Dear Mr. Versace :
I have reviewed all of the previous correspondence regarding
this drainage problem and I am enclosing herewith a summary
that was produced by my engineer dated August 16 , 1983 . 'This
summary was forwarded to former Supervisor Diehl on September
IS , 1983 .
The bottom line of the situation that we ' re in is that the
water is a Town problem. The water would cross a County high-
way and end up back into an area which is currently being
sub-divided and possibly under Town review. Based on all of
the above conditions , I believe the problem should be handled
by the Town. As we have indicated, we are certainly coopera-
tive in allowing you to use the County right-of-way foT the
introduction of the required drainage system, however, the
participation by the County would not be considered as the cur-
rent drainage system meets our requirements .
I will be glad to meet with anybody in regard to this if they
so desire, however, I believe the attachments should suffice .

Dear Lou:
In regard to your letter dated July 8th indicating that "it
could be in part created" by County surface water, please be
advised that I immediately directed my Engineering Department
to investigate our exposure in your request to connect a Town
drainage system into the County drainage system along Myers
Corners Road.
Our review of the situation indicates that there can be a con-
nection into our system, however, the proper solution would
be to improve the system from Dogwood Hill Road along that side
a of Myers Corners Road to the existing culvert that crosses Myers
Corners Road approximately 1500 feet to the west. We take the
position that the increase in flow into our system is not as
you noted - casually being created from Highway surface water
and that an improvement to the system would require us to enter
into an agreement with the Torn in regard to responsibilities
and apportionment of cost . I think that with this being a pos-
sibility, we should sit down as soon as possible and get some
of the groundwork established so we can get this project to-
gether and have it scheduled properly so that the drainage
problem can be solved.
I would suggest that your engineer and my Director of Enginee r
ing meet for a preliminary overview of the project so we can
proceed from that point in regard to the apportionment of Cost
and address the question of responsibilitieVSPR-NTT,

the drainage work.

Investigation of conditions relative to the request
described in Supervisor Lou Diehl's letter of July 8, 1983 indicates
the following:
Q The Town problem involves two culvert crossings on
Dogwood Hill Road with inadequate downstream drainage
and no easements. The Town is therefore requesting
tying into the existing storm drainage system on
CR 93.
Q The said system on CR 93 cannot handle the additional
flow from Q without major modifications. I am unaware
of any past problems with our drainage system.
Q The discharge of the drainage system in ® is into
vacant land which is proposed for subdivision
(Shelburne Hills) . This of course compounds the
Town's problem since discharge from an enlarged
system on CR 93 would have to be handled by the town
or the developers.
® The stream which would accept the flow from
eventually recrosses CR 93 approximately 650 feet
from the proposed subdivision access mentioned above.
Q In order to accommodate the Town's request, an
understanding must be reached regarding who will be
responsible for design and funding of construction.
There are two alternate methods of satisfying drainage
requirements: I, Upgrade the present system on CR 93
and discharge into the proposed subdivision--this
will also necessitate an enlargement of the culvert
under CR 93 mentioned in II, Construct anew system
from Dogwood Hill Road along CR 93 to the stream crossing
mentioned in ®.
We recommend consideration of Alternate II as the best solution
in the long term for handling storm drainage in this area. Agreements
addressing responsibilities and apportionment of costs will be necessary
to implement.

Dear Members of the Board:
I have reviewed the drainage problem at 6 Dogwood Hill Road and
I concur with Mr. Lapar' s letter, dated June 17 , 1981, that the
problem can be corrected by discharging the water out on Myers
Corners Road. The expense would be considerable, and a legal
opinion as to responsibility should be obtained.

Dear Board Members :
On Monday, June 15, 1981, we visited the above captioned resi-
dence and found the condition to be as related in Karl Houseknechts '
letter of June 2 , 1981 .
It is our opinion that the correction of this problem would only
be done by a complete piping or rip-rap ditch construction down
to High View Road. A 15 foot easement 7 . 5 ' on each side of the
northern property line does exist . The cost would be substantial.
An alternate would be to eliminate this discharge and deposit all
waters on Myers Corners Road. If the Board, does in fact decide
to do anything, (a legal decision as to responsibility should be
obtained) it could first by-pass to see if any adverse effects are
caused and then as an alternate, pipe or rip-rap to High View.
