Resident Mary Schmalz asked about a statement Attorney Roberts made at the last meeting and
reflected in the minutes stating that "... the second challenge is with New York State parks and
recreation". She pointed to the statement and then questioned whether residents would still be
able to use the Carnwath Park after the "Hops" project gets underway. Attorney Roberts
clarified the statement and responded that the town government may or may not need permission
from the state for the "Hops" project to proceed. He did not address the usage of the park by
residents.

Sparrow's Nest Presentation
Laurie Green from the Sparrow's Nest Came to promote her organization whose mission is
cooking and delivering meals to the families of moms with cancer. She explained that each
Monday recipients will receive 2 trays of homemade food delivered to their door to help relieve
moms stress with everyday life during these hard times. She hoped to sell Tea shirts to town hall
employees for $20 and to promote a dress down day for employees to wear these shirts.
Summer Camp Program
Director Fulton came to the board 2 meetings ago asking for a as a $75 per year increase for the
entire 7 week program. At that time she was asked to outline a list of activities for this meeting
to justify the requested increase. She explained an average day of events along with specific
activities that are planned throughout the year. She handed the board a written plan that included
weekly clinics, gardening basketball, art, lunch, arts and crafts, visits, special guests, and trips.
She asked for the rate increase of $75 from $300 to $375 for regular hours and from $400 to
$475 for extended hours. The board deliberated and agreed to a $50 increase for each plan.
Thus, the annual increase would be $50, from $300 to $350 for regular hours; and, from $400 to
$450 for extended hours.

Workplace Violence Incident Report
COMMENTS - Current Meering:
She then asked the board to adopt the Workplace Violence Incident Report.
Councilman Beale asked her to run it by Attorney David Wise. Supervisor Gutzler responded
that she already had done so. Councilman Beale then asked to check for training. Supervisor
Gutzler explained that she had contacted other municipalities to find out what they were doing.

Highway Department Construction
Engineer Gray reminded the board that they asked him to get bids on repairs on the highway
garage up to $30,000. He asked to go to amend previous request to $50,000. The work is for a
furnace and insulation that is hanging down. The bids are due Wednesday. He expects those
bids to be less than $10,000. He explained that the north addition to the shop one roof which is
in bad shape. He suggested a permanent solution to the roof estimating it to cost under $30,000.
Thus, he asked to increase the upper limit of approval to be $50,000. A motion and a vote

E. Municipal Power Purchase proposal
Supervisor Gutzler asked for support on the Municipal Power Purchase Program which comes at
no cost to the town. The board agreed to let her continue to pursue the program providing that
she does not engage in any binding agreement. She added that any saving would qualify for the
tax efficiency program.

Supervisor Gutzler pointed to a February 25th memo from the Highway department asking to go
out to bid for Highway supplies and services, i.e. gasoline, diesel, aggregates and striping of
town roads. Councilman Kuzmicz moved the reauest.

Hudson Valley Hops
Shawn McLearn from Hudson Valley Hops spoke of the use of the center hole, better known as

"The Doughnut", in the Carnwath Farms and how to use it. He handed out a draft of a plan from
a meeting earlier in the week. He suggested that the Carriage House would be used for the
processing of crops, the distribution of agricultural products and the storage of agricultural
equipment to begin in the spring of 2015. The dormitory would be used as an incubator for
sustainable agro-business in the Hudson valley specifically designed to provide studio work
space to artisans and/or organizations with artisan or agricultural missions with provisions that
they are programs that are generally open to the public. A food processing facility may be
operating that supports on-site activities of off-site events to begin in the spring of 2015. The
chapel would be used to operate a farm brewery and tasting room and programmatic space all to
begin in the spring of 2015. The administration building will be used for administrations
intended for the use of farm operations and programming to begin in the spring of 2015. The
manor house's use is to be determined. The exterior grounds will be used for agriculture,
production, processing, storage of the equipment, as well as farm animals, bee keeping,
programs, agro-tourism, and recreation to begin in 2015. Attorney Roberts pointed out a typo,
stating the Doughnut "IS" restricted by conservation easement. He also asked about the structure
of the lease agreement. He added that any lease has to be adopted by a permissive referendum
and published in the local newspapers. Supervisor Gutzler asked about the dormitory and if the
rooms would be rented. She also asked about the pay back to the town, the effect to the Wheeler
Hill historic district, the Reese Cultural Center, and the Sports museum. Shawn answered that he
would find a way to explore the lease agreement in an appropriate way that the town and the
professionals will advise on. He added, "We want to find a way to develop a critical mass that is
beneficial to the agricultural intention of the farm operation and the public use of what we hope
will be a center and a destination not only for that use but for recreation programs and agro-
tourism." He said "What we think we're hearing is that it should look something like the existing
zoning language so that any procedural considerations might be appropriate to the intended use.
If however, we hear from the team that we should peel additional uses off, until a permitted
entity is using the space, either through a lease or a license agreement, and then from that core
set of uses, further proceed to request from the town consideration of additional uses that might
require additional steps." Attorney Roberts said, "I'm not sure I'm following you". He added,
"Are you suggesting that you identify a minimum core number of uses at the so called
dormitory." Attorney Roberts said he would think the town would want some reservation to
approve whatever incubator tenants they might have and that there would have to be some
mechanism for the Town Comptroller for the various sub -tenants they're going to have. Shawn
jumped in and said, "We can explore that, I'm not for one accustomed to having the city or the
town approve my sub -leases, but that's certainly something we can explore." Councilwoman
Czarnecki asked about the condition of the buildings and the short time frame to begin use.
Shawn said, "We should be thinking the intended use date and that we understand that we will
still need a certificate of occupancy that will address the third issue specifically. So, there is still
process in front of us to begin to utilize the space." Councilwoman Czarnecki summarized that
they are not going to bring anyone in to inhabit the building until it's safe, but would like to
begin working on it in that time frame. Shawn added that in his opinion, nothing will change
during the first year. And, that "during the first year we will all have an opportunity to
contemplate how far along we're getting and what makes sense, but we don't want to operate in a
mutually exclusive way whereby the sports museum or any of the administrative activities there
should be replaced." Councilwoman Czarnecki asked "where's the money coming from".
Shawn answered that is would be coming from private equity, though the county, and the state.
He added, "Our intent is to put together a series of public private partnerships that require public
support whether it be in the form of agreements that we would strike together, public support in
the form of that which we got from the county and from regional council and also private support

in the form of equity and or loans that we would be brought to bear in order to bridge and deal
with the funds what we expect to receive from the state." Councilman Bettina pointed to the nice
job that they had done in Harlem and he feels are credit worthy. Planner Stolman spoke of the
existing R-80 zoning and approvals that their uses are permitted in the residential zone except for
one dormitory use. Councilman Beale asked why are we adapting to a zone that we do not want
and creating unnecessary hurdles. Planner Stolman said that they are trying to find the easiest
way through this process and the R-80 residential zone is the easiest. Certain agricultural uses
require no approvals and they are trying to find that easiest route. Councilman Beale said he
understood that. Supervisor Gutzler asked for a next step. Attorney Roberts said the board must
accept the application and refer it to the planning board to review it under SEQRA and ask that
the planning board be designated as lead agency.

2. Motion To: Waive all escows both town board and planning board, and waive application fees
Zoning Administrator Roberti asked about an escrow. Councilman Beale felt that this is not a
commercial endeavor coming into the town. Attorney Roberts commented that, should there not
be an escrow and the project does not work out, then it would be at a considerable cost to the
town. Councilman Bettina said that there should be some type of escrow, something that's
reasonable. Planner Stolman added that there is going to be planning board approvals, site plans,
special permits, legislative work for the town, creation of a new district, adding uses, and both
boards will be involved. He said that as soon as part one of the Environmental Assessment form
comes in, the planning board can send it out to the other involved agencies and declare its intent
to be the lead agency. Councilwoman Czarnecki asked Shawn if they had any seed money in
pocket. She asked if they had any idea what escrow costs would be. Supervisor Gutzler said that
traditionally escrows have been anywhere in the neighborhood of $5,000. Shawn suggested that
they are not meeting with the town as a private site, but rather an aggregated benefit by bringing
other parties from the state. He felt that they are partners and that their professionals and the
town's professionals would work hand in hand. Attorney Roberts pointed out that, should the
uses be approved, then there would be no zoning changes. He said that we are going to have to
structure the terms of the lease immediately. Councilman Beale jumped in and minimized the
impact of a $5,000 escrow and moved to waive all escrows, both town board and planning board,
along with all application fees; citing this as an opportunity to begin a true partnership.
Councilman Kuzmicz seconded it and the board and approved.

H. Aeration System Replacement
Attorney Roberts informed the board that the Tri -Municipal commission is looking for capital
repairs and improvements and needs a new Aeration system. He added that the Town of
Wappinger needs to prepare its own map plan and report and forward it to bond council to have
bond resolution in place by June. Resolution 2015-86 is forthcoming.
1. Zoning Amendments
Planner Stolman put this on the agenda to field additional or any other comments before final
approval. Supervisor Gutzler referred to page 10 number 11, highway design district, and asked
if this was to discourage automotive uses. Planner Stolman said this was to minimize auto
dealerships on route 9 and certain fast food establishments. She then referred to page 9
regarding Bed and Breakfast establishments and asked where they go. Planner Stolman said they
fit into residential establishments and have been eliminated from business zones. Councilman
Beale moved the entire set of zoning amendments. The board approved without further
discussion. Planner Stolman promised to submit the proper introductory resolution to Clerk
Paoloni. He also asked to set a public hearing. Clerk Paoloni suggested the April 27th date. The
Public Hearing was set to April 27th, 2015.
RESOLUTION: 2014-285
Resolution Introducing Local Law No. 1 Of 2015 Which Would Amend Chapter 240,
Zoning, Of The Town Code With Respect To A Variety Of Planning And Zoning Matters
WHEREAS, the Town Board is considering the adoption of Local Law No. 1 of
2015 which would amend Chapter 240, Zoning, of the Town Code with respect to a
variety of planning and zoning matters; and
WHEREAS, the Town Board has determined that the Proposed Action is a Type I
action pursuant to Article 8 of the Environmental Conservation Law, Part 617 NYCRR
(commonly known as "SEQRA") and pursuant to Chapter 117 of the Town Code (the
Town's Environmental Quality Review (WEQR) Law which establishes locally designated
Type I actions); and
WHEREAS, the Town Board has determined that the proposed Local Law is an
action for which there are no other Involved Agencies and that the Town Board is therefore,
by default, the Lead Agency for this action.
NOW, THEREFORE, BE IT RESOLVED, AS FOLLOWS:
1. The Town Board hereby adopts and incorporates the recitations and statements set
forth above as if fully set forth and resolved herein.
2. The Town Board hereby introduces for consideration of its adoption proposed Local
Law No. 1 Of 2015 in the form annexed hereto.

3. The Town Board hereby schedules a Public Hearing regarding the adoption of the
annexed proposed Local Law No. 1 of 2015 for 7:30 PM on the 27th day of April,
2015 and the Town Clerk is hereby directed to post the notice of the Public Hearing
in the form annexed hereto and to publish same in the Southern Dutchess News
and the Poughkeepsie Journal not less than ten (10) days prior to said Public
Hearing date.
4. The Town Board hereby directs the Town Clerk to act as follows with respect to the
proposed Local Law:
a. To serve a copy of this resolution, the annexed proposed Local Law, and the
public hearing notice to the municipal clerk of each abutting municipality not
less than ten (10) days prior to said public hearing;
b. To serve a copy of this resolution, the annexed proposed Local Law, and the
public hearing notice to the Dutchess County Department of Planning and
Development for advisory review in accordance with Section 239 of the
General Municipal Law; and
C. To distribute a copy of this resolution, the annexed proposed Local Law, and
the public hearing notice to the Town of Wappinger Planning Board for its
review and recommendation pursuant to Section 240-112 of the Zoning Law
prior to said public hearing.

Resolution Authorizing Preparation Of A Map, Plan And Report For Tri -Municipal
Aeration System Replacement Project

WHEREAS, the Town of Wappinger has a long term Tenancy Agreement with the Tri -
Municipal Sewer Commission for the treatment of 1,375,000 gallons per day of wastewater
generated by the United Wappinger Sewer District ("UWSD") and the UWSD is obligated to
share in the costs of all necessary capital improvements to the Tri -Municipal Sewer Plant; and
WHEREAS, the Tri -Municipal Sewer Commission ("the Commission"), has adopted a
Map, Plan and Report for Capital Improvements for the Aeration System Replacement at the Tri -
Municipal Wastewater Treatment Plant; and
WHEREAS, the Commission's Map, Plan and Report estimates the total capital cost for
the aeration system replacement to be $1,657,420 and the Tenancy Agreement provides that the
Town of Wappinger on behalf of the UWSD shall be allocated a proportionate share of 49.55%
of the cost based on design flow, which results in a share of $821,252 for the Town; and
WHEREAS, Town Law §202-b(1) requires the preparation of a Map, Plan and Report
by the Engineer to the Town to assess the cost of the improvement against the individual
benefited properties within the UWSD and that a public hearing shall be held upon completion of
the report;
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.

Resolution Appointing Part -Time Secretary To The Planning Board And Part -Time
Secretary To The Zoning Board Of Appeals
WHEREAS, pursuant to the authority vested in it pursuant to Town Law § 272, the
Planning Board hereby confirms to the Town Board that it wishes to appoint Beatrice B. Ogunti
to the position of Part -Time Secretary to the Planning Board; and
WHEREAS, the Zoning Board of Appeals hereby recommends to the Town Board that
Beatrice B. Ogunti be appointed to the position of Part -Time Secretary to the Zoning Board of
Appeals.
NOW, THEREFORE, BE IT RESOLVED, as follows:

1. The recitations above set forth are incorporated in this Resolution as if fully set

2. The Town Board hereby acknowledges the appointment of Beatrice B. Ogunti to
the position of Part -Time Secretary to the Planning Board and hereby appoints Beatrice B.
Ogunti as Part -Time Secretary to the Zoning Board of Appeals for the remainder of calendar
year 2015, said appointment to expire December 31, 2015.
Beatrice B. Ogunti shall be paid an annual salary of $31,850, in accordance with the 2015
adopted budget to be paid in 52 weekly installments, beginning March 10, 2015 and terminating
December 31, 2015, and in accordance with the Contract between the Town of Wappinger and
the International Brotherhood of Teamsters, Local 445, as the same may be in effect for calendar
year 2015.

Items for Special Consideration/New Business
Councilman Kuzmicz asked Steve Frazier about the maintenance of some beautification signs set
up years ago the grounds maintenance. The signs were set up as part of a beautification program
began in 2001 by former Councilman Paoloni and former Supervisor Ruggiero. Councilman
Beale said he would work with Steve Frazier to get proposals on repairing and replacing some of
the signs.
Steve Frazier reported that he repaired a ramp for $250 in one of the trailers at the barn with an
estimated replacement cost of $1,200. He has enough materials to repair a second ramp. He also
explained that he had replaced a number of light panels that uses 25% less energy. He requested
a laptop as he travels a lot and needs to research products and download manuals. He
recommended a laptop that cost $711. Councilman Beale asked to wait 2 weeks on this to wait
for the revenue and expense report.
Councilman Kuzmicz asked about the speed limit reduction for route 376. Supervisor Gutzler
promised to set up meeting.
Councilman Beale asked to meet with the Supervisor, the Fire Inspector and some Fire Chiefs
before the first town board meeting of each month at 7PM to discuss the emergency plan of the
town. He also spoke of using a state bid vendor for the purpose of purchasing code enforcement
vehicles. He asked to put together a proposal. He suggested the same vendor used in many
municipalities which comes fully equipped, i.e. lettered up and radios installed.

Town of Wappinger: Workplace Violence Prevention Policy Statement
The Town of Wappinger is committed to the safety and security of our
employees. Workplace violence presents a serious occupational safety hazard to our
agency, staff, and clients. Threats, threatening behavior, or acts of violence against
Town of Wappinger employees where any work related duty is performed will be
thoroughly investigated and appropriate action will be taken, including summoning
criminal justice authorities when warranted. All employees are responsible for helping
to create an environment of mutual respect for each other as well as clients, following all
policies, procedures and program requirements, and for assisting in maintaining a safe
and secure work environment.
This policy is designed to meet the requirements of NYS Labor Law 27b and
highlights some of the elements that are found within our Workplace Violence
Prevention Program. The process involved in complying with this law included a
workplace evaluation that was designed to identify the workplace violence hazards our
employees could be exposed to. Authorized Employee Representative (s) will, at a
minimum, be involved in:
• The evaluation of the physical environment;
• The development of the Workplace Violence Prevention Program and;
• The review of workplace violence incident reports at least annually to identify
trends in the types of incidents in the workplace and review of the effectiveness
of the mitigating actions taken.

All employees will participate in the annual Workplace Violence Prevention Training
Program.
The goal of this policy is to promote the safety and well-being of all people in our
workplace. All incidents of violence or threatening behavior will be responded to
immediately upon notification.
All Town of Wappinger personnel are responsible for notifying the contact
person designated below of any violent incidents, threatening behavior, including
threats they have witnessed, received, or have been told that another person has
witnessed or received.
