RESOLUTION: 2018-48 Resolution Authorizing Appropriation Of Highway Fund Balance To Increase 2018 Highway Department Salt Budget WHEREAS, the Highway Superintendent, Vincent F. Bettina, advises that for the past decade or more the Town of Wappinger, has annually contracted for the purchase of 5,000 tons of road salt for use on the highways of the Town; and WHEREAS, the Highway Superintendent has contracted for the purchase of road salt through the Dutchess County Department of Public Works salt contract at the price of $75.00 per ton which represents a savings of $3.39 per ton over the NYS Office of General Services bid price; and WHEREAS, the Comptroller has advised that $275,000 has been appropriated in the Final 2018 budget (DB5142.400) for the purchase of salt which would permit the purchase of 3,366 tons of salt at $75 per ton; and WHEREAS, this winter there has been an increased number of icing conditions which has caused an increase in the use of road salt to make the Town Highways safe for the travelling public; and Town of Wappinger Page 5 Printed 3/6/2018 Regular Meeting Minutes February 12, 2018 VI. RESOLUTION: 2018-40 Resolution Appointing Student Worker WHEREAS, the Town Board desires to hire Joseph Cavaccini as a Part -Time Student Worker to assist Town Officials and Department Heads with miscellaneous tasks and functions; and WHEREAS, the Joseph Cavaccini was appointed as Town Historian by Resolution 2018-12; and WHEREAS, the Town Historian for the Town of Wappinger is a voluntary position without compensation; and WHEREAS, the Attorney to the Town has advised that the positions of voluntary Town Historian and Student Worker are compatible, so Mr. Cavaccini may occupy both positions simultaneously; and WHEREAS, the position of Student Worker is classified as a Labor position under the Rules of Dutchess County Human Resources; and NOW, THEREFORE, BE IT RESOLVED, that: 1. The Town Board hereby appoints Joseph Cavaccini as a Part -Time Student Worker in the Labor Civil Service Classification of Dutchess County Human Resources at the pay rate of $11.00 per hour; and 2. The Student Worker shall be employed Part -Time and work no more than 17.5 hours per week; and 3. The Town Supervisor, or his designee, will assign the work and schedule of the Student Worker and said Student Worker shall report directly to the Supervisor or his designee; and 4. He distributed documents to all seated at the table, but excluded the Town Clerk, so no copy can be attached to the minutes. A summary follows: Town of Wappinger Page 9 Printed 3/6/2018 Regular Meeting Airport Drive - Field Floods Minutes February 12, 2018 Angel Brook Park - 4 acre parcel. Supervisor Thurston asked if we can sell it? Applesauce pond at 220 All Angels Hill Rd. is landlocked. Cannot find Town board approval to purchase? It took 2 years for the town to take it over. Take steps to avoid the restrictive covenant. It was not a legal park. It never legally was declared parkland. No legal responsibility. Castle point 40 acres 2 baseball fields and restrooms. Good condition. Needs fencing. Chelsea boat launch. Dock in need of repair. The ramp is eroded. Fleetwood - This is a 2 acre park with a swing set, basketball court. Pavement has tree encroachments. Playground set needs mulch installed. A Martz field is good condition. There is drug use at the park. Needs town patrol. Tennis courts need cleaning. Steve will try to get Basketball courts up to shape by summer camp time. Needs repair to pavement on storage building. Parking could be provided by opening up the gate to allow parking in the park. Quiet acres is a 6 acre park. Remnants of a baseball field based on old backstop. Worst park for vandalism and drug use. Reese Park is 40 acres. He recommends removing the outhouse located there. It is a major hub for the Greenway Trail system. Robinson Lane is 50 acres, it hosts 13 baseball fields, It's in good condition and still needs more fencing. Bleachers need repair and accountability is needed for the field lights. He recommends 'maintenance -free' aluminum bleachers. Rockingham Park is 19.5 acres large, 3 soccer fields. Residents want fencing around the ponds. Recommends fill in the pond, get rid of fencing, and then mow the field instead of having a fence. Steve recommended that the Schlathaus main roof be replaced. He also recommended replacing the aluminum siding with vinyl siding. The garage was painted recently. A new storage was placed last year. He mentioned replacing the nearly informational sign. He added that the stage needs work. Supervisor Thurston brought up a productive meeting on Spook Hill Park on how to regain the grant for handicap accessibility that was offered to us under the last administration. A South Fowlerhouse park 2.9 acre has a half -court basketball. Roots are coming through the pavement. He added it would be a major undertaking. There was question about the usage by the lack of neighborhood children. He added that there is an additional property at 33 Pattie Place, an original sewer plant. There is a steel storage building there. It is used for generator storage. Town of Wappinger Page 10 Printed 3/6/2018 Regular Meeting Minutes February 12, 2018 Councilman Kuzmicz added that as a general issue surrounding parks that the playgrounds need mulch. Mr. Frazier said that mulch is $2,200 a truckload. Councilman Kuzmicz wanted the estimates at the next meeting. In closing Mr. Frazier said that he was hired with an 11 man crew that now he has funding for 7 men. He expressed frustration in the this long list of items as shown above and the amount of manpower and hours in a day. He complained that the pay is too low and cannot attract reliable employees. The DCTC typically conducts 250 traffic counts annually, with individual locations counted every three years. Though the program originally focused on collecting traffic volume data, we now also collect vehicle speeds and classifications. In 2016, we conducted our first analysis of the speed data, using data from 2012-2015, to identify potential speeding issues on county and local roads. Based on the positive feedback from our first analysis, we have updated the analysis using data .from 2014-2017. The speeding analysis 'identifies road segments with high percentages of `high-end' speeding, defined by staff as those traveling more than 10 mph over the posted speed limit. By highlighting road segments with high-end speeding, we hope to assist elected officials, law enforcement agencies, and highway departments with their efforts to target speed enforcement, implement traffic calming measures, and allocate resources to reduce speeding and improve traffic safety. This year we have added speed -related crash data to the analysis, to enable comparison of high-speed areas with reported crashes involving speed. Below is a summary of our findings: a. Overview For this 2017 update, staff analyzed speed data collected from 1,042 unique road segments in Dutchess County during a four-year period (2014-2017). The speed data was collected through our annual traffic count program, which relies on automatic traffic recorders (pneumatic tubes placed across the road) placed for 3-7 days at designated locations. Thirteen percent of the measured road segments (114 segments total) had 85th percentile speeds (the speed that 85 percent of drivers travel at or below) more than 10 mph above the designated limit in at least one direction (e.g. eastbound or westbound). WITNESSETH THAT: WHEREAS, the Town Superintendent of Highways, in his sole discretion, nominated the Employee for the position of Working Supervisor in the Town of Wappinger Highway Department on April 4, 2017 and the Employees qualification were submitted to Dutchess County Human Resources ("DCHR"); and WHEREAS, DCHR approved the Employee as being qualified to occupy the position of Working Supervisor on July 10, 2017 and under DCHR Rule III, the Employee was then deemed appointed to the position as of that date; and WHEREAS, the Town was engaged in litigation regarding the authority to appoint the Working Supervisor and a decision was rendered in such litigation determining that the appointment was in the sole discretion of the Town Superintendent of Highways; and WHEREAS, the Town began paying the Employee the wages for the Working Supervisor position after January 23, 2017; and WHEREAS, the parties to this Agreement agree that the Employee is entitled to a retroactive pay differential from July 10, 2017 up to and inclusive of January 23, 2018; and WHEREAS, the Employee continues to occupy the position of Working Supervisor and performs the duties of that position; and WHEREAS, the parties to this Agreement desire to enter into, this agreement in order to provide a settlement to Employee in consideration for Employee's agreement to waive any claims he may have for any back pay due to him and to release the Town from any claims the Ernployee may have against the `Town; and NOW, THEREFORE, in consideration of the mutual covenants and promises hereinafter provided and of the actions taken pursuant thereto, the parties agree as follows: 1. The "Town agrees to pay Employee the sum of $2,335.92 as back pay and compensation for services rendered to the Town. 2. Acceptance of the above amount is acknowledged and is 11`1 full accord and satisfaction of the amount due. 3. In consideration of the amount paid, the Employee, for himself, his heirs, representatives, successors and assigns, releases and forever discharges theTown and its successors, assigns, officers, employees, attorneys, and agents from any and all claims, demands, debts, damages, injuries, actions or rights of action of any nature whatsoever, whether known or unknown, which Employee had relating to his compensation by the Town from April 1, 2017 through January 23, 2018. 4. The Employee represents that Employee has not filed any action, complaint, charge, grievance or arbitration against the Town or any of its successors, assigns, officers, employees, attorneys, and agents. 5. The terms of this Agreement have been approved by resolution of the Town Board of the Town of Wappinger at a duly convened meeting held on February 12, 2018. 6. This Agreement constitutes the entire agreement of the parties andall prior negotiations or representations are merged herein. It shall be binding upon and shall inure to the benefit of the parties hereto and their respective successors, assigns, heirs and legal representatives but neither this Agreement nor any rights hereunder shall be assignable by Employee without the Town's written consent. 7. If for any reason any one or more of the provisions of this Agreement shall be held or deemed to be inoperative, unenforceable or invalid by a court of competent Jurisdiction, such circumstances shall not have the effect of rendering such provision invalid in any other case or rendering any other provisions of this Agreement inoperative, unenforceable or invalid. 8. Job Description Town of Wappinger Historian The Town's Historian maintains and preserves the historical records of the Town of Wappinger. Residents and out-of-town visitors look to this resource for answers to questions concerning ancestry, historic buildings, genealogy, and historical facts that may be found in books, artifacts, or newspapers. The duties of the Historian are divided into four broad categories: research and writing, teaching and public presentations, historic preservations, and organization and advocacy: 1. Research and Writing- The first, and primary, responsibility of the Town Historian is interpretation of the past. It may include scholarly treatises as well as writing for the general public. 2. Teaching and Public presentations- The Historian may serve as a resource to teachers locally, speaking to community groups and working with individuals who are interested in the community's past. 3. Historic Preservation -This responsibility includes preservation of: the historic buildings throughout the town; manuscripts and records that document a community's past; and the artifacts that make up our Town's culture. 4. Organization and Advocacy -The Town Historian is often asked to participate in civic or patriotic observations. The Historian may be asked to use his/her knowledge of local government to lobby for legislative initiatives to promote community history. General Characteristics of the Office of Town Historian: This is an administrative position with the responsibility to collect and preserve documents, maps, photographs, and other materials relating to the history of the Town of Wappinger. The Historian also does research, writing, and public speaking about the Town of Wappinger and acts as a resource for the general public on ethnic, religious, genealogical, archeological or other related information. Work is performed under the general direction of the Town Supervisor. Q 1 Work activities: Typical work activities for the Town Historian include those listed below. They are indicative of the level and type of activities to be performed. But, they are not meant to be all-inclusive and do not preclude the Town Supervisor, Deputy Supervisor or Town Board from assigning activities not listed which could reasonably be expected to be performed by any person holding this title. 1. Develops plans and proposals for the preservation of the Town's historic buildings, working closely with the Director of Buildings and Grounds; 2. Collects and preserves old documents, photographs, and records; 3. Answers questions and does research pertaining to the history of the Town of Wappinger; 4. Furnishes assistance to the public in search of historical information; 5. Writes press releases (but only upon Board request and approval); 6. Performs public speaking about the Town of Wappinger History upon Board approval; 7. Develops programs and educational projects in conjunction with area educational institutions and historic societies; 8. Prepares genealogy tables of early settlers and helps to expand archeological excavations; 9. Supervises subordinate staff members and/or volunteers, if any; 10. Records current events for posterity; 11. Helps with Grant proposals as needed; 12. Provides archival assistance to the Town Clerk and any other designated records management officer; 13. Provides assistance from time to time to the Director of Recreation and the Recreation Committee; 14. Prepares an annual report to the town board, to be submitted no later than December 15th every calendar year; 15. Prepares an annual program budget for Town Board consideration during the annual Board Budget review process; 16. Provides such other assistance as may be requested by the Town Supervisor, including but not limited to delivery of Board Agenda and other packets of information; and 17. Submits bi-weekly reports of activities, to be included in the bi-weekly Board packets.
