paoloni and asked to forward the paperwork to the Attorney and Conflict Engineer to put
together the paperwork for the formation. Supervisor Jiava asked for a motion to authorize the
Attorney Al Roberts and Engineer Paggi to start proceedings to formalize the drainage for the
subdivisions.

5. Wappinger Farms Athletic Field(Jiava)
Engineer Gray explained the property under discussion adjacent to the Robinson Lane ball fields.
He explained that the property on the northeast side of the ball fields was studied by Chazen
Engineering and they could only get one field at that location. The Wappinger Farms location is
on the opposite or on the south west side of the ball fields. He explained that looking at that
property would cost more money. He said that property could support four fields. He pointed
out that the wetlands are by the creek only. He explained that football and soccer advocates are
not pursuing it as intensively as they once were. The board agreed that they would not want to
spend money on all these environmental studies for a property that the town doesn't even own
and concluded that this would be a discussion for another night.
6. Marshall and Sterling (Jiava)
Peter A. Carr of Marshall & Sterling, Inc. Has negotiated an insurance coverage proposal for the
Town of Wappinger through NYMIR for general comprehensive liability insurance, with cyber
coverage being provided by Hiscox, for a total combined premium charge of$186,203.28, as set
forth on the Premium Summary prepared by Marshall & Sterling, Inc.; and the proposed
coverage through NYMIR and Hiscox will result in an approximate premium savings of
$51,450.00. Peter Carr explained that NYMIR insures 900 subscribers of municipalities spread
out throughout the state and reinsures itself. Ryan from NYMIR explained NYMIR and its
financial stability. He added that for every dollar of written premium they have $1.70 of surplus
compared to traditional insurance companies that for every dollar of written premium have only
50 cents of surplus. Councilman Fenton asked about the credit worthiness of their 900
customers. Mr. Carr said that they accept customers that are under section 2 of the New York
State finance law. Councilman Beale asked about the risks. Peter Carr said there was very little
risk and offers more and better coverage. He explained that the contribution is 10% of the first
year's premium and that there are no high risk municipalities with a 99%retention rate.
Councilman Fenton asked for a list. Ryan said that he sent a list to Michael. The unanimous
approval concluded the discussion.
RESOLUTION: 2016-72
Resolution Authorizing Change In Insurance Carriers
WHEREAS, the Town of Wappinger employs the firm of Marshall & Sterling, Inc. as its
insurance consultants and agent; and
WHEREAS, Peter A. Carr of Marshall & Sterling, Inc. has negotiated an insurance coverage
proposal for the Town of Wappinger through NYMIR for general comprehensive liability insurance, with

WHEREAS, the machinery and equipment rental rates, including operator, are itemized and
identified in a certain email dated January 11, 2016 from Karol Kelly, Secretary of the Highway
Department, a copy of which is affixed hereto; and
WHEREAS, the machinery and equipment rental rates, including operator, procured by the
Highway Superintendent are not subject to competitive bidding but are subject to Town Board approval.

Resolution Authorizing Rental Of Water Truck For Highway Department
WHEREAS,pursuant to New York State Highway Law § 143, the Town Superintendent
of Highways may rent or hire machinery or equipment at a rate to be approved by the Town
Board; and
WHEREAS, the Town Superintendent of Highways, Vincent F. Bettina, has negotiated
the rental of a 2000 Roscoe Water Truck, Model 4 DS2000, Serial 4 36828, from Hoffman
Equipment, Inc., with offices located at 1440 Route 9W, Marlboro, New York, for a period of
five(5) months; and
WHEREAS, the rental rate for a period of five (5) months is $17,500.00,payable
$3,500.00 per month, commencing on January 25, 2016; and
WHEREAS, the Town Board hereby approves the rental of above-described Water
Truck from Hoffman Equipment, Inc. for a period of five(5) months commencing on January
25, 2016 through June 25, 2016; and

WHEREAS,the Town will pay for the cost of insuring the Water Truck during the term
of the rental.

3. The Town Superintendent of Highways is hereby authorized to rent the above-
described Water Truck from Hoffman Equipment, Inc. in accordance with the attached Standard
Lease Agreement, a copy of which is affixed hereto.

RESOLUTION: 2016-68
Resolution Extending Temporary Town-Wide Moratorium On The Installation Of
Freestanding Or Ground-Mounted Solar Energy Systems For One Additional Three
Month Term
WHEREAS, on November 9, 2015, by Resolution 2015-232, the Town Board adopted
Local Law 2 of 2015 which established a Temporary Town-Wide Moratorium on the Installation
of Freestanding or Ground-Mounted Solar Energy Systems in the Town of Wappinger; and
WHEREAS, Section XI of Local Law 2 of 2015 provided for a moratorium term of three
months from its effective date, subject to review and renewal by the Town Board of the Town of
Wappinger for two (2) additional three (3) month extensions by Town Board Resolution; and
WHEREAS, Local Law 2 of 2015 became effective on December 3, 2015 upon filing
with the Secretary of State, and therefore it shall expire on March 3, 2016 unless it is extended;
and
WHEREAS, the purpose of the Temporary Town-Wide Moratorium on the Installation
of Freestanding or Ground-Mounted Solar Energy Systems is to preserve the status quo in the
Town of Wappinger pending the completion and adoption of the Town's new zoning regulations
with respect to solar energy systems; and
WHEREAS, the new zoning resolutions are being drafted and reviewed, and it is
anticipated that the revisions will be adopted by June 3, 2016; and

WHEREAS, the Town Board has determined an extension of the moratorium term is
warranted and it is in the best interest of the residents and property owners of the Town of
Wappinger to extend the provisions of Local Law 2 of 2015 for an additional three month term
by resolution pursuant to Section XI thereof, and
WHEREAS, The Town Board may terminate the Moratorium earlier than three months
provided that the new zoning law is adopted and the appropriate revision to the land use
regulations have been made.
NOW, THEREFORE, BE IT RESOLVED, as follows:

The Town Board hereby extends the Temporary Town-Wide Moratorium on Residential
Development established by Local Law 2 of 2015 for an additional three month term

have a contract with DCDPW for blacktop, in place in the town of Wappinger for county routes which the town may take
