2016-146 2016-146 Resolution Accepting Deed Of Dedication For Portion Of Highway Right-Of-Way Adjacent To Baisley Farm At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on April 25, 2016. The meeting was called to order by Lori A. WHEREAS, the Town of Wappinger Planning Board received an application from Kristin Klipp on behalf of Robert L. Baisley and Dorothy M. Baisley, hereinafter referred to as the "Owners", for preliminary and final subdivision plat approvals for the subdivision of a parcel of land totaling 9.38 acres into two building lots, approval of a common driveway for the two lots and a lot line revision to facilitate street frontage standards of these lots and to identify if the frontage on Wheeler Hill is a road per deed or drawn at 25 feet from the center of the road and, if necessary, to create a highway right-of-way parcel of land to be dedicated to the Town as and for a Town right-of-way; and WHEREAS, as a condition of subdivision approval, the Owners agreed to dedicate certain frontage along Wheeler Hill Road so as to provide the Town with a minimum road bed of 25 feet from the centerline of Wheeler Hill Road; and WHEREAS, the aforementioned applications were approved by the Town of Wappinger Planning Board by Resolution dated October 21, 2015 and the subdivision plat entitled "Baisley Farm Subdivision" is to be filed in the Dutchess County Clerk's Office simultaneously with the recording of the Deed and Declaration of Common Driveway Easement; and WHEREAS, the attorney for the Owners, Robert J. Lackaye, Esq., has certified title to the property being dedicated to the Town of Wappinger. NOW, THEREFORE, BE IT RESOLVED, as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board hereby accepts the Deed of Dedication as well as the Declaration of Common Driveway Easement for the road frontage from Robert L. Baisley and Dorothy M. Baisley to the Town of Wappinger and directs the Town Supervisor to execute any documents necessary to record said documents in the Dutchess County Clerk's Office. The Town Board hereby acknowledges the recording of the Deed establishing the boundary of the Owners property on Wheeler Hill Road at 25 feet from the centerline of Wheeler Hill Road. The foregoing was put to a vote which resulted as follows: RESULT: ADOPTED [UNANIMOUS] MOVER: John J.
