Motion To: Open Public Portion Dr. Mary Schmalz asked about recycling of newspaper and whether one has to pay for a sticker just to recycle newspaper. Supervisor Gutzler said yes. She then asked about the charge for sewer in the Edgehill district for those NOT in the sewer district. She was referring to the oversized trunk line that was put in place such that should the district be expanded to accommodate certain areas, the pipe capacity would be adequate. Attorney Roberts responded saying that it is hard to answer such questions without the specifics. She then asked about the laptop computers being purchased. Supervisor Gutzler said that the Town of Wappinger Page 2 Printed 711012015 Regular Meeting Minutes June 22, 2015 laptops are for the supervisor and her administrative assistant. Discussions 1. 2. 3. Duncan Gilchrist: green energy and sustainability Duncan Gilchrist appeared before the board to talk about climate change and asked the town board to adopt the New York State Climate Smart Community Pledge and chart a course forward that carries the well-being of our local economy to the health of our community and our environment. He proposed that we can decrease our carbon footprint and save money at the same time. He cited neighboring towns that have adopted this pledge such as Buffalo with $71,000 annually, Kingston with $113,000 annually, and Yonkers with $16 million over 5 years. He continued to read his statement and then asked the board for questions. Supervisor Gutzler explained that neighboring towns have processed this through their Conservation Advisory Council. Councilwoman Czarnecki asked about financing for accepting the pledge. Mr. Gilchrist said no, however they do have grants. She then asked about the priority order. Duncan said that every action need not be completed. Councilman Beale asked about Duncan's organization. Duncan explained that he started a grass roots organization called the Wappingers Climate Action group. Councilman Beale asked about the types of funding available. Steve Frazier explained the energy saving lights that are being installed. Supervisor Gutzler congratulated the group and invited them back at the July 13th meeting. Port -a -Potty use at Recycle Center and rental rates Steve Frazier explained that the Port -a -Potty's have been ordered. He asked if this was seasonal and promised a memo to accommodate the highway superintendent when he asks about that. Dutchess County Hazard Mitigation Plan Barbara Roberti gave a sample to the board that they have already done. She address worksheet 7 that would be submitted to the by the county to FEMA by the end of the year. Worksheet 7 is mitigation and each town has been asked to come with any project that is exposed to hazards. She asked the board to weigh in on it. Bob Gray cited the bridge on Robinson lane and Smithtown road as potential risks. Councilman Beale asked the town board to identify potential areas of risk. Councilman Kuzmicz mentioned the culverts at Cloverdale. Bob Gray said that some were county owned and some were town owned. Councilman Beale cautioned that if Town of Wappinger Page 3 Printed 711012015 Regular Meeting Minutes June 22, 2015 you're not in the plan then you cannot receive any funds and that it must be submitted in the next 30 days. Councilman Beale added Joan Lane as a risk area and Councilman Kuzmicz added Deer Run as a potential risk area. 4. Motion To: Eagle Scout Project at Reese Park Mr. Thomas Knox explained his Eagle Scout project at Reese Park. He showed pictures of items that need replacing at the park, i.e. cracked billboards with graffiti, broken bench, trail marking and underbrush cutting. Councilman Beale offered his help as it was his Eagle Scout project 21 years ago. Councilwoman asked how he would pay for these items and offered to contribute to him and Dromised to write a check. Motion To: Resolution for Reconstruction and Resurfacing of Town Roads - Authorizing Attorney to Prepare Resolution Councilman Ciccarelli identified the roads to be paved and pointed out that NY State needed to be contacted for CHIPS funding. Exchange of Maintenance Responsibility for All Angels Road Supervisor Gutzler explained the swap of responsibility of Old All Angels Hill Road and the light at Middlebush Road and Old Route 9. VIII. Resolutions RESOLUTION: 2015-150 Resolution Authorizing Transfer Of Ownership And Maintenance Responsibilities Between Dutchess County And The Town Of Wappinger WHEREAS, Dutchess County reconfigured All Angels Hill Road (CR 94) near its intersection with Town of Wappinger road, Alpert Drive; and WHEREAS, as a result of the reconfiguration of All Angels Hill Road, the County was required to maintain the portion of All Angels Hill Road now currently known as "Old All Angels Hill Road"; and WHEREAS, a traffic light was installed at the intersection of Middlebush Road (CR 93) and Old Route 9; and Town of Wappinger Page 4 Printed 711012015 Regular Meeting Minutes June 22, 2015 WHEREAS, the Town of Wappinger is responsible for the maintenance and operation of the traffic light at the aforementioned intersection; and WHEREAS, Dutchess County is willing to take ownership and maintenance responsibility of the traffic signal at the intersection of Old Route 9 and Middlebush Road (CR 93) in exchange for Dutchess County transferring ownership and maintenance responsibilities for Old All Angels Hill Road located off of All Angels Hill Road (CR 94) from Dutchess County to the Town of Wappinger in accordance with letter dated June 9, 2015 from Robert H. Balkind, P.E., Deputy Commissioner of Public Works, a copy of which letter is affixed hereto. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. RESOLUTION: 2015-154 A Resolution Authorizing The Issuance Of $945,000 Serial Bonds Of The Town Of Wappinger, Dutchess County, New York, To Pay The Cost Of The Increase And Improvement Of The Facilities Of The United Wappinger Sewer District, In The Town Of Wappinger, Dutchess County, New York WHEREAS, the capital project hereinafter described has been determined to be a Type II Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act and pursuant to Chapter 117 of the Code of the Town of Wappinger, the implementation of which as proposed, which therefore, will not result in a significant environmental effect; and WHEREAS, pursuant to the provisions heretofore duly had and taken in accordance with the provisions of Section 202-b of the Town Law, and more particularly an Order of even date herewith, the Town Board has determined it to be in the public interest to increase and improve the facilities of the United Wappinger Sewer District, in the Town of Wappinger, Dutchess County, New York, at a maximum estimated cost of $945,000; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Wappinger, Dutchess County, New York, as follows: Section 1. For the specific object or purpose of paying the cost of the increase and improvement of the United Wappinger Sewer District, in the Town of Wappinger, Dutchess County, New York, (the "Sewer District"), being the Sewer District's share of the cost of the replacement of the existing mechanical agitation aeration system at the Tri -Municipal Sewage Treatment Plant, including original equipment, machinery, apparatus, appurtenances and incidental improvements and expenses in connection therewith, at a maximum estimated cost of Town of Wappinger Page 8 Printed 711012015 Regular Meeting Minutes June 22, 2015 $945,000, which specific object or purpose is hereby authorized at said maximum estimated cost, there are hereby authorized to be issued not to exceed $945,000 serial bonds of said Town pursuant to the provisions of the Local Finance Law. Section 2. It is hereby determined that the plan for the financing thereof is by the issuance of the $945,000 serial bonds of said Town authorized to be issued pursuant to this bond resolution. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is forty years pursuant to subdivision 4 of paragraph a of Section 11.00 of the Local Finance Law. Section 4. The faith and credit of said Town of Wappinger, Dutchess County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. To the extent not paid from monies raised in said United Wappinger Sewer District, there shall annually be levied on all the taxable real property of said Town, a tax sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 6. The powers and duties of advertising such bonds for sale, conducting the sale and awarding the bonds, are hereby delegated to the Supervisor, who shall advertise such bonds for sale, conduct the sale, and award the bonds in such manner as she shall deem best for the interests of said Town, including, but not limited to, the power to sell said bonds to the New York State Environmental Facilities Corporation; provided, however, that in the exercise of these delegated powers, the Supervisor shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds. The receipt of the Supervisor shall be a full acquittance to the purchaser of such bonds, who shall not be obliged to see to the application of the purchase money. Section 7. All other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities and interest payment dates, within the limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be determined by the Supervisor, the chief fiscal officer of such Town. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such form and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Supervisor shall determine consistent with the provisions of the Local Finance Law. Section 8. The Supervisor is hereby further authorized, at her sole discretion, to execute a project finance and/or loan agreement, and any other agreements with the New York State Department of Environmental Conservation and/or the New York State Environmental Facilities Corporation, including amendments thereto, and including any instruments (or amendments thereto) in the effectuation thereof, in order to effect the financing or refinancing of the specific object or purpose described in Section 1 hereof, or a portion thereof, by a bond, and/or note issue of said Town in the event of the sale of same to the New York State Environmental Facilities Corporation. Section 9. X. Items for Special Consideration/New Business 1. Martz Field Pavillion Steve Frazier explained the lack of a handicap ramp to the recently designed and built Martz Field Pavilion. Bob Gray estimated another $6,000 cost to this project. Councilman Beale addressed other possible oversights such as handicap usability of picnic tables. Steve promised an update at the next meeting. He also spoke of security cameras at various locations subject to vandalism. Bob Gray spoke of additional change orders or oversights at the Martz Field Pavilion. He asked for saw cuts in the floor at a quote of $452. Additionally, he pointed out that they have no ceiling in the rooms on each end to prevent unauthorized entry for another $3,300. They agreed to approve these change orders at the next meeting. 2. Motion To: Spend $950 out of Town -wide A Fund to Remove a Tree in an Unbudgeted Conservation District Steve also mention a tree in a conservation easement that needs removed, yet there is no funding. Supervisor Gutzler explained that these are special districts that need to be funded during budget time. Councilman Beale explained that these costs need to be incurred by these residents and not by the entire town. Historian Cavacini presented the proposal to have the funds diverted to the Sports Museum. Attorney Roberts had concerns along with Engineer Gray who stated that the Mansion Structure is not safe. Councilwoman Czarnecki proposed focusing the momentum of this effort toward the village at Mesier Park. Councilman Beale echoed the concerns of the Attorney and Engineer with regards to the structural safety of the adjoining mansion. Mr. Mazzioti from Veridian approached the board asking for information to help realize energy saving at town hall. Supervisor Gutzler agreed to provide a listing and data. XI.
