James Klein .for a Conservation Sub- Division covered in Town Zoning Regulation 411.92. Mr. Klein and his engineers have already informally met with the Town Board, and it is my understanding that it is the intention of the Town Board to instruct the Planning Board to receive said application. The Planning Board will then take all necessary steps to review, recommend and notify all Government agencies as a normal, Conventional Sub--Division and present it to the Town Board for their review before a Public Hearing is scheduled. For any surface waters that enter upon properties of other persons, the applicant shall obtain letters from the same permitting such discharge. 6 . The following improvements shall be required: A. All storm water shall be conveyed by pipe to natural drainage courses. B Standard street signs will be required at each . intersection and temporary signs will be installed during construction. C. Street specifications shall be those presently in effect at the time of construction. D.. No open streams will be allowed unless permission in writing is obtained from the Town of Wappinger Highwag'. Department. 7 Inspection fees for sewer lines, water lines and storm drainage lines shall be paid before the Planning Board chairman signs the pkat. . 8. Downstream drainage fee of $200.00 per lot on the final plat shall be paid prior to the signing of the plat or work of an equal or greater amount to be agreed upon by the Engineer to the Town, the Highway Department and the developer; and a line of credit will be presented to the Town of that value before the signing of the plat. 9. No structure is to be- built where lowest openings. (windows, doors, garage doors, crawl space, etc. ) are lower than two° feet above the road surface unless approved by the Highway Department and/or the Engineer to the Town. .10. All footing drains and roof leaders, if installed, shall be piped into the storm drainage system unless waived by the Highway Department and/or the Engineer to the Town. 11. . 1n subdivisions with underground utilities the developers shall contact Central, Hudson, New York Telephone Company, the Town franchised cable TV company abd the Town Board to negotiate an agreement whereby cable .TV facilities will be installed with the underground utilities . Should these negotiations be unsuccessful, the developers shall provide a statement indicating why an agreement could not be reached. Mr .. James A. Klein Page 3 12 . Prior to the issuance of any building permits, a bond of sufficient amount for the road and drainage and in a form approved by the Attorney to the Town shall be approved and accepted by the Town. Amount of said bond is to be determined by the Highway Superin- tendent and the Engineer to the Town. .13 . A determination of the location of the required street trees will be made prior to the signing of the plat. 14. Lands as indicated as a Conservation District shall, be donated and the Town Board shall establish said Conservation District. The applicant will petition the Town Board for establishment of a Conservation District. 15. Determination on the Environmental Impact Statement will be made prior to the signing of the plat. 16. Recreation fee of $5010 per lot on the final plat is to be paid prior to the signing of the plat or work of equal or greater value to be agreed upon by the Recreation Commission, the Town Board and the developer; and a line of credit will be presented to the town of that dollar value before the signing 17. The developer will be required to keep the roads of the subdivision clear from snow and ice and make the roads otherwise passable until such time as the roads have been accepted by the Town. Upon failure to do so, the Town may authorize, after determining that an emergency . exists,. a private contractor, to .clear the roads or make the roads passable, and the expense of such work will be assumed by the developer. 18. Road opening permit shall be obtained from the flown of Wappinger Highway Department. 19 . Note shall be placed on the plat to indicate that the road will continue as, a thru road to the adjacent property. 20. I recommend that the Town pay the tax due. This property in accordance with the enclosed Final Approval of the i . subdivision was to be turned over to the Town. Apparently the deed was never offered, or if it was presented to the Town, the deeds were not recorded. The parcel contains 27.71 acres. An adjacent parcel, of 39. 13 acres was also to be deeded to the Town under the same resolution of Final Approval and is still in the name of Fieldstone Farm. The statement of unpaid taxes was created on the 1984 Town Assessment II' Roll when we placed a zero value on the parcel to avoid a tax lien but for whatever reason we failed to remove the parcel from Sewer #1 and Water #1. Both districts received payment of the benefit assessment in 1985 since the County paid the districts as a result of the County guaranteeing collection of taxes. Mr. ,lames Klein, the developer of Fieldstone, has agreed with me that if the Town Attorney will draw the deeds for these two parcels he will execute them and the Town can record them. f We have come across this problem of deeds to the Town never being presented, accepted or recorded, that I suggest that no subdivision plat be signed it until such time as the required deeds are presented and accepted by the 'I Town and that the deeds be promptly recorded by the Town. Dear Mr. Klein: At the October 5th, 1981 Planning Board meeting, a motion was made by Mr. Fanuele, seconded by Mr. Mills, to adopt the following resolution: WHEREAS, an application for final approval of a subdivision plat entitled ",Section Two of Fieldstone Farm, Town of Wappinger, Dutchess County, N.Y." was received by the Town of Wappinger Planning Board on September 21st, 1981, and WHEREAS, a public hearing was held on said subdivision application and plat at the Town Hall;, Mill Street, Wappingers Falls, New York, on October Sth, 1981, and WHEREAS, the requirements of the Subdivision Regulations of the Town of Wappinger have been met by said subdivision plat and application, except as noted below, and WHEREAS, the conditions of the preliminary approval of said subdivision plat, granted by the Town of Wappinger Planning Board on August 17th, 1981, have been met, except .as noted below. NOW, THEREFORE, BE IT RESOLVED THAT the application of James A. Klein for approval of said subdivision plat, prepared by Richard G. Barger, P.E. .& L.S., and dated 7/27/81 and revised 9/15/81, be approved subject to the following conditions, and that the Chairman be authorized to endorse approval on said subdivisions plat upon compliance with said conditions by the applicant, which conditional approval shall expire six months from the 'date of this resolution if the applicant has not complied with the conditions set forth. Rear Yard Setback - 25 foot minimum. 3 . The following restrictions shall apply to this subdivision: A. No fencing except ornamental such as split rail, maximum. height - 36 rear .patio may be 6 feet maximum. B. No outbuildings may be constructed on any lot. C. No above-ground pools will be permitted. D. In-ground pool or patio may be installed, minimum of ten feet from any property line except in the front yard. E. Fencing around pool must be in accordance with the Zoning Ordinance. 4. Approval of the road plan and profile and plan and profile of the drainage system shall be obtained, in writing from the Engineer to the Town, .prior to the signing of the plat. 5. Drainage flow patterns shall be indicated on the individual plot plans. For any surface waters that discharge upon properties of otherpersons, the applicant shall obtain . letters from the same permitting such discharges. 6. The following improvements shall be required: A. All storm water shall be conveyed by pipe to natural drainage courses. B. Standard street signs will be required at each intersection and temporary signs will be installed during construction. C. Should these negotiations be unsucess-- ful, the developer shall provide a statement indicating why an agreement could not be reached. 12. Prior to the issuance of any building permits, a bond of sufficient amount for the road and drainage and in a form approved by the Attorney to the Town shall be approved and accepted by the Town. Determination on the Environmental Impact Statement was made by the Planning Board at their August 17th, 1981 meeting. 16 .` Recreation fee of $500.00 per .lot on the final plat isto be paid prior to the signing .of the plat orIwork of equal or greater value to be agreed upon by the Recreation Commission, the Town Board and the developer; and a letter of credit will be presented to the Town of that dollar value before the signing of the plat. : ., . 17. The developer will be required to keep the roads of the subdivision clear from snow and ;ice and make the roads otherwise passable until such time as the roads have been accepted by the Town. Upon failure to do so, the Town. may authorize, after determining that an 'emergency exists, a private contractor,. .to clear the roads or snake the roads passable, and the expense of such work will be assumed. by the developer. 18. Road opening permit shall be obtained from the Town of Wappinger Highway Department. 19.
