Total Bid Change New order Contract, Sum S663,60074,031 X6;37,534 �f.CO Milbank CHANGE r^IR TYFR Town of Wappinger Page 6 Printed 1 213 012017 Regular Meeting Minutes December 27, 2017 Because this $74,031 overrun was given to the board well after the Public Agenda was published which in effect obscured it from public scrutiny on the reason, the who authorized it, the what it was for, and the fact that it was not the lowest bid anymore; Town Clerk Joseph Paoloni asked the board to honor the rules annually accepted by the board at the beginning of the year in that significant vote able items that have been obscured from PUBLIC knowledge by issuing them after the agenda has been published should at least be acknowledged by a confirmation of each board member. Because the board had agreed in executive session to put this overrun through without board or public discussion; Supervisor Jiava objected to her own rule. The board agreed to add it to the agenda. Supervisor Jiava, well prepared for this objection, read from a letter by Robert Freeman of the New York State Committee on Open Government. Supervisor Jiava challenged the validity of such a Town Board rule, a rule that she herself voted FOR a year earlier on January 9th, 2017. She also stated that she can change the rules anytime she liked. From the audience, Supervisor Elect Dr. of Law Richard Thurston confirmed the validity of the town board rules. Councilman Kuzmicz who stated the he is a holder of three law degrees, agreed with Town Clerk Paoloni stating that what Supervisor Jiava read was a fallback position. Attorney Roberts stated that Mr. Freeman did not indicate he had read our town board rules. Councilman Beale argued that the town has known about this for some time; and, argued that it was a moot point given fore knowledge that the vote would be unanimous anyway. The rule had been in place for 15 years. He added that the new station commander for the state police made changes to the original plan. He added, "We had a discussion". Yet, no PUBLIC discussion occurred. He added that it was under an amount of $100,000 and will accommodate the station commander's wishes. He said it came in at $58,000 yet the attached paperwork and actual amounts are $74,031. Town Clerk Paoloni said that the information which was available well before the agenda was published was withheld from the agenda and added at the last minute to obscure the item and discussion from the public. Town Clerk Paoloni who was on the Town Board when these rules were put in place in 2002, explained that the practice of submitting a significant item after the agenda was publically published is nothing more than deceiving the public and for that was the exact reason why it was put in the rules in 2001. Councilman Beale justified the action the keep this item off the agenda by saying that this had been normal practice on smaller in -significant items. Clerk Paoloni argued that when significant monies are spent or significant items are purposely hidden, then this is not free and open government. This has been done regularly throughout the last two-year term of this board and had been brought up to the attorney, supervisor, and board members. The behavior continued despite the Town Clerk's objections. Most egregiously, this was done in 2016 in attempt to convert the elected Highway Superintendent to an appointed position. The discussion continued regarding the moot point of such a town board rule, obscuring the issue of the overrun. Councilman Kuzmicz defended the town board rule, yet no one challenged the overrun on a project that will spend $2.2 million dollars that cost $1.5 million to build only 22 short years ago in 1995 with an overrun initiated by the tenant to the cost of the taxpayer. RESOLUTION: 2017-188 RESOLUTION AUTHORIZING CHANGE ORDER NOS. 1 & 2 FOR THE EMERGENCY SERVICES BUILDING RENOVATION PROJECT GENERAL CONSTRUCTION CONTRACT NO. 17-003G WHEREAS, by Resolution No. 2017-165 adopted by the Town Board on October 10, 2017, the Town Board awarded a bid to J.C. Millbank Construction Co., Inc. (General Construction Contract) in the amount of $563,500 for renovations to be made to the Emergency Services Building; and Town of Wappinger Page 7 Printed 12/30/2017 Regular Meeting Minutes December 27, 2017 WHEREAS, J.C. Millbank Construction Co., Inc. and the Town entered into a formal written contract dated November 8, 2017 pursuant to said bid; and WHEREAS, the Engineers to the Town, Morris Associates Engineering & Surveying Consultants, PLLC, have approved two Change Orders to the aforesaid contract, which results in a new contract price in the amount of $637,531.
