Mary Schmalz informed that the Grinnell Library is having a vote on Tuesday October 4th to

1. Motion To: Give Planning Board to move forward with the Eduardo Lauria Luxury
Apartments
Attorney Al Roberts explained that the subject property owned by Mr. Lauria is proposing a 14
unit apartment building with a Laundromat. The applicant will be subject to buy in fees and the
water and sewer lines that the applicant has constructed will have the capacity required to handle
the expected usage. Supervisor Jiava agreed to draft a letter on the subject.

2. Motion To: Direct Attorney to Draft Local Law to implement Stop Sign at Carroll and Davies
Councilman Fenton led the discussion to put a three way stop sign at Carroll and Davies. He
provided a letter to the Supervisor who read it live. He added that tickets must be given to
speeders. Attorney Roberts asked to be authorized to prepare the Local Law. Councilman Beale
suggested a town patrol to enforce the speeding on Carroll drive as signs alone would not suffice.

RESOLUTION: 2016-246
Resolution Authorizing A Public Hearing On The Intended Use Of Dutchess County
Community Development Block Grant Funds And The Submission Of The Grant
Application For Fiscal Year 2017
WHEREAS,the Dutchess County Department of Planning and Development is
soliciting applications for the 2017 Community Development Block Grant Program; and
WHEREAS,the Town of Wappinger intends to make application for a Community
Development Block Grant pursuant to the Dutchess County Department of Planning and
Development's Community Development Block Grant Program for fiscal year 2017; and
WHEREAS,the Town of Wappinger is required to hold a Public Hearing to discuss the
Town's intended use of Community Development Block Grant Funds prior to and in furtherance
of making application for said funds.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby schedules a Public Hearing to be held at Town Hall, 20
Middlebush Road, Wappingers Falls, New York, on the 11th day of October, 2016 at 7:30 P.M.
at such time all parties and citizens shall have an opportunity to be heard as to the grant proposal
for the Community Development Block Grant Funds being applied for by the Town of
Wappinger for fiscal year 2017.
3. The Town Board has determined that pursuant to 6 NYCRR 617.5(c)(21) the
proposed adoption of the aforementioned Resolution is a Type II action not requiring
environmental review pursuant to the State Environmental Quality Review Act (SEQRA) or
pursuant to Local Law No. 6 of 1992 and, accordingly, no environmental review has been
undertaken.
4. The Town Clerk is hereby directed to publish and post the Notice of Public
Hearing in the form annexed hereto which said publications are to be made in the Poughkeepsie

Journal and the Southern Dutchess News at least five (5) days prior to the scheduled Public
Hearing and post same on the Town's website and the sign board maintained by the Town Clerk.

Albert P. Roberts, and the Engineer to the Town, Robert J. Gray, to assist the Supervisor to
prepare and submit the Grant Application for fiscal year 2017.

Resolution Authorizing Refund Of Unused Escrow For The Golden Dog Grooming, Inc.
Site Plan (Account 14-3312)
WHEREAS, on or about June 18, 2014, The Golden Dog Grooming, Inc. (hereinafter
the "Applicant") filed an application for Site Plan Approval under Application Number 14-
3312; and
WHEREAS, total escrow deposits in the amount of Four Thousand Three Hundred
Ten 55/100 Dollars ($4,310.55) were received from the Applicant for payment of the fees of
the Town's professionals to review the application; and
WHEREAS, all professional fees incurred during the review of the application have
been paid and there remains a balance of Six Hundred Eighty 25/100 Dollars ($680.25) in
escrow account number 14-3312 and Applicant has requested a refund and the Town
Accountant has audited the escrow account and reviewed the amount due.
NOW, THEREFORE, BE IT RESOLVED:
1. The recitations above set forth are incorporated in this Resolution as if fully set

2. The Town Board hereby authorizes a refund to The Golden Dog Grooming, Inc. in the

Resolution Scheduling Town Board Meetings To Adopt Budgets For Fiscal Year 2017

WHEREAS, the Town Supervisor, as Budget Officer, pursuant to § 106 of the Town
Law, has prepared the Tentative Budget for delivery the Town Board for review, examination
and possible revision; and
WHEREAS, said Tentative Budget will be submitted to the Town Clerk on or before
September 30, 2016, as required by law; and
WHEREAS, a Special Town Board meeting will be scheduled for Wednesday, October
5, 2016 at 7:30 p.m. for the purpose of having the Town Clerk deliver the Tentative Budget to
the Town Board in accordance with Town Law § 106; and
WHEREAS, New York State Town Law § 108 requires that the Town Board must hold
a public hearing on the Preliminary Budget on or before the Thursday immediately following the
general election in November; and
WHEREAS, Town Law requires the adoption of a Final Budget on or before November
20, 2016; and
WHEREAS, in order to accomplish the Budget Adoption Schedule set forth in Article 8
of the Town Law, the Town Board hereby establishes the following tentative schedule of Town
Board Meetings set forth below, reserving unto itself the right to change the scheduled meetings
if circumstances require.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town Board hereby schedules the following meetings of the Town Board to
be held at the Town Hall, 20 Middlebush Road, Wappingers Falls, New York, commencing at
7:30 p.m. on the following dates for the purpose of examining, discussing, deliberating and
adopting the Town Budget for calendar year 2017, reserving unto itself the right to change the
scheduled meetings if circumstances require.

benefit assessment rolls for Special Improvement Districts and Improvement Areas within the Town of
Wappinger each year pursuant to Town Law § 202-a; and
WHEREAS, the Town Board is required by Town Law § 202-a to hold a public hearing in
accordance with the provisions of Town Law § 239 to consider any objections to the annual benefit
assessment roll.

WHEREAS, the Town Board annually establishes budgets for the financing of capital
improvements of all Special Improvement Districts and Special Improvement Areas within the
Town of Wappinger for the ensuing year, and as part of the budget process the Town Board
establishes Operation and Maintenance Charges (O&M Charges), Rates and/or Rents, to be
charged against those properties within said Special Improvement Districts or Special
Improvement Areas; and
WHEREAS, the Town Board will have completed the proposed budgets for the
financing of capital improvements for the proposed quarterly O&M Charges, Rates and Rents to
be charged against those properties within said Special Improvement Districts and Special
Improvements Areas for Fiscal Year 2017 no later than October 5, 2016; and
WHEREAS, the Town Board, as required by Town Law, hereby schedules and orders a

X. Items for Special Consideration/New Business
Councilman Fenton addressed the speeders on Central Avenue and Kent Road. Councilman
Kuzmicz recommended to get together with Sargent Begor to discuss the enforcement of
speeders, adding that stop signs without enforcement are in-effective. Resident Terry Clayton of
13 Plaza Road recommended putting speed traps at that location at the opening and closing of the
local high school when students are speeding through. Councilman Beale argued that it's the
residents in that area that are doing the speeding and should not be given a pass. Councilman
Kuzmicz added that the law should be applied to town highway employees driving town vehicles
that have been cited running through the stop signs. Councilman Beale objected to tickets being
given to highway employees citing safety issues of such large vehicles stopped on the roadside;
however,he recommended an email be sent to highway employees to remind them to follow the
vehicle policy with a zero tolerance.

Steve Frazier sent a letter to the supervisor regarding seasonal labor. He recommended Joseph

2. Vandalism at Carnwath Park

Steve Frazier cited more vandalism at Carnwath Park on the entrance gate by vandals seeking
access to the upper fields with their vehicles. He added that the town needs to purchase more
gates to prevent people getting on to the fields where they are ripping up the turf with their cars
and trucks. Councilman Ciccarelli asked if it was recorded by the security cameras purchased
earlier in the year. Mr. Frazier said "The cameras haven't been installed yet, those cameras will
be specifically for the building and probably isn't going to record much of that because the way
the lay of the land is does not allow for it."

I'd like to thank the Highway Department for the excellent job
done in Quiet Acres off New Hackensack Road. I felt the men
worked so efficiently. The entire neighborhood roads were
taken up, several layers, and trucks and men cleaned up
everything left. Somehow the way it was done allowed
residents to get in and out even while paving was being done.
The new roads are smooth and look wonderful. Please pass

Engineer to the Town, which state the applicant has approximately 15 feet from edge of pavement
to sell his hot dogs. Customers are not to park on adjoining vacant property. Per the Highway
Superintendent, location meets the criteria set forth in Section 175-12A.of the Code of the Town
of Wappinger.

The above referenced property was authorized to connect to Town water and sewer utilities via
L-
an agreement for the extension of the United Wappinger Water District and the United e
Wappinger Sewer District in 2012. This agreement represented that the subject property would
not need more than 320 gallons per day of water which was based on the use of the property at
e
that time as a three-bedroom single family residence.
The connection was accomplished by the construction of a privately owned water service and co
UJI
sewer lateral through private easements that were negotiated with adjacent involved properties
by the owner of the subject property. The cost of the installation was borne exclusively by the
owner of the subject property.
The single family residence has since been razed and there is a current application before the
Town Planning Board requesting site plan approval for a new building with thirteen one-
0
bedroom apartments, one three-bedroom apartment and a laundromat with four washing
machines. e
The proposed new use is expected to use no more 1,760 gallons per day for the apartments,
based on the Dutchess County Health Department Standard of 110 gallons per day per bedroom.
The laundromat is expected to use no more than 400 gallons per day based upon studies
indicating a typical laundromat will experience six to eight turns per day per machine, and the
manufacturer's information for the water use per turn(11.9 gallons) for the proposed eighteen-
pound front load washing machines. The total use is not expected to exceed 2,160 gallons per
day.
It is our understanding, as asserted by the Town Engineer,that the Town water and sewer
systems have sufficient capacity to accommodate the additional 1,840 gallons (2,160 gallons—
320 gallons) of water demand and sewage discharge from this project. The original district
extension agreement included provisions that require the owner to pay buy in fees for any

additional capacity above the original 320 gallons per day. The fee for the proposed residential
use would be $1,000 per one bedroom apartment for water and$1,500 per one bedroom
apartment for sewer. The proposed three-bedroom apartment fee would be $3,200 for water and
$4,800 for sewer, which is the same as the fee that would be paid for a three-bedroom single
family residence. The fee for the commercial use would be$10 per gallon for water and$15 per
gallon for sewer, totaling$4,000 and$6000 respectively for the commercial use of 400 gallons
per day. The total buy in fee is $42,500,based on the numbers above and subtracting the fee for
the three-bedroom apartment, which is to be credited for the prior payment for the single family
residence.
The Planning Board has requested that we submit this information to the Town Board for its
review and acknowledgement in writing that the additional water and sewer capacity outlined
above will be authorized for the subject property upon payment of the buy in fee.
We respectfully request that this matter be placed on the Town Board's September 26'agenda.

The following instructions relate specifically to Community Development Block Grant (CDBG) municipal
activities. They work in concert with the following documents to insure consistency between programs for
both the County and our partners:
1. Community Investment Programs Policies and Procedures
2. Procurement Policies and Procedures
These documents should be reviewed when developing and implementing any activity. All documents are
available as searchable PDFs on the Department of Planning and Development's website.
The County's CDBG Program is funded by the Federal government. Federal laws, regulations and guidance
supersedes County policies and procedures in any case where they conflict.
APPLICATION PROCESS
Eligible Applicants—Any municipality which is a member of the 2017 CDBG Urban County Consortium.

Eligibility Determination— One of the most important things to remember is that the Community
Development Block Grant (CDBG) is designed to assist with the development of projects that benefit low and
moderate income residents. Information on eligibility is available in Section B.
All applicants must contact Anne Saylor by Friday, October 7, 2016 at asaylordutchessny. ov or (845) 486-
3600 for an eligibility determination.

Submission Requirements—

1. Application and attachments must be submitted to cd housing@dutchessny.gov by 12:00 p.m., Friday,
October 21, 2016. There is an application checklist at the end of the application form. �-
2. Submit the application and attachments in their original formats (PDF and excel). (DO NOT print, scan
and e-mail scanned documents.)
3. Submission e-mail must come from the authorized certifying official or they must be copied on the e-
mail. An original signature is not needed.
Required Public Hearing—
• Municipality must hold a public hearing to discuss the use of CDBG funds and solicit ideas prior to
application submission. 2

• For joint applications, each municipality must hold a public hearing and pass a resolution CL
supporting the application.
• Municipalities are required to invite representatives from all proposed projects to the hearing. •

• A copy of the public notice, the meeting minutes and the resolution must be submitted with the
application. A sample resolution is attached to the application or is available here.
• Applications submitted without a public hearing are ineligible.

Number of Applications - Only one (1) application may be submitted, except that a second application may
be submitted for an eligible housing activity. Housing activities require a separate application.

PRIORITIES AND ELIGIBILITY
To have the best chance of getting funded, proposed activities should meet a Consolidated Plan priority AND
must meet Federal Eligibility requirements in Sections 1 and 2 below. It is important to remember the CDBG
Program is designed to assist projects that benefit low and moderate income residents.

The County has an obligation to address all the priorities over the Plan period. The County reserves the right
to fund activities as necessary in order to meet this objective.
CDBG POLICIES AND PROCEDURES
The CDBG Program has detailed Policies and Procedures. Below is a summary of the several important items:
Implementation and Architectural/Engineering Costs -Activity implementation and engineering costs for 0.
consultants will be limited to 20% of the activity's final approved allocation. Municipal personnel are not
eligible to be reimbursed for activity implementation.

Start Date—Activities may not begin or incur costs prior to March 1, 2017 (beginning of the program year).
Completion/Expenditure Deadline—Activities allocated funds under this application must be completed and
all funds expended by October 31, 2018 (twenty (20) months from the beginning of the program year).

Environmental Reviews—The County must conduct an environmental review under the National co

Environmental Policy Act (NEPA) and the municipality must ensure compliance with the NYS Environmental
Quality Review Act (SEQRA). Activities may not begin construction until the environmental review is complete.
City of Beacon Annual Allocation -The City of Beacon receives 15% of the annual CDBG allocation after the
deduction of the County's administrative expenses. All program guidelines apply to the City's activities with
the exception of maximum grant award and number of applications submitted.
Public Service Activities— Up to 15% of the annual allocation, after the deduction of the County's
administrative expenses, may be set aside for public service activities. If a public service agency is applying 2
for a construction activity, that is considered a municipal activity and must be sponsored by the municipality in
which the activity is located. Parties interested in non-construction public service activities should apply
directly to the CDBG Public Service or Agency Partner Program using the APG/CDBG Public Service Application. •2
Procurement Requirements-All activities are subject to Federal and County Procurement Policies and
Procedures. This generally includes public bidding and prevailing wages. More detailed guidance is available
in the County's Procurement Policies and Procedures.

APPLICATION REVIEW
Applications are reviewed for completion. Applications that lack required items or contains a technical error
will be notified by email and given ten (10) calendar days to correct the error. Failure to submit the missing
items by the deadline will result in ineligibility.
The application process is competitive. Applications are reviewed based on the below considerations. A site
visit and staff evaluations are conducted. Preliminary staff funding recommendations are presented to the
CDAC. The CDAC reviews the staff recommendations and requests additional information if necessary. CDAC
funding recommendations are sent to the County Executive for final approval.
Review Considerations
The staff will begin the evaluation of each activity by asking:
1. Is the proposed activity eligible under HUD CDBG guidelines?
2. Does the activity address a HUD National Objective (Low/Mod Benefit)?
If the activity does not meet these first two criteria it is ineligible.
Questions 3 through 12 aid in further evaluation and development of funding recommendations.
1. Does the proposed activity meet a priority of the 2013-2017 Consolidated Plan?
2. Does the activity benefit a substantial number of low to moderate income persons?
5. Is the estimated completion time for the activity realistic and allow for completion by the deadline?
6. Does the proposed activity build on previous investments or is it part of a larger development plan?
7. Does the municipality have outstanding CDBG funds?
8. Does the activity represent an innovative approach to a problem?
9. Is the activity consistent with the County's Consolidated Plan, Analysis of Impediments to Fair Housing and
other County Plans such as Directions, Centers and Greenspaces Guide, and the PDCTC Metropolitan
Transportation Plan Moving Dutchess?

10. Is the activity a cooperative effort from two or more municipalities?
11. Has the municipality leveraged other sources of funds? Are they secure? �-
12. How is the municipality's organizational capacity; was the administration of previously activities positive?
13. Is the activity cost effective? Are costs in line with comparable activities?
14. Has the municipality taken action to affirmatively further fair housing?

14. If the applicant has received HOME or CDBG funds in the past, were those projects completed in a
timely fashion and with quality workmanship? Has the applicant maintained the projects in an 2

19. Does the project further fair housing choice throughout Dutchess County?
