Resident Mary Schmalz referred to a prior meeting on August 1 lth where the Wappinger Indians
promised to contribute $4,000 - $5,000 to the $15,000 dollar cost borne by the town to study
future football fields at Robinson Lane Park. She explained that from a recent inquiry to the
town accountant that the Wappinger Indians have not contributed anything. Supervisor Gutzler
added that the money was to be paid to the cost of the study not to the town. Resident Schmalz
continued to point out that Pop Warner for over fifty years never cost the town one cent. She
said she supports football, but that they should play at Van Wyck Junior High School and ask the
school district where they can play. She added that the Wappinger Indians are a private
organization made up of children from other towns as well as Wappinger. She further added that
the school district is more likely to support them because of the multitude of town encompassed
by the Wappingers Central School District. She said that she would be more than happy to
approach the school district with this request. Supervisor Gutzler confirmed that is what may be
necessary because anything that happens at Robinson Lane has jurisdiction for town residents
onlv.

VIII. Discussions
1. FEMA Letter of Map Amendment Determinations
Supervisor Gutzler addressed the residents regarding a flood of emails. She said when FEMA
conducted its study of the new mapping, the town was not notified and the residents were denied
the local appeals process. At the time of this project in 2008, no special flood hazard area
existed. Hence, FEMA was not notified of any previous work the town had undertaken, because
there was no flood zone back then; and, FEMA had not notified the town of any new mapping
process. She added that the town has worked to represent its residents to the fullest legal extent
possible. The town has provided detailed information to FEMA of the 1996 drainage project to
the Rockingham Drainage for this subdivision. They've hosted 2 public meetings with FEMA
and the DEC and others. They participated in a community assistance visit with FEMA and
DEC. She said they just met with Andrew Martin of FEMA to discuss requirements for a
LOMR. No other municipality has worked this hard on behalf of their residents.
Resident Robert Sieferman at 3 Cloverdale Place rose to address the FEMA flood plain adding
that the local resident had recently paid for a LOMA study which is the first step in the process
for residents to appeal the FEMA maps that were redrawn in 2012. In accord with the procedure,
the town filed the LOMR to complete their end of the process. Mr. Sieferman explained that as a
result of this appeal that 5 of the 7 resident have succeeded in getting out. He suggested that the
other 2 may get out if the town would submit to a LOMR. He added that other families
throughout the town would also benefit in the reduction of their flood insurance premiums. He
responded to Attorney Roberts letter indicating that a town cannot spend tax dollars on private
property issues. He asked the town to step up for all residents concerned. Attorney Roberts
explained that the government has to weigh the circumstances and make the determination based
on the circumstances when there is limited money. He added that Andrew Martin from FEMA
confirmed that Attorney Roberts letter was accurate. He strenuously pointed out that the town
never got a notice from FEMA in November of 2011. He added that there was no requirement to
supply the details of the 1996 Rockingham Drainage project to FEMA, because we were not in
any flood plain. FEMA backfilled the X Zones to Zone A. He said there are two ways to solve
this, one by a LOMA supplied by the residents for their individual parcels or there could be a
LOMR where the entire map is reconstructed based on information supplied by the homeowners
and/or the community. He added that this is a two edged sword because by doing a LOMR may
get some out but others put in. He added that the rates have been substantially reduced. He said
he asked FEMA to take the 1996 Rockingham Drainage information and plug it in to their
calculations. FEMA will be back later to discuss the results. Mr. Sieferman responded by
questioning whether or not culverts were included in their study. Attorney Roberts pointed out
that the mandate came from the federal government and that it would be an enormous
undertaking by the town; but, the key thing is that FEMA admitted that there is a problem and
they are going to take another look at it with the 1996 drainage information which will take
significantly less time than a LOMR study which would take from 6-9 months on an expedited

basis.
Beth Saterlee from Cloverdale Place rose to speak. She explained that she is 4 inches disparity
and only a 1 inch dispaity when looking at her elevation certificate.
Florance Martinez from 326 All Angels Road rose to speak. She explained that culverts under
Carroll Drive were placed in 1973 and the whole brook was re-routed. She added that she has
lived there for 42 years and have never flooded out.
2. Running Bamboo
Kathy Dyer explained that Bamboo gets into the water system, gas pipes, and septics. She said
that Yellow Grove Bamboo is the world's most invasive species. Yellow Groove Running
Bamboo is one of the most invasive and fastest growing plants on the planet. She added that it
Invades water pipes, sewer pipes, gas pipes. It breaks through concrete and asphalt, creates
underground pressure that breaks through any means to contain the bamboo. It reduces property
value. Ordinances have been done in Glen Cove, NY, Hempstead, NY (largest town in US),
Malverne, NY, Northport, NY, Smithtown, NY. Additional ordinances are being passed weekly
to stop the invasion of Running Bamboo It reached a maximum height of 30 feet. She pointed
out locations around the town that have this evasive species. Initial planting of Yellow Groove
Running Bamboo - mother plant - —1 year to establish. Running Bamboo is dormant from
October - March. April - June - Previous year rhizomes send up culms (bayonets), which grow
about 2 feet per day. July to September rhizomes invade the underground in a 360 ❑ pattern
around each cane spreading approximately 20 feet underground every year. Cutting the canes
will not stop the spread underground of the massive rhizomes network. She added Mowing only
keeps the culms from growing, camouflages the spreading the spreading rhizomes underground
and redirects the energy to the rhizomes. Rhizomes can grow without sunlight for years.
Herbicides are not effective on Phyllostachys invasive running bamboo. Running bamboo
flowers at long intervals over 65 years. Containing running bamboo forces the rhizomes, which
generally grow to a dept of 12 - 29", to grow deeper. Each year the invasion is more destructive.
She showed pictures throughout the town with these invasive bamboo plants. It Cracks concrete,
grows into a building's infrastructure, invades / damages neighboring properties (legal issues),
Other damages - water pipes, septic systems, swimming pools, gas lines, foundations, well,
garden, loss of lawn and landscape, Property value - reduce market value due to stigma and
possible continual vigilance. Causes both public and private continual nuisance. She stated that
Towns need to develop ordinances. She added that buffers and containments (can't be
contained). She says that towns should require all bamboo contaminated rhizomes be
incinerated. She wants to educate the general public. Councilman Chicarrelli pointed out that
the towns that have these ordinances are on sand bars with little to no restrictions; however, our
soil has clay and rock. Ms. Dyer said that it is spreading in our neighborhood. He added that it
is important issue. Councilman Kuzmics asked the Zoning Inspector if we have had a property
maintenance issue filed. She said no. Councilman Kuzmics said that we have a lot of property
maintenance issues in the town that are more pressing at the moment and we have very minimal
resources and we seriously have to consider what we would have to do in regard to this matter.
Councilwoman Czarnecki said that educating the puclic would be usefull. Highway
Superintendent added that he recently attended a highway conference where they addressed this
as a high risk in concern with pipes and roads.
3. Motion To: AED Inventory and Assignments - Transfer $500 out of Contingency.

Councilman Beale reported that there are working defibulators throughout the town. He said
there is one defibulator needed at the highway garage. Supervisor Gutzler said that it would cost
about $500 to repair this defibulator. Councilman Beale made a motion to transfer $500 out of
the general highway contingency fund.
Councilman Beale asked that CPR-AED training be made available to highway and town hall
employees.

RESOLUTION: 2015-145
Resolution Accepting Performance Agreement Secured By Performance Bond In
Connection With Hilltop Village At Wappinger (The Regency At Wappinger)
WHEREAS, Toll Brothers, Inc. (the "Applicant") on behalf of Contrail, LLC (the
"Owner") had made application to the Town of Wappinger Planning Board to approve a
subdivision of lands more particularly described in Subdivision Plans entitled "Hilltop Village of
Wappinger" prepared by Povall Engineering, PLLC and survey by Robert V. Oswald, Jr. Land
Surveying, LLC, dated May 28, 2013, last revised July 18, 2013; and
WHEREAS, the Town of Wappinger Planning Board granted Final Conditional
Subdivision Approval to Toll Brothers, Inc. as Applicant and Contrail, LLC as Owner pursuant
to Resolution dated March 18, 2013, subject to certain public improvements being made and
constructed within said subdivision as set forth in the construction documents prepared and
submitted in connection therewith, and subject to completion of and/or the compliance with the
requirements set forth in the Town of Wappinger Subdivision Regulations, Highway
Specifications, Zoning Code (including compliance with escrow deposits), Municipal
Stormwater Management Law, and Rules and Regulations of the Town of Wappinger; and
WHEREAS, Contrail, LLC conveyed its rights and interest in said subdivision to Toll
Land V, Limited Partnership; and
WHEREAS, Town Law §277 requires that a developer of a proposed subdivision
guarantee the construction, installation and dedication of the proposed improvements required by
the Resolution of Approval, prior to the issuance of any Building Permits; and
WHEREAS, the Town of Wappinger is requiring Toll Land V, Limited Partnership to
make, construct, complete the concrete sidewalks, site lighting and street trees, as set forth in the
Bond Estimate affixed hereto as Schedule "A", in accordance with any relevant standards
maintained by the Town of Wappinger Highway Department and at the direction of the Town of
Wappinger; and
WHEREAS, to secure the obligation to guarantee the construction and installation of the
required improvements and obligations, and compliance with required escrow deposits, James

Fitzpatrick, as Division President of Toll Land V, Limited Partnership, and individually as
guarantor, has executed a Performance Agreement dated May 19, 2015 secured by a
Performance Bond issued by Arch Insurance Company, bearing Bond No. SUI 133194 and
issued in favor of the Town of Wappinger in the sum of Three Hundred Seventy Seven Thousand
Eight Hundred Dollars ($377,800.00) posted with the Town of Wappinger, securing the
obligations set forth in the Performance Agreement; and
WHEREAS, Toll Land V, Limited Partnership covenants and warrants to the Town of
Wappinger that in the event Toll Land V, Limited Partnership fails to fully perform and complete
all the requirements of the Resolution of Approval, then, upon the demand of the Town of
Wappinger, the Town of Wappinger shall have the right to draw upon the Performance Bond in
an amount equal to the cost necessary to complete the required improvements; and
WHEREAS, it is understood that the Town of Wappinger shall have the right to use said
security toward the completion of any required improvements required by the Resolution of
Approval upon the default of Toll Land V, Limited Partnership to remedy the same after the first
given written notice to Toll Land V, Limited Partnership to do so within thirty (30) days of
receipt of said notice from the Town of Wappinger; and
WHEREAS, the Performance Agreement executed by Toll Land V, Limited Partnership,
and James Fitzpatrick individually as guarantor, further binds their heirs, executors,
administrators, successors or assigns for the faithful performance of its obligations hereunder.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Performance Agreement executed by James Fitzpatrick, as Division President
of Toll Land V, Limited Partnership, and James Fitzpatrick, individually, in favor of the Town of
Wappinger is hereby accepted as security to guarantee the completion of the construction,
installation and dedication of the improvements required by the Resolution of Approval adopted
by the Planning Board on March 18, 2013.
3. The Performance Bond issued by Arch Insurance Company, bearing Bond No.
SUI 133194, and issued in favor of the Town of Wappinger, dated May 26, 2015 is hereby
accepted as security for the obligations set forth in the Performance Agreement.
Both the original Performance Bond and the original Performance Agreement in the amount of
Three Hundred Seventy Seven Thousand Eight Hundred Dollars ($377,800.00) is to be placed on
file with the Town Clerk.

Resolution Authorizing The Town Supervisor To Initiate A Request For Proposals For
Portable Fire Extinguisher Inspections And Certifications
WHEREAS, the Town of Wappinger annually obtains the inspection of its portable fire
extinguishers in Town owned buildings; and
WHEREAS, the Fire Inspector has advised that such annual inspection is due soon; and
WHEREAS, the Fire Inspector has further advised that the Town of Wappinger has been
utilizing numerous companies to perform these inspections and recommends the Town Board to
solicit bids for such service for the purpose of cost savings and other efficiencies; and
WHEREAS, the Town Supervisor is authorized to solicit bids for portable fire
extinguisher inspections and certifications for the Town of Wappinger, in accordance with
recommendations from the Fire Inspector.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Supervisor is hereby authorized to solicit bids for portable fire
extinguisher inspections and certifications for the Town of Wappinger, in accordance with
recommendations from the Fire Inspector.
The Town Supervisor is directed to present such bids in response to the solicitation process to the
Town Board for their consideration in awarding the service contract.

XI. Items for Special Consideration/New Business
1. Motion To: Waive Fee for bicycle race at Castle Point Park
Director Fulton got a request to open and close the gates at Castle Point for a bicycle race. They
additionally asked to waive the fee of $75. Supervisor felt that the fee should be collected.

2. Cental Air Compressor Replacement/Dutch Door at Recreation Office
Steve Frazier notified the board that central air unit that serve one third of the building needs
repair to replace AC unit. He added that the Dutch Door for the recreation office would cost
$1,365.
3. Other Items
Zoning Administrator Roberti addressed property maintenance issue. She added that there are
many abandoned homes in the town and is keeping track of them. She cited one on 27
DeGarmo, one on Applesauce, and one on Blackthorne.
Councilman Beale addressed the Dutchess County Hazmat Mitigation Plan to be discussed at the
June 22 meeting.
He updated the town vehicles. He has a quote from one dealership. He said it would be in our
best interest to wait 2 weeks to get quotes on the new model vehicles.

CERTIFICATION OF APPOINTMENT TO FILL VACANCY IN THE OFFICE OF
COUNCILMAN WARD TWO, TOWN OF WAPPINGER
WHEREAS, a vacancy exists in the Office of the Councilman Ward Two of the Town of
Wappinger, Dutchess County, New York, by virtue of the resignation of Vincent Bettina, who resigned as
Councilman Ward Two effective May 3rd, 2015; and
WHEREAS, pursuant to Town Law § 64(5), the Town Board, or the majority Members thereof,
are authorized to fill such vacancy for the remainder of the unexpired term of Councilman Ward Two.
NOW, THEREFORE, pursuant to the power vested in us by Town Law § 64(5), we, the

A formal study concerning a reduced speed limit on CR 34 Baxtertown Road between Stoneykill
Road and Route 9D has been completed.
We found that it is appropriate to establish a 35 MPH speed limit on CR 34, Baxtertown Road
from Stoneykill Road to Route 9D. It is the responsibility of the Dutchess County Dept. of Public
Works to install the new 35 MPH speed limit signs as specified in the National Manual on
Uniform Traffic Control Devices. It is also the responsibility of the Highway Superintendent to
determine if certain existing conditions on the roadway may require additional signing.
We have enclosed a copy of the Official Notice of Orders for your files.
We appreciate your continued cooperation in traffic safety matters. If you require further
