The Official Codes, Rules and Regulations of the State of New York (NYCRR), Chapter 17b, also known as the Manual of Uniform Traffic Control Devices (MUTCD), states under §212.2 that, "Speed limits should be established only where engineering study indicates they are justified and reasonable.,, The New York State Vehicle and Traffic Law section §1622 further states that the NYSDOT may establish speed limits on county roads and town highways upon the request of the county superintendent of highways of the county and the town board of the town or towns of the affected roadway. Please be advised that the Department has implemented a procedure for addressing speed limit requests on non-State roads. The municipality shall provide the Department with the necessary study data, using standard Department methodology. We will review the submission and' return a decision to you within one month after receipt of the study. The following information is required: the amount and type of development along the road, various roadway features and physical condition of the roadway, one or more speed checks, and a report and recommendation signed by a licensed Professional Engineer. Cummins, Dutchess County Investigator 2007-32 Resolution of Support for Speed Limit Study on River Road North and Chelsea Road In the Town of Wappinger At a regular meeting of the Town Board of the Town of Wappinger,Dutchess County, New York,held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on January 8", 2007. The meeting was called to order by Joseph Ruggiero, Supervisor, and upon roll being called,the following were present: PRESENT: Supervisor - Joseph Ruggiero Councilmembers - William H. Beale Vincent F. Bettina Joseph P. Paoloni ABSENT: Maureen McCarthy The following Resolution was introduced by Councilman Paoloni and seconded by Councilman Bettina. WHEREAS,there is a large volume of traffic on River Road North and Chelsea Road, and WHEREAS, Town of Wappinger resident Wendy Smart, in a letter to the Town of Wappinger as attached, has expressed concerns about the excessive speeding which occurs on River Road North, and WHEREAS, Wendy Smart has requested that the speed limit be reduced from 40 miles per hour to 30 miles per hour, and WHEREAS,the New York State Department of Transportation sets the speed limits within the Town of Wappinger. NOW THEREFORE,BE IT RESOLVED as follows: 1. The recitations above set forth are incorporated in this Resolution as if fully set forth and adopted herein. 2. The Town Board of the Town of Wappinger hereby requests that the New York State Department of Transportation conduct a study of the speed on River Road North and Chelsea Road and requests that a feasibility study be conducted to have the speed limit reduced to 30 miles per hour. This change would effect only the northern end of the road, as the southern end of the road is already 30mph, and all other connecting roads are also already at 30mph_ This letter is to reiterate a verbal request made at the Town of Wappinger Planning Board meeting on 11120106, during the review of the proposed site plan and long term construction work planned by the DEP at the NY and Delaware Water Supply_ The work proposed at this site will increase the volume and types of traffic on the road. At that meeting, speed limit was cited as one of the factors compromising traffic safety,though your response to this request was essentially that the town can do-nothing about changing the speed limit. It is our understanding from talking with Richard Dillcnann,regional Traffic and Safety.Engineer from the NYS Department of Transportation,that the general process for such a request must first be approved by the town. The approved resolution would then be forwarded on to the county and then onto the State Department of Transportation for their subsequent approval. We have also confirmed this process on the Dutchess County Government website. In addition,we have recently-noticed in the.Poughkeepsie.Journal that the.Town of New Paltz is_under taking a similar request, and it seems to be going smoothly. We have attached this for your reference. The second one is to change the narne of Broadway which starts at Liberty Street and runs west to intersect with Market Street to continue on as Chelsea Road. The reason for this request is the confusion emergency "ambulance" services had during the past few months trying to locate the emergency. Smith, Supervisor Reference: Chelsea/Liberty Street/Parking 5 Dear Supervisor Smith & Board Members: At the November 22"d, 1999 Town Board meeting, the Board discussed a letter that they had received from the Chelsea Fire Department regarding parking on both sides of Liberty Street and its impact on the safe passage of fire fighting apparatus. The Board authorized Graham Foster and myself to make a field inspection of the above site to determine a possible remedy to the situation. One suggestion by.the fire company was to construct off- street parallel parking on the west side of Liberty Street. Graham Foster and I made the field inspection on November 24", 1999, and have found the following: 1 . There is existing right-of-way on the west side of Liberty Street from the edge of pavement to the right-of-way line of between 12'-15'. It is not recommended that parallel parking be placed in this right-of- way south of the existing gravel drlvews toward the intersection of Liberty Street and Spring Street. Construction of parallel parking north of the existing gravel driveway on Liberty Street up to and including some frontage along the existing Episcopal Church would provide room for no more than four' (4) vehicles. This may not prove effective in helping the parking problem. 2. It. is recommended that a letter from.the. Town Board be sent to each of the churches on Liberty Street in Chelsea, asking them not to. park along the sides of the streets during Sunday and other services, south of the existing churches and fire station. Y. 12590 Re : Extension of Chelsea River Road North to State Route 9D Gentlemen: Enclosed please find a copy of my letter of January 9, 1976 to William P. Horton, Superintendent of Highways , and his return memo of January 13, 1976 . It is my recommendation that negotiations be entered into by the Town ' s Attorney to obtain the R.O.W. ' s required. I have examined the soil maps of Dutchess County and question the area of Mansfeld silt loam that the road would pass through. Mr. Horton has personal knowledge of the construction of the Central Hudson power lines in this area and indicated to me that, with proper filling and settling, no serious problem in the construQtion of the road should be encountered. He however suggested, as we do, that the Town obtain the lands as soon as possible so all waste fill obtained by the Town can be placed in the low areas and given sufficient time to settle . My field investigation indicates that we should try to get as far away from the house on lot #6920301 so as to save the property_ Therefore, we could acquire some land on the northwest corner of the intersection of River Road North and Reeves Bypass where the old barns are partially demolished. This would allow the road to run on top of the existing culvert which flows east. We would have to get R.O.W. `s from lots #632030 and #720034 in addition to Central Hudson. The road would discharge onto Route 9D at about the Power Station. We certainly would have no problem with site distances .
