Former Supervisor Barbara A. Gutzler of 5 Russet lane expressed her concerns about the

proposed local law 10 prohibiting parking on roads during the winter. She said that she never
have seen roads obstructed during winter months. She asked for the number of tickets issued and
towing. Councilman Johnston replied that there were 58 summonses issued in 2017 and 27
issues in the first 4 months of 2018.
27 year Highway employee Mickey Krisco and a long-time snow plow operator, expressed the
opposite opinion citing impassable conditions with cars who have parked during snowstorms.
He cited numerous times where time was wasted waiting for people to move their cars.
Sometimes cars were never moved. Dutchess County Sergeant Beagor expressed the notion that
infractions are much greater than the number summoned and are only a fraction of those
violators were actually issued summonses. He also felt that there is a need for revising the law.

1. Motion To: Open the Public Portion
Adele Amir from the Mid -Hudson Islamic association expressed concern about a need for
increased and enhanced patrol at the mosques during active times at these houses of worship
citing the acts of violence reported on the national news for the purpose of safety and security.
Shehnaz Ali of 7 Twin Road in the Town of Poughkeepsie spoke to the board and also expressed
fear of potential hate related acts and was glad that we were having a discussion on how we can
again feel safe. Councilman Beale expressed similar concerns on soft targets like houses of
worship of all creeds. The board agreed to discuss the issue with Dutchess County Sergeant
Beagor. Sami Kahn of Poughkeepsie High School read a statement pointing out the attacks on
places of worship and expressed concern about threats and fears in attending these places. He
said that he would appreciate any support they can receive from the officials of the town to
continue living the dream that so many people came with here.
Ken Sciochi from 47 Edgehill Drive. Came to speak about speeding on Edgehill Drive in the
area where Brothers Road sub division connects to the Edgehill sub division via the Edgehill
spur between the two developments. He asked for a three way stop sign. Engineer Gray
explained that stop signs do not control speed and susmested hiahwav Datrol duriniz Deak hours.

Discussions
Town Patrol and Edgehill Drive Speeding
Sergeant Begor suggested a full time deputy sheriff for the Town of Wappinger. The cost for
one 8 hour per day (40 hours per week) deputy would be $113,358. This would include $2,673
for benefits, $18,109 for FICA and retirement and $68,466 for salary payable to the county. His
recommendation would be to budget $250,000 for the remainder of the time that the full time
person was not here. The budget is currently approximately $200,000 per year which would
result in an increase of $50,000. Councilman Beale confirmed that $250K would be the total
amount NOT on top of the existing $200,000. Sergeant Begor agreed. He added that the full
time deputy would only leave the town on emergencies. The question arose as to whether patrol
services would be increased or decreased. The board agreed that a further need for discussing
patrol hours needed.
Sergeant Begor also addressed the speeding on town roads including Edgehill Drive. He
suggested temporary speed trailers at Edgehill Drive and then ticketing. He added many are
usually non-resident speeding which would drop off once ticketing is evident.
Soccer field interim solution(Wappinger United Soccer
A representative from soccer came to ask for a solution to the wet fields that exist throughout the
town parks. The use of Carnwath Park was suggested at the site of the former softball field
which usually stays dry.
Community Day Update
Director Fulton suggested a 2 day event where carnival rides would be larger. She suggested a
Saturday parade, fireworks, and children focused activities such as having a magician and mad
science. Sunday would be a more adult focus, musicians, dance floor, vendors that offer more
adult focused items such as crafts, business vendors, etc... The ride issue will be discussed in
executive session.

WHEREAS, Michael Krisco has submitted his resignation and notice of retirement; and
WHEREAS, Michael Krisco has been an employee of the Highway Department for the
past 27 years and has served with dignity and reliability; and
WHEREAS, Michael Krisco has performed his duties for the Highway Department with

great distinction and dedication.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The recitations above set forth are incorporated in this Resolution as if fully set

2. The Town Board acknowledges and reluctantly accepts the resignation and notice
of retirement of Michael Krisco and long-time employee of the Highway Department.
3. The Town Board acknowledges that Michael Krisco has served as long-time
employee of the Highway Department with great distinction and dedication and wishes him
many years of happiness in retirement and commends him for his devoted years of service to the
Town.
The Town Board requests the Town Supervisor to send a letter formally acknowledging Michael
Krisco's resignation and notice of retirement and his many years of distinguished and devoted
service to the Town and wishes him all the best in his future endeavors.

RESOLUTION: 2018-260
Resolution Adopting Local Law No. 10 Of The Year 2018, "Local Law Amending Chapter
230 Of The Town Code Prohibiting Parking During The Winter."
WHEREAS, a Resolution was duly adopted by the Town Board of the Town of Wappinger
introducing a proposed Local Law entitled "LOCAL LAW AMENDING CHAPTER 230 OF THE
TOWN CODE PROHIBITING PARKING DURING THE WINTER" for consideration by the
Town Board; and
WHEREAS, a Public Hearing was duly advertised in the Southern Dutchess News and the
Poughkeepsie Journal, the official newspapers of the Town; and
WHEREAS, a Public Hearing was held on November 13, 2018 and all parties in attendance
were permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or
any part thereof; and
WHEREAS, the Town Board determined that the proposed Local Law was not subject to
environmental review; and
WHEREAS, the Town Board of the Town of Wappinger after due deliberation, finds that it
is in the best interest of the Town to adopt said Local Law; and

WHEREAS, said Local Law has been on the desks of the members of the Town Board of
the Town of Wappinger for at least seven (7) days, exclusive of Sunday, prior to the adoption of this

NOW, THEREFORE, BE IT RESOLVED, as follows:
The Town Board of the Town of Wappinger hereby adopts the Local Law entitled "LOCAL
LAW AMENDING CHAPTER 230 OF THE TOWN CODE PROHIBITING
PARKING DURING THE WINTER" a copy of which is attached hereto and made part
of this Resolution.
2. The Town Clerk is directed to enter said Local Law in the minutes of this meeting and into
the Local Law book for the Town of Wappinger and to give due notice of the adoption of
said Local Law to the Secretary of State of New York.
The Town Highway Superintendent is authorized and directed to place new signs describing the
parking restrictions at all principal entrances to the Town of Wappinger as required by the Local
Law.

real property located at 1639-1643 Route 376 in the Town of Wappinger, Tax Grid 4 6259-03-
482346, seeking a reduction in the 2017 and 2018 tax assessment for those respective tax rolls;
and
WHEREAS, the Town Assessor and Special Counsel have recommended a settlement of
these tax review proceedings; now, therefore be it

settlement on behalf of the Town of Wappinger of the tax review proceedings for the years 2017

the Town Accountant has audited the escrow account and reviewed the amount due.

Resolution Authorizing Purchase Of Greenway Community Signs
WHEREAS, the Town of Wappinger is a Hudson Valley Greenway Community; and
WHEREAS, the Town posted welcome signs at the principal entrances of the Town and of the
hamlets within the Town; and
WHEREAS, the existing signs are in disrepair and other signs are missing;
NOW, THEREFORE, BE IT RESOLVED:
1. The Town Board hereby authorizes the purchase of 7 single sided signs and 2 double sided
signs from Sing Language, Inc.in accordance with the attached invoice.
2. The signs shall be installed as shown in Attachment 1.
3. The Superintendent of Highways is directed to coordinate with Dutchess County DPW and
NYS DOT to install signs at the noted locations.
4. The following budget transfer is hereby authorized to fund the purchase.

WHEREAS, the Highway Superintendent has requested the ability to create one

Resolution Authorizing Transfer Of Funds For Purchase Of Buildings & Grounds
Equipment
WHEREAS, Supervisor of Buildings and Grounds, Steven Frazier, has advised that his
department needs a mini -excavator and a tractor mounted wood chipper attachment; and
WHEREAS, the Supervisor of Buildings and Grounds identified a mini -excavator which is
available through a vendor that has an approved contract through by Sourcewell Purchasing
Consortium, so it is not subject to competitive bidding; and
WHEREAS, the Supervisor of Buildings and Grounds solicited three quotes for the tractor
mounted wood chipper attachment in accordance with the Town of Wappinger Procurement
Policy; and
WHEREAS, the Town Board has agreed that it is in the best interest of the Town to purchase the
mini -excavator and tractor mounted wood chipper attachment; and
WHEREAS, in order to cover the cost of the equipment, it will be necessary to transfer funds
between budget lines;
NOW, THEREFORE, BE IT RESOLVED, as follows:
The Supervisor of Buildings and Grounds is hereby authorized to enter into a contract
with H.O. Penn for the purchase of a One (1) New Caterpillar Inc. Model: 304E2 CR
Excavator at a price of $56,350.00 in accordance with attached quote dated November 8,
2018;
2. The Supervisor of Buildings and Grounds is hereby authorized to enter into a contract
with Westchester Tractor, Inc. for the purchase of a Wallenstein 3 -point hitch chipper
Model BX102RI at a price of $11,973.00 in accordance with attached quote dated
November 7, 2018;
3. The following budget transfer is hereby authorized to fund the purchase.

LOCAL LAW NO. 10 OF THE YEAR 2018
A Local Law entitled "Local Law Amending Chapter 230 of the Town Code Prohibiting
Parking During the Winter."
BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section L• Title.
This Local Law shall be known and cited as "Local Law Amending Chapter 230 of the
Town Code Prohibiting Parking During the Winter."
Section IL• Legislative Intent.
The purpose of amendment is to prevent any obstruction or interference with the use of any
public highways of the Town of Wappinger, outside the corporate limits of the Village of Wappinger
Falls, during the winter months to facilitate the clearing and removal of snow and ice from such
highways and to prevent the obstruction of the operations of the Town Highway Department during
snowstorms. As snow can fall at any time of the day or night, it is important to prohibit parking at all
times during winter months, not just during the overnight hours, to reduce the necessity of ticketing
and removing vehicles during snow and ice removal in the winter months. The Local Law also moves
the commercial parking provision from the no parking at all times provision to the parking prohibited
during certain hours.
The Town Board hereby determines that it is in the interest of public safety, the safety of the
travelling public, government efficiency and in the best interests of the residents that parking be
prohibited on any public highway of the Town of Wappinger, outside the corporate limits of the
Village of Wappinger Falls, at all times from November through March when ice and snow events
are most likely to occur. The Town Highway Superintendent concurs with this determination.

Section III: Parking Prohibited at All Times
Section 230-16 entitled "Parking prohibited at all times; parking of commercial vehicles." is
hereby deleted and replaced with a new section 230-16 to read as follows:
"§ 230-16. Parking prohibited at all times; Wintertime parking prohibited.
A. No person shall park a vehicle at any time upon any of the streets or parts thereof
described in Schedule XII (§ 230-46), attached to and made a part of this chapter
B. No person shall park a vehicle at any time, upon any street in the Town of Wappinger
outside the corporate limits of the Village of Wappinger Falls, but not including state
highways maintained by the state, between November 1 of each year and March 31
of the following year, inclusive of said dates. Signs giving notice of this parking
restriction shall be posted at all principal entrances to the Town of Wappinger.
C. Any violation of this section is subject to Penalty as set forth in Chapter 230, Article
VI, § 230-34 and/or Removal as set forth in Chapter 230, Article V, § 230-32."
Section IV: Parking Prohibited Certain Hours.
Section 230-19 entitled "Parking Prohibited Certain Hours; All -Night Wintertime Parking"
is hereby deleted and replaced with a new section 230-19 to read as follows:
"§ 230-19. Parking Prohibited Certain Hours
A. No person shall park a vehicle between the hours specified in Schedule XV (§ 230-
49) of any day, unless otherwise indicated, upon any of the streets or parts of streets
described in said Schedule, attached to and made a part of this Chapter.
B. No person shall park a commercial vehicle between the hours of 7:00 p.m. and 7:00
a.m. the next day on any Town road in any residential zoning district, except in the
event of an emergency.

(1) For the purposes of this section, a "commercial vehicle" shall be a vehicle
which exceeds 18,000 pounds in gross vehicle weight, and includes
tractors, road tractor -trailers, rollers, tractor and truck cranes, power
shovels, road -building machines, snowplows, road sweepers, sand
spreaders, tank trailers and buses, and any other such vehicle used for,
intended to be used for, registered for or potentially registered for
commercial purposes.
(2) Notwithstanding the above, the following shall be exempt from this
section:
Any police, fire or emergency service vehicle.
ii. Any vehicle owned by a municipality or corporation engaged in
repairs or improvements to any service provided by the Town of
Wappinger or its authorized agents.
iii. Any vehicle owned by a municipality or corporation engaged in
repairs or improvements to any street or right-of-way maintained by
the Town of Wappinger.
iv. Any vehicle which is in the process of picking up or delivering
merchandise or other property.
V. The temporary parking of any vehicle on a road while the driveway
where said vehicle is normally parked is being repaved."
(3) Signs giving notice of this parking restriction shall be posted at all
principal entrances to the Town of Wappinger."

Section V: Numbering for Codification.
It is the intention of the Town of Wappinger and it is hereby enacted that the provisions of
this Local Law shall be included in the Code of the Town of Wappinger; that the sections and sub-
sections of this Local Law may be re -numbered or re -lettered by the Codifier to accomplish such
intention; the Codifier shall make no substantive changes to this Local Law; the word "Local Law"
shall be changed to "Chapter", "Section" or other appropriate word as required for codification; and
any such rearranging of the numbering and editing shall not affect the validity of this Local Law or
the provisions of the Code effected thereby.
Section VI: Separability.
The provisions of this Local Law are separable and if any provision, clause, sentence,
sub -section, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any
person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall
not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or
parts of this Local Law or their application to other persons or circumstances. It is hereby
declared to be the legislative intent that this Local Law would have been adopted if such illegal,
invalid or unconstitutional provision, clause, sentence, subsection, word or part had not been
included therein, and if such person or circumstance to which the Local Law or part thereof is
held inapplicable, had been specifically exempt therefrom.
Section VII: Effective Date.
This Local Law shall take effect immediately upon adoption and filing with the Secretary
of State as provided by the Municipal Home Rule Law.

Each of the E2 models is equipped with the engine solution to best

class and application. Also, standard features like auto idle offer
consistent lower engine speeds to increase engine life and offer

Smart Technology is a new feature of the 303.5E2. Through the
integration of this technology with the U.S. EPA Tier 4 Final 23.5 hp
(17.6 kW) engine, the machine is able to meet and exceed performance
of the previous generation 303.5E. Additionally, testing on the 303.5E2
revealed an 8% fuel economy improvement and 7% greater efficiency
over the E Series.
Automatic Two Speed
With the standard automatic two speed feature, the machine will
automatically balance high speed and torque travel requirements
based on job site conditions to give the operator the optimum speed
and control. The machine can be put in low gear if slower travel
is desired while in tight conditions.
The COMPASS control panel on the Cat E2 Series mini hydraulic
excavators was specifically designed by Caterpillar for compact
excavators. It adds several new features to the machines increasing
the amount of customer value. All of the following features are now
standard on all E2 Series models.

The E2 Series is available with a mechanical pin -grabber
or a hydraulic pin -grabber quick coupler option. The coupler
design uses a wedge to keep the tool secure to the coupler,
reducing wear and maintaining a tight fit through the life

One-way and two-way auxiliary lines (combined function),
including quick connections, are fitted as standard equipment
so the machine comes ready to work. A standard accumulator
allows for auxiliary pressure to be released, making connecting
and disconnecting work tools safer and easier.
