The August 6, 2018 minutes were sent by email to all board members on August 27th and on
September 6th, 2018. The Supervisor's office neglected to include a hard copy in their hand
delivered packets. Thus, the board agreed to acknowledge this at the next Town Board meeting.

Second Change Order for the ESB
Bob Gray advised that the HVAC change order number two is proposed to bring it back up by
$5,000 to join the furnaces into one flue, subsequent to the $10,000 reduction authorized in
Change order number one. He couldn't speak to the high humidity situation at the EMS building
addressed by Councilman Beale.

WHEREAS, by Resolution 2018-178, the Town Board authorized the solicitation of bids
for repairs to buildings at Schlathaus Park; and
WHEREAS, the Engineers to the Town prepared bid specifications which were duly
advertised in accordance with the provisions of General Municipal Law X103

3. The Town Board hereby authorizes the Supervisor to execute a contract after the Attorney to
the Town has confirmed that Trademark Custom Building & Woodworking. has duly executed
the contract documents, has supplied the necessary documents to begin the work.
The Town Board hereby authorizes that funding for the capital improvement project be appropriated from
the Parkland Trust Fund.

RESOLUTION: 2018-208
RESOLUTION AUTHORIZING CHANGE ORDER NO. 16 FOR THE EMERGENCY
SERVICES BUILDING RENOVATION PROJECT GENERAL CONSTRUCTION
CONTRACT NO. 17-003G
WHEREAS, by Resolution 2017-165 adopted by the Town Board on October 10, 2017,
the Town Board awarded a bid to J.C. Millbank Construction Co., Inc. (General Construction
Contract) in the amount of $563,500.00 for renovations to be made to the Emergency Services
Building; and
WHEREAS, the Town Board previously approved Change Order Nos. 1 through 15 to
the aforementioned contract in the total amount of $209,024.17, which resulted in a revised
contract sum in the amount of $772,524.17; and
WHEREAS, the Engineers to the Town, Morris Associates Engineering & Surveying
Consultants, PLLC, by email dated August 29, 2018, have approved Change Order No. 16 as
hereinafter set forth, which Change Order will result in a new contract price of $772,524.17.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
The Town Board hereby approves Change Order No. 16, which increases the total contract price
by the amount of $812.72, resulting in a new contract price of $773,336.89, a copy of which
Change Order is attached hereto.

RESOLUTION: 2018-209
RESOLUTION AUTHORIZING ENGINEERING STUDY OF WATER AND SEWER
MAIN INSTALLATION IN MYERS CORNERS AND OLD HOPEWELL ROADS
WHEREAS, Dutchess County Department of Public Works is realigning certain portions
of Myers Corners and Old Hopewell Roads; and
WHEREAS, it would be cost effective for the Town of Wappinger to install water and
sewer mains where needed in the right of ways of the two county roads while they are already
under construction; and
WHEREAS, the Engineer to the Town has advised that installation of certain water
mains to create service loops would be helpful for the operation of the United Wappinger Water
District;
NOW, THEREFORE, BE IT RESOLVED:
1. The Town Board of the Town of Wappinger hereby authorizes the Engineers to the
Town to conduct a study of the feasibility and costs associated for the installation of water and
sewer mains.
If the projects are feasible, the Engineer to the Town is directed to prepare a separate Map, Plan
and Report for water and sewer improvements that are identified and submit it to the Town
Board for its consideration.

RESOLUTION: 2018-210
RESOLUTION AUTHORIZING REPAIR OF CARNWATH FIRE ALARM SYSTEM
WHEREAS, the Fire Alarm System in the Dormitory Building and Chapel at Carnwath
Farms are inoperative and in need of repair; and
WHEREAS, the Dormitory Building, which includes the Sports Museum of Dutchess
County, a public assembly space, is in violation of the Fire Code of New York State because it
does not have a working fire alarm and the Town of Wappinger Fire Inspector issued a notice of
violation for that deficiency; and
WHEREAS, a working fire alarm system is required to open the Sports Museum of
Dutchess County to the Public; and
WHEREAS, the Town of Wappinger will appropriate the $17,510 from the A Fund; and
WHEREAS, the lowest quoted proposal is from Custom Security Services dated August
1, 2018 that details a rebuild of the Fire Alarm System Rebuild for the Dormitory Building and
the Chapel at a cost of $17,510.00; and
WHEREAS, the proposed work will fully alarm the basement and first floor of the
Dormitory Building and limited alarm coverage for the hallways on the 2nd and 3rd Floors which
are not utilized by the public and limited alarm coverage will be provided for the Chapel; and
WHEREAS, the Town of Wappinger has a contract with ("CSS") for fire and security
monitoring of Town Buildings;
NOW, THEREFORE, BE IT RESOLVED:
1. The Town Board of the Town of Wappinger will incurr the cost of $17,510 from
the A Fund.
2. The Town Board hereby accepts the proposal of Custom Security Services and
authorizes the Town Supervisor to sign any necessary documents to effectuate the terms of the
proposal.
3. The Supervisor of Buildings and Grounds is directed to assist with the fire alarm
system installation as required.
The Town of Wappinger Building Department shall issue any necessary permits for the
installation of the fire alarm system and perform any necessary inspections of the system.

RESOLUTION AUTHORIZING FEASIBILITY STUDY AND COST ANALYSIS FOR
REPLACEMENT OF TOWN HALL HVAC SYSTEM
WHEREAS, the Heating, Ventilation and Air Conditioning ("HVAC") System in Town Hall has
been plagued with problems for many years and fails to heat and cool the building properly; and
WHEREAS, the Supervisor of Buildings and Grounds has advised that the present HVAC
system has been repaired in a patchwork manner and can no longer be effectively maintained and
must be replaced; and
WHEREAS, a separate HVAC system was previously installed in the Town Courtroom and
Court Offices and is performing satisfactorily;
NOW, THEREFORE, BE IT RESOLVED:
1. The Town Board of the Town of Wappinger hereby authorizes the Engineers to the Town to
conduct a feasibility study and cost analysis for the replacement of the HVAC system for Town
Hall, including the addition of climate control for the hallways.
2. The Engineer to the Town is directed to prepare a report for the Town Board setting forth
feasible options for replacement of the Town Hall HVAC system.

VIII. Items for Special Consideration/New Business
Councilman Beale suggested a communication fix to allow for backup of communication
avenues in the event cell phone service goes down. He promised a resolution at a future
meeting.
Councilman Beale cited the need for the installation and expense of street lights at the
intersections of newer developments and town owned access roads. He suggested that those that
had lighting districts pay for it and those without districts would be paid by the town.
Supervisor Thurston addressed dangerous utility poles on roads throughout the town.
Councilman Beale addressed an unmentioned issue at the Greenway Bridge and the need to have
someone look at it.
1. Motion To: Authorize Pre -Work at Schlathaus Park before the Awarded Contract under
Resolution 2018-214 can begin.
Steve Frazier addressed work that needed to be done at the Schlathaus Park for a cost of $7,500
that needs to be done before the work at Schlathaus can be done. The board agreed to authorize
Pre -Work at Schlathaus Park before the Awarded Contract under Resolution 2018-214 can
begin. The amount is not to exceed $10,000 and is to be paid from the Parkland Trust. No
documentation was provided to the board nor the Town Clerk.

RESOLUTION: 2018-213
RESOLUTION SETTING PUBLIC HEARING ON CABLE FRANCHISE RENEWAL
AGREEMENT BETWEEN THE TOWN OF WAPPINGER AND CABLEVISION OF
WAPPINGERS FALLS, INC
WHEREAS, the New York State Public Service Commission issued an order on October
22, 2007 in Case No. 03-V-1133 Application of Cablevision of Wappingers Falls, Inc. d/b/a
Cablevision Systems Corporation for Approval of the Renewal of its Cable Television Franchise
for the Town of Wappinger (Dutchess County) approving the Cablevision Cable Franchise
Agreement with the Town for a ten-year term expiring on October 21, 2017; and
WHEREAS, Cablevision of Wappingers Falls, Inc. submitted a proposed franchise
renewal agreement to continue to operate a cable television system within the Town of
Wappinger a copy of which is attached hereto as Exhibit "1"; and
WHEREAS, prior to entering into a renewal of the cable franchise agreement, the Town
Board is required to conduct a Public Hearing thereon; and

WHEREAS, the Town Board determines that the renewal of the cable franchise
agreement is a Type II action pursuant to 6 NYCRR 617.5 (c) (20) and is otherwise exempt from

(SEQRA).
NOW, THEREFORE, BE IT RESOLVED, as follows:
The Town Board hereby schedules a Public Hearing on the franchise renewal agreement with
Cablevision of Wappingers Falls, Inc. to be held at Town Hall, 20 Middlebush Road,
Wappingers Falls, New York on the 24th day of September, 2018 at 7:30 p.m., and the Town
Clerk is directed to post the Notice of Public Hearing in the form annexed hereto and to publish
same in the Southern Dutchess News and Poughkeepsie Journal as required by law.

appropriate; and,

September 24th meeting.

Article I Intent; Applicability of Other Laws.'
§ 20-1 Statement of Intent.
The Town Board of the Town of Wappinger ("TOW'or or "Town") recognizes that there
are state statutory provisions authorizing towns to establish rules and standards of
ethical conduct for public officers and employees which, if observed, can enhance
public confidence in local government. In the light of a tendency today on the part of
some people to downgrade our local governments and to discredit our public servants
and our free institutions generally, it appears necessary that every effort be made to
assure the highest caliber of public administration of this town as part of our state's
important system of local government. It is the purpose of this chapter to implement
this objective through the establishment of standards of conduct, to provide for
punishment of violation of such standards and to create a Board of Ethics to render
advisory opinions to the town's officers and employees as provided for herein.
§ 20-2 Applicability of Other Laws.
The standards, prohibited acts and procedures established herein are in addition to
any prohibited acts, conflicts of interest provisions or procedures prescribed by
statute of the State of New York and are also in addition to common law rules and
judicial decisions relating to the conduct of town officers to the extent that the same
are more severe in their application than this chapter.
Article II. Ethical Standards.

Wappinger and who shall serve without compensation and at the pleasure of the

Town Board, shall consider and make recommendations to such Town Board as to
any amendments of this Code. The opinions of the Board of Ethics shall be advisory
and confidential, and in no event shall the identity of the town employee or Board
