Supervisor explained that in order to make improvements to the district properly the'Sewer Improvement' area must be a'District' in order to bond to do work. The work that needs to be done is to prevent the infiltration of storm water into the pipes during the presence of ground water rendering the plant effluent to not meet the specific criteria mandated by DEC thus issuing a fine and mandating the required repairs. The quarterly sewer charge will essentially remain the same; however, the town will borrow $280,000 to be paid out over a 20 year period and added to the special district's tax bill once per year. Ms. McWilliams asked if the loacl residents will serve extra people. Attorney Roberts replied, "The same people, same area, same sewer plant, it's just a conversion to a different municipal entity because regrettably in the future there is going to be more required improvements as they get mandated by DEC, so rather than having form and re-form; this will create a district which will allow the town on your behalf to make any borrowings necessary to keep the plant consistant with DEC requirements." Resident Al Casella asked when the process will start and isn't there a fund balance. Attorney Roberts said that the UWWD fund balance is a separate district and funds cannot be co-mingled. He added that it amortize after 20 years and the price will come off. Engineer Gray said the work will start in the spring of 2017. R.Holt's letter recommending Randy Ross to Rec Committee COMMENTS-Current Meering: Mr. Holts was not available so Councilman Kuzmicz referred Randy Ross in Mr. Holt's absence. 2. Degnan Retail Center - Change of Zone Application -MHV Realty COMMENTS-Current Meering: The representative for Degnan Retail center addressed the board and explained that this project will require a change in zone from Highway Design to Highway Business for an 8 1/2 acre parcel on the east side of 1708 route 9 adjoining the Wappinger Creek. He cited an existing on the building with 16,000 square feet . Supervisor Jiava asked for an $10,000 escrow. Attorney Roberts said that it needs to be referred to the planning board. Supervisor Jiava summarized the three things that needed to be done, establish the escrow, refer to the planning board and added that and to work with the planner and the engineer. 3. Motion To: Obercreek/DC Water and Wastewater/Chazen Richard Cantor came to the board to explain the progress of the Obercreek project. Obercreek received conditional subdivision approval from the planning board in June 2016. The lots range from 0.11 acres to 13 acres in size. Water will come from private wells. The wastewater system is proposed to be a county district through the county wastewater authority to be approved by the county wastewater authority and the Dutchess County legislature. The approvals that he will be asking for from this board is a no further sub-division. They are planning a sewer line on Marloville road subject to approval of the Highway Superintendent and the town board. They are also planning to deed a 25 foot from the center of Marloville road in toward to the subdivision for town board approval along with a storm water agreement. United Wappinger Water District Extension -Joseph Jordan Bill Poval from R.J. Holdings addressed the board regarding a subdivision of a 5.8 acre parcel with borders of Myers Corners Road, Robert Lane, and Patti Place adjacent to the old H &B office building. They are planning a 9 lot conventional subdivision. They are looking to petition the board to enter the United Wappinger Water district. Both Councilmen Kuzmicz and Fenton Town of Wappinger Page 4 Printed 121112016 Regular Meeting Minutes November 14, 2016 expressed concern about adding an additional road cut into Myers Corners Road especially so close to Robert Lane and the impending traffic concerns. Councilman Beale said, "Our role as a town board really has nothing to do with that,we're looking at this from a water district perspective and my position would be if we have the water to provide to these additional homes, certainly I would not have an objection to it. It fits within the existing zoning." Councilman Kuzmicz said, "I also would like to make sure that our traffic concerns are addressed on an already congested Myers Corners Road." Councilman Fenton agreed saying, "Councilman Kuzmicz and myself and our constituents are all right there and I'm telling you right now, it's an issue." Councilman Beale replied, "I'm not sure we have the authority require that." Supervisor Jiava agreed saying, "We don't. As long as it's within the zoning and planning board and agrees with that the studies that have been done then we just making remark as to." Councilman Beale interjected, "I'm not sure that that's our role. Attorney Roberts, said, "It's really a planning board function for them to decide. If you have those issues, I would suggest that you transmit them to the planning board. Certainly Bob and I can relay this information." Councilman Beale said, "We've had a lot of traffic studies done in this town and they've really proved useless, in my opinion." Councilman Kuzmicz cited empirical evidence as to support his concerns. Councilman Beale said, "It's a county road." Councilman Fenton said, "Maybe we can reach out to the county." Supervisor asked the applicant to put a formal district extension request in and asked Mr. Macho to establish an escrow. Councilman Beale thought it interesting that the land had sewer, but no water. Engineer Gray indicated that the sewer main that the applicant would provide would be very handy for future expansion. Supervisor Jiava said, "When we look at it as a whole, it's only 9 houses. It's not like we're asking for a sub-division of 40. I understand both sides." The escrow was set to $7,500. Engineer Gray addressed Councilman Kuzmics and said, "Mike, I think we might want to see if we could piggy-back those lots over on All Angles Hill road that we've talked to at the same time; and, make it a little bit more affordable for everybody." Councilman Kuzmicz said that would be a good idea. The discussion concluded. 5. Re-Appointment of Lynn O' Dell to the Board of Assessment Review This was removed from the agenda. IX. Resolutions RESOLUTION: 2016-283 Resolution Adopting Annual Budget For Fiscal Year 2017 WHEREAS, on November 2, 2016, the Town Board, pursuant to and in accordance with the provisions of Section 106 of the Town Law and other applicable provisions of law, accepted the Preliminary Budget, by Resolution No. 2016-269; and WHEREAS, in accordance with Resolution No. 2016-269, a Public Hearing on the Preliminary Budget which was scheduled for November 9, 2016 at 7:30 p.m. and all parties in attendance were permitted an opportunity to speak on behalf or in opposition to the proposed Annual Budget for the fiscal year 2017; and WHEREAS, the Town Board has taken into consideration the comments made by the public at the Public Hearing. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. RESOLUTION: 2016-291 Resolution Designating Unrestricted Fund Balance as Taxpayer Protection Fund" WHEREAS, Chapter 97 of the Laws of 2011 established a tax levy limit on all local governments in New York State, effective January 1, 2012; WHEREAS, this law requires that local governments maintain any property tax increase to no more than 2 percent or the rate of inflation, whichever is less; WHEREAS, the law does provide exemptions for certain specific costs and allows the governing board to override the tax levy limit with a supermajority vote; WHEREAS, the Town Board of the Town of Wappinger has earnestly complied with this law and its specific regulations each fiscal year since the inception; WHEREAS, the Town Board of the Town of Wappinger will supersede the requirements of this law in Fiscal Year 2017; WHEREAS, this action by the Town Board of the Town of Wappinger will result in a reduction of effective property tax rates for residential and commercial parcels within the Town of Wappinger, both inside and outside the Village of Wappingers Falls; WHEREAS, the Town of Wappinger has an accumulated unrestricted fund balance; NOW, THEREFORE BE IT RESOLVED, that the Town Board of the Town of Wappinger direct the Town Supervisor to earmark $400,000 in unrestricted fund balance as a Taxpayer Protection Fund for the purpose of ensuring that the Town of Wappinger will comply with Chapter 97 of the Laws of 2011 during Fiscal Years 2018, 2019. RESOLUTION: 2016-284 Resolution Authorizing Refund Of Unused Escrow For Swenson Subdivision (Account 09- 5154) WHEREAS, on or about July 22, 2009, Reed Swenson (hereinafter the "Applicant") filed an application for Subdivision Approval under Application Number 09-5154; and WHEREAS, total escrow deposits in the amount of Twenty-One Thousand Dollars ($21,000.00) were received from the Applicant for payment of the fees of the Town's professionals to review the application; and WHEREAS, the Applicant has made a request to have the application withdrawn and the unused escrow balance be refunded; and WHEREAS, all professional fees incurred during the review of the application have been paid and there remains a balance of Nine Thousand Four Hundred Seventy-Five 80/100 Dollars ($9,475.80) in escrow account number 09-5154 and Applicant has requested a refund and the Town Accountant has audited the escrow account and reviewed the amount due. RESOLUTION: 2016-285 A Resolution Making Certain Determinations In Relation To And Approving The Establishment Of Mid-Point Park Sewer District Of The Town Of Wappinger, Dutchess County, New York, Pursuant To Article 12-A Of The Town Law WHEREAS, a map,plan and report have been prepared in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Wappinger, Dutchess County, New York, relating to the establishment of Mid-Point Park Sewer District of said Town (the "District"); WHEREAS, said map, plan and report were prepared by a competent engineer, duly licensed by the State of New York, and have been filed in the office of the Town Clerk of said Town, where the same are available during regular office hours for examination by any persons interested in the subject matter thereof, WHEREAS, said Mid-Point Park Sewer District shall be bounded and described as hereinafter set forth; WHEREAS, the improvements proposed for said Mid-Point Park Sewer District consists of improvements to the sewer collection system by sliplining or relining of gravity sewer main along Gabriella Drive and in vicinity of the boundary of the existing Mid-Point Park Wastewater Treatment Plant and related reconstruction work (which facilities were made an improvement of the Mid-Point Park Sewer Improvement Area in said Town held by the Town for the benefit of the properties therein by Order of the Town Board dated and duly adopted on June 10, 1974 pursuant to Article 12-C of the Town Law, an area coterminous with that of the proposed District but for the addition of one parcel as hereinafter described), including original equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith as more fully described in the aforesaid map,plan and report; WHEREAS, the maximum amount proposed to be expended for said improvement is $280,000; WHEREAS, said capital project has been determined to be a "Type 11 Action" pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act ("SEQRA"), including 6 NYCRR Part 617.5(c)(2), (c)(5) and(c)(29), the implementation of which as proposed, the Town as Lead Agency has determined, as so defined, will not result in any significant adverse environmental impact and SEQRA compliance materials are on file in the office of the Town Clerk where they may be inspected during normal office hours, and the establishment of said District is likewise a "Type 11 Action"; and WHEREAS, said improvements are required pursuant to an Order on Consent between the Town and the State of New York Department of Environmental Conservation (Case No. R3- 20150210-16); and WHEREAS, the proposed method of financing the cost of said improvements consists of the issuance of not to exceed $280,000 serial bonds of said Town maturing in annual installments over a period not exceeding thirty years, which will be payable in the first instance from an annual assessment upon the several lots or parcels of land in said District which the Town Board shall determine and specify to be specially benefitted thereby in proportion to the benefit derived therefrom, in an amount sufficient to pay the principal and interest on said bonds as the same become due, but if not paid from such source, all the taxable real property in said Town shall be Town of Wappinger Page 8 Printed 121112016 Regular Meeting Minutes November 14, 2016 subject to the levy of ad valorem taxes without limitation as to rate or amount sufficient to pay the principal of and interest on said bonds as the same shall become due and payable; and WHEREAS, there are no estimated costs of hook-up fees to the typical property in Mid- Point Park Sewer District as existing property owners in the proposed District are currently being serviced; and WHEREAS, the estimated cost of the establishment of the Mid-Point Park Sewer District to the typical property therein is $894.00 in the first year in which operation, maintenance, debt service and other charges and expenses are to be paid; and WHEREAS, a detailed explanation of the manner by which such first-year costs to the typical property were computed, has been filed in the office of the Town Clerk where the same are available during regular office hours for examination by any person interested in the subject manner thereof, and WHEREAS, on April 25, 2016, a public hearing was duly held to consider establishment of said District; and WHEREAS, it has since been determined that the proposed boundaries of said District as presented in said Map, Plan and Report included a parcel of land that was not connected to the Mid-Point Park Sewer System, said parcel being 1415 Route 376 in the Town of Wappinger, Tax ID No. 135689-6259-04-921040, it having been the intention of the Town Board that the boundaries of the proposed District only include parcels actually connected to the Mid-Point Park Sewer System; and WHEREAS, said parcel is prohibited from connecting to the Mid-Point Park Sewer System because of New York State Department of Environmental Conservation (NYS DEC) permit limitations and is therefore not benefitted by the proposed Mid-Point Park Sewer District; and WHEREAS, the elimination of said parcel and other revisions to the February 2016 Report in connection therewith were necessary and have been completed; and WHEREAS, the February 2016 Report has been revised by the preparation of Amendment No. 1 to the Map, Plan and Report by Morris Associates Engineering Consultants, PLLC dated October 24, 2016 and same has been filed in the Office of the Town Clerk of said Town where same, together with the February 2016 Report, is available during regular office hours for examination by any person interested in the subject matter thereof, and WHEREAS, the revised boundaries of said District shall be as described in Schedule A attached hereto and hereby incorporated herein and consist of and are coterminous with the boundaries of the Mid-Point Park Sewer Improvement Area established in 1974 plus the Blue Fin Acquisition Corp. parcel which had been permitted to connect to the Mid-Point Park Sewer System as a tenant; the Blue Fin parcel is described as tax grid parcel No. 6529-04-907028; and WHEREAS, an Order was duly adopted by said Town Board on October 24, 2016, reciting a description of the revised boundaries of said proposed Mid-Point Park Sewer District, the improvements proposed, the maximum amount proposed to be expended for said improvements, the fact that said map, plan and report were on file in the Town Clerk's office for public inspection and specifying the 14th day of November, 2016, at 7:30 o'clock P.M., Prevailing Time, at the Town Hall, in Wappingers Falls, New York, in said Town, as the time when and the place where said Town Board would meet for the purpose of holding a public hearing to consider the establishment of said Mid-Point Park Sewer District with the boundary revised as described herein and said map, plan and report filed in relation thereto and to hear all persons interested in the subject thereof concerning the same; WHEREAS, notice of the aforesaid public hearing was duly published and posted in the manner and within the time prescribed by Section 209-d of the Town Law, and proof of publication and posting has been duly presented to said Town Board; The establishment of Mid-Point Park Sewer District of the Town of Wappinger, Dutchess County, New York, to be bounded and described as hereafter set forth, and the improvement therefor consisting of improvements to the sewer collection system by sliplining or relining of gravity sewer main along Gabriella Drive and in vicinity of the boundary of the existing Mid-Point Park Wastewater Treatment Plant and related reconstruction work, including original equipment, machinery, apparatus, appurtenances, and incidental improvements and expenses in connection therewith, at a maximum estimated cost to the Mid-Point Park Sewer District of$280,000, are hereby approved. Section 3. Said Mid-Point Park Sewer District with boundary revised as described herein shall be bounded and described as set forth in Appendix A attached hereto and hereby made a part hereof. Section 4. Resolution No. 2016-162 of this Town Board is hereby superseded. Section 5. The Town Clerk shall, within ten (10) days after the effective date of this resolution, file certified copies of this resolution in duplicate in the Office of the State Department of Audit and Control at Albany, New York. The amendment was part of Local Law No. 1 of 2015 adopted on April 27, 2015. Section 5 of the Local Law as it has been published is entitled "Application of Local Law" and provides that the zoning amendments in this omnibus amendment shall not apply to any property for which an application for site plan approval has been properly filed with the Town of Wappinger as of the effective date of the Local Law. The Local Law was to become effective immediately upon filing with the Secretary of State. I attach a copy of Amended Resolution 2015-115 to exempt subdivisions by including subdivisions in the exemption language at p. 17 of the Local Law. i { also attach a copy of the Local Law taken from the Minutes of the April 27 meeting.
