RESOLUTION AWARDING CONTRACT FOR THE PURCHASE OF
AN AERATOR SYSTEM FOR APPLESAUCE LANE POND
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls; New York, on the 18th
day of August, 2003, at 7:30 P.M.
The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll being
called, the following were present:

ABSENT:
The following Resolution was introduced by Mr. Colsty and seconded by
Mr. Paoloni j
WHEREAS, pursuant to Resolution No. 2003-178, the advertisement for bids for the
installation of aerator fountains and related appurtenances within Applesauce Lane Pond subject
to the competitive bidding requirements'of General Municipal Law §103 and the Town's '
Procurement Policy was published in the Southern Dutchess News on June 25,2003; and
WHEREAS,bids were opened on July 7, 2003 and no bids were submitted for review to
Gloria J. Morse, Town Clerk of theTownof Wappinger; and
I WHEREAS, since no bids were received on July 7, 2003, a second advertisement for
bids for the installation of aerator fountains and related appurtenances within Applesauce Lane

WHEREAS; bids were opened on August 13, 2003 and bids were reviewed by Gloria J.
Morse, Town Clerk of the Town.of Wappinger; and
WHEREAS, Joseph E. Paggi, Jr., P.E. of Paggi, Martin &Del Bene, Engineers to the
Town of Wappinger, has provided an award recommendation to the Town Board.
NOW, THEREFORE, BE IT RESOLVED,
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein. '
2. The Contract for the.installation of aerator fountains and related appurtenances
within Applesauce Lane Pond is hereby awarded to Aquatic Management Services doing business
at 318 Church Road,Putnam Valley,New York 10579 for the price of Fifteen Thousand Dollars

{$15,000.00}in accordance wiih the award recommendation letter dated August 14, 2003 from
Charles R.Del Bene, Jr., P.E. of Paggi, Martin&Del Bene, Engineers to the Town of Wappinger,
to the Town Board.
3. Supervisor Joseph Ruggiero is hereby authorized and directed to execute said

Reference: Applesauce Lane Pond Aerators
Dear Supervisor Ruggiero &Board Members:
On May 25th, 2004, Steve Ho of Aquatic Management Services was at Applesauce
Lane Pond to install the aerators. During the installation a few problems arouse with
the anchor systems.
Typically, when the aerator is removed from the pond,the stainless steel anchor
cables are removed from the aerator and attached to floats,which keep the anchor
cables at the surface. When Mr. Ho went to reinstall the first aerator at the southern
end of the pond, the floats were not visible and the cables were at the bottom of the
pond. He then dragged the bottom of the pond with a rake and finally recovered the
two anchor cables. He also retrieved the floats used to suspend the cables and
informed me that they had been cut.
Mr. Bill Avon, a resident of Applesauce Lane, informed us that one of the residents
using a snow blower to clear the ice for ice. skating may have cut the floats.
Mr. Ho indicated that in the fall when the aerators are removed,the cables can be
suspended by the floats under the surface of the water by adjusting the connecting
cables from.the floats. This will keep the floats under the surface of the ice and out
of harms way.
Once this aerator was in place, the power was turned on, and the aerator was
functioning properly.
.He then proceeded to.start the installation of the aerator on the north end of the pond.
The same problem occurred at that end of the pond. Unfortunately, due to the deeper
depth at this end of the pond, he was unable to dredge the bottom and retrieve the
anchor cables. He did not have an extra stainless steel anchor system with him so the
northern aerator was not installed.

RE: Applesauce Pond Aerators I
On May 271h, 2004, Mr. Ho returned to the pond, assembled a new stainless steel
anchoring system, and installed the northern aerator. The power was turned on and
the aerator was operating properly.
We have attached the Town voucher from Aquatic Management Services for your
review and subsequent payment.
As you can see on the voucher, the original proposal for the installation of the two
aerators with the discount was $450.00. The additional cost for the materials and
labor for new anchor system for the north aerator was $250,00, resulting in the total
of$700.00.

face amount of$15,000.00.
• Acord Certificate of Liability Insurance issued through National Grange
Mutual Insurance Co. on behalf of Stephen J. Ho dib/a Aquatic
Management Services issued in favor of the Town of Wappinger as
Certificate Holder.
Please note that the Certificates are in the minimum amounts required by the Town of
Wappinger except the automobile liability insurance is lower due to the small size of the
job to be performed. Nevertheless, the amount of the automobile liability insurance
should be sufficient for these purposes.

Dear Supervisor Ruggiero &Board Members:
In looking at an estimated schedule for the installation of aerators at the above referenced
location, we contacted a manufacturer, Otterbine Barebo, Inc., for lead-time on the units.
They advised us that lead-times are dependent on what time of the season and the amount
of orders they receive. However, they indicated that a 1-2 week period would be a good
estimate.
We looked at the schedule for the project in two ways. The first was bidding the entire
project, including the aerator units. The other was to go out to informal bid for the
aerators and then bid the installation and electrical hookup only. With the estimated cost
of the two units being approximately $9,000.00, we thought the Town could send out
Request for Proposals (RFP) to purchase the units and save the 1 —2 week lead time.
This would also allow the installation to start immediately after the contract signing
because the aerators would be in hand.
We based our schedule on the Town Board's authorization being granted at the June 23rd,
2003 Town Board meeting. If this was the case, the RFP's for the aeration units could be
sent out to the manufacturers within 1-2 days. However, with a holiday on July 4 , 2003
and the Town Board meeting on July 7'h, 2003, this would leave only five (5)working
days for the manufacturers to submit their proposals.
If we could work the RFP's into the July 7"' Board meeting and the Town accepts a
proposal, we could have the units by the 3rd week of July. We could advertise for bids
for the installation as early as July 2nd, 2003, however, the contract could not be awarded
until the Town Board meeting on August 1 sty 2003.

With the award on August 18th, 2003, the contract signing most likely would take place
during the week of August 25t; 2003. The installation could take 2 weeks due to the
required Underwriters electrical inspection and Central Hudson's work,thereby taking us
into the second week of September 2003.
We will wait for your direction before proceeding any further.

Dear Supervisor Ruggiero &Board Members:
At the request of the Board,this office contacted Stephen Ho, Aquatic Biologist who
prepared a proposal for the residents the above referenced location.
During our conversation, we discovered that Mr.Ho has been working with the residents
of this area in trying to manage this pond for the last 8 to .10 years. When he was first
contacted by the residents of this area, he indicated he-initiated a non-chemical
management program for the pond, which continues today. Mr. Ho then went on to say
that the fish kill that has occurred was a result of the drought conditions and a lack of
oxygen in the water throughout the pond. Based on past successful pond aeration
projects, he feels that this treatment would enhance the pond environment.
We then went onto discuss the proposed number of units and the size of the aeration
motors. Mr.Ho indicated that due to the size of the pond and its configuration, he felt
that 3 units would due the best job. The reason for this is that the aerators have only a
certain radial distance where.they can effectively circulate the water. We explained to
him that our recommendation would be to initially use 2 units instead of 3. He said that
with 2 units there maybe sections of the pond which receive little or no circulation of the
water.
The reasons for the 2 hp. Motors instead.of 1 hp. motors are that the 1 hp. motor has a
tendency to breakdown from overworking and the 2 hp. motor is built better.
Lastly, we discussed the electrical costs associated with running two (2) aerators. Mr: Ho
indicated that the aerators typically run anywhere from 16 to 18 hours a day. The
following calculations are based-on a motor efficiency of 60% and approximately 100
watts per motor running amp, The 2 hp. motors use approximately 13.2 amps. -

■ $13.50/Day x 242 days (8 months) = $3,300.00 for 8 months
The electrical hookup, consisting of a 230 volt single phase service, will have to be
installed in accordance with the National Electric Code, as well as, Local Building Codes
and inspected.
Therefore,.this office would recommend that two of the proposed aerators be initially
purchased for the pond and if sometime in the future a third unit is warranted then the
Town Board can decide how to proceed.

RESOLUTION AUTHORIZING AN ADVERTISEMENT FOR BIDS
FOR THE PURCHASE OF AN AERATOR SYSTEM FOR
APPLESAUCE LANE POND
At a regular meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York,held at Town Hall, 20 Middlebush Road,Wappingers Falls,New York, on the 23rd
day of June, 2003, at 7:30 P.M.
The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll being
called,the following were present:

ABSENT:
The following Resolution was introduced by Mr. Colsey and seconded by
WHEREAS, a subdivision known as"Ye Old Apple Orchard"was approved by the
Town of Wappinger Planning Board in the early 1970s; and
WHEREAS, Applesauce Lane Pond was created as part of that Subdivision; and
WHEREAS, ownership was shared by and between surrounding landowners and the
Town of Wappinger pursuant to the creation of Applesauce Lane Pond; and
WHEREAS, Applesauce Lane Pond has become stagnant, and as a result thereof,the
growth of algae, lily pads and other organic life has caused the pond to become substantially
more shallow to the detriment of aquatic life; and

WHEREAS, as a result of the stagnation of Applesauce Lane Pond, the oxygen level of
the pond dropped below acceptable levels which further threatened aquatic life within the pond;
and
WHEREAS,the Town of Wappinger wishes to stop and reverse the negative effects
caused by the stagnation of Applesauce Lane Pond by increasing the oxygen level and inverting
the water temperature through the use of aerator fountains to achieve proper oxygenation and
foster the growth of aquatic life in order to preserve Applesauce Lane Pond for future
generations; and
WHEREAS, Joseph E. Paggi, Jr., P.E. of Paggi, Martin&Del Bene, LLP, Engineer to
the Town„ has recommended the installation of aerator fountains and related appurtenances
within Applesauce Lane Pond subject to the competitive bidding requirements of General
Municipal Law §103; and
WHEREAS, Supervisor Joseph Ruggiero has recommended that$22,000 be apportioned
from Parkland Trust to cover the costs associated with the installation of the aerator fountains
and related appurtenances to complete the work to be performed.
NOW, THEREFORE,BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. Joseph E. Paggi, Jr.,P.E. of Paggi,Martin&Del Bene, LLP,Engineer to the
Town, is hereby authorized and directed to advertise for bids for the purchase and installation of
aerator fountains to be installed within Applesauce Lane Pond in the Southern Dutchess News
and the Poughkeepsie Journal newspaper on June 25, 2003.

transfer the $22,000 from the Parkland Trust to the General Fund, Recreation Account A-710.2
entitled"Parks and Equipment", in order to cover the costs associated with the installation of the
aerator fountains and related work to be performed.

On Wednesday, August 13'`,2003, bids were received and opened for the above
referenced contract. The results are as follows:

• All Bright Electric . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 56,666.00
We have reviewed the above bids and found Aquatic Management Services bid to be
numerically correct. However, the bid proposal from All Bright Electric was not
completed properly.
As you may recall, the estimated capital cost for the Improvement was $19,000.00.
Being that the low bid received was $4,000.00 less, we would recommend awarding the
contract to the low bidder Aquatic Management Services in the amount of$15,000.00.
As in my July I Vh2003 letter to the Board, I would again please ask that this item be
placed on the August 18'`, 2003 Town Board agenda for the purpose of awarding the
Contract.
