Resolution Rescinding Prior Bid Award And Authorizing The Solicitation Of Bids For The Tall Trees
Water Emergency Interconnection To The United Wappinger Water District (UWWD)
At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County, New York, held
at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on August 21, 2017.
The meeting was called to order by Lori A. Jiava, Town Supervisor, and upon roll being called, the
following was recorded:

The following Resolution was introduced by Councilman Beale and seconded by Councilman Kuzmicz.
WHEREAS, Engineers to the Town, Morris Associates Engineering & Surveying Consultants, PLLC,
solicited written quotes through a"Proposal Request for the Town of Wappinger United Wappinger Water
District Tall Trees Emergency Interconnection" dated October 2016; and
WHEREAS, on November 14, 2016, the Town of Wappinger awarded a contract for work for the Tall
Trees Water Emergency Interconnection to Thomas Gleason, Inc., Poughkeepsie, NY in accordance with the
letter recommendation of Robert J. Gray, P.E. dated November 14, 2016; and
WHEREAS, a review of the request for proposal determined that the solicitation for bids did not
comply with the requirements of General Municipal Law §103-d and Labor Law § 220-d and therefore the bid
award is a nullity so new bids must be solicited.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted
herein.
2. The Town of Wappinger hereby rescinds the bid awards to Thomas Gleason, Inc., of
Poughkeepsie, NY as being a nullity.
The Town Board hereby authorizes Morris Associates Engineering & Surveying Consultants, PLLC to prepare
new bid specifications for the Town of Wappinger United Wappinger Water District Tall Trees Emergency
Interconnection and to solicit bids for such project in accordance with the provisions of Article 5 of the General
Municipal Law and Labor Law § 220-d.
The foregoing was put to a vote which resulted as follows:
