1. Motion To: Open Public Portion
Resident Dawn Stopa from 33 Montfort Road came to speak to the Town Board for the first time
regarding flooding in her home. She asked for the town to remedy the situation by lowering the
waterway for better drainage and sloping it so that it can be maintained by the town. She asked
the town to send a letter to her surrounding residents asking them not to dump in the easement.
The issue was whether or not it is a town responsibility or not. The historical drainage easement
set up by the developers of the Serenity mission development behind her property was remedied.
However, there was no drainage easement set up for the Montfort road homes. The Montfort
road homes are below the grade level of Montfort road, and have berms in place to keep the flow
of water along the road's drainage pipes during the majority of the year. During the winter when
the snowplows disturb the berms, water from melted snow would occasionally flow away from
the road until they get repaired in early spring. According to the town attorney if the water flows
from Montfort road in a normal way, the town would be responsible. If it flows down a
driveway because it is lower that Montfort road it is not. According to the engineer and highway
superintendent, a special drainage district would need to be set up with benefit units charged to
the 23 lots in that area to avoid a precedent of using public funds for private use. The district
would encompass the residents whose back yards face the wetland from the roads of Larisa Lane,
Elizabeth Terrace, and Montfort road whose flow was never directed south into the Sprout
Creek. Resident Stopa handed out correspondence but gave nothing to the town clerk for filing
in these minutes.
Resident Bill Dengler from Drew court also addressed the drainage from a Rockingham
easement.
Tommy Masch addressed the Local Law prohibiting winter parking during snow emergency with
regard to towing. He requested a copy of the ordinance be made available to the public for the
benefit of the tow truck operator to allow for a hassle free removal of the vehicle that is being

towed. He asked for a copy of the ordinance for him to copy and hand out to residents. The
code is available on the town website along with copies of the Local Law on file at the Town
Clerk's office.

Discussions
Easements and Improvements
With regard to the flooding at 31 Montfort road, Highway Superintendent Bettina stated, "You
cannot take taxpayers money and make improvements on other people's property. That's why we
created drainage districts today." Attorney Horan stated that at the time that the Montfort road
houses were built, there was no drainage easement set up. The subdivision map for the
development to the north and east, Larissa Lane/Elizabeth terrace sub -division, had an easement
that started on a high point intended to flow 'North' under Larissa Lane rather South to the Sprout
Creek. He re -iterated that Drainage Districts must be established among the lots along Montfort,
Elizabeth and Larissa. The subdivision map had an easement coming from the south under
Elizabeth and then go under Larissa. The low point is not in the easement but on the side of a
hill. No easements exist behind the Montfort properties at the time sit was built. Right now
there is a utility easement on a side of a hill. He stated that no easement was created for the
catch basin in 1973. He further stated that the town has NO legal obligation to remedy
wetlands or personal drainage only to direct water flow from the highways such that it does not
affect neighboring properties. He found no map of wetland found in this area. Drainage
easements are for draining roads not properties. Common law states that property owners cannot
re -direct the flow of water by pipes and swales. In 2003, storm water analysis went into effect
on flow off site, prior and after development. Post 2003 sub -divisions are in good shape, but not
so before where there are no storm water ponds. Engineer Gray attempted to staked out the
swale according to the easement, but found that it did not match the maps. He noted that the
McGraff subdivision had no easements filed on the county clerk map. It was only recorded as a
final subdivision. The engineer's recommendation is to establish a Drainage District can
establish a district and assess a benefit unit. Attorney Horan stated that drainage districts were a
result of MS4 restrictions. There will be a Status update at next meeting.
2. Motion To: Authorize the Supervisor to sign the Eagle Scout Proposal
Eagle Scout representative Mr. T.J. Goldman proposed a 6 week long S.T.E.A.M program to

build rockets for Science Technology and Arts. Supervision will be from adults and parents.
The rockets will land with the help of a parachute and which has no combustible fuel left.
Location is tentative at Martz field. Die very quickly and safe basically model rockets. The
board will get a copy of Eagle Scout plan. Kevin Hathord from Rockingham, 50 Carroll drive
susmested landing the rockets at the Rockingham soccer fields.

Community Day
The Town of Wappinger Recreation committee suggested having community day moved from
Schlathaus to Wappingers Junior High School. They suggested that parking is better than
Schlathaus Park and the parade would be better attended and the field is drier. They felt that the
fireworks would be set from the Evans school. The parade route would start at Mesier Park
down Mesier Avenue to Wappingers Junior High School which will need school approval. An
option for a July event will be investigated.
Report on Audit by RBT
Jessica and her Director from RBT accountants appeared before the board. They distributed an
outline of their presentation and audited 2017 financial statements to the board; but, gave nothing
to the Town Clerk for filing or reporting in these minutes. They did not provide a copy to the
comptroller upon request of a copy of the statements by the Town Clerk of the Town
Accountant/Comptroller
The director gave the highlights of each of the general funds. The town has assets of
$54,218,685. The A general fund balance decrease by $1.3 million dollars to $2.1 million
dollars. The B -General Fund increase by over $1 million dollars in the year 2017 due to raised
property tax revenues and granted revenues such as sales tax that exceeded actual spending. She
did not give a B fund fund balance, only the $1.0 million dollar increase. The highway's fund
balance increased by $50,000 to $1.8 million dollars. The town has $22 million in outstanding
bonds with stable principle payments at about $2.2 million. Liability for Post Health Retirement
is $7.5 million over the life of retirees.
The footnotes describe the findings of escrow liabilities and the calculation of post employment
benefits that have been addressed.
Volunteer Policy
Supervisor Thurston Proposed a Volunteer policy draft to the board for their feedback. Nothing
was given to the town clerk,. This will be put into a more final form at the January Regular town
Board meeting.
6. Charter For Committee For Arts and Culture
Supervisor Thurston handed out a document for Arts and Culture. He encouraged the board to
give feedback also by the first regular town board meeting.

7. Bottini Oil
Minutes December 10, 2018
Attorney Horan discussed a plea agreement by Bottini Oil for improper business practices
regarding credit balances. There were 2 instances for over payments for the Town of Wappinger
amounting to $1,100 dollars which should be repaid with interest within the next few months.
Councilman Beale asked Town Accountant/Comptroller to review all payments for fuel over the
last 12 years and have a report ready at a future town board meeting.
8. Town Park Rules on Signs
Steve Frazier was asked to review rules on signs at town parks for accuracy.
VII. Resolutions
RESOLUTION: 2018-260
Resolution Adopting "Local Law Amending Chapter 230 Of The Town Code Prohibiting
Parking During Snow Emergencies."
WHEREAS, a Resolution was duly adopted by the Town Board of the Town of Wappinger
introducing a proposed Local Law entitled "Local Law Amending Chapter 230 of the Town Code
Regulating Parking During the Winter" for consideration by the Town Board; and
WHEREAS, the Town Board determined that the proposed Local Law was not subject to
environmental review; and
WHEREAS, a Public Hearing was duly advertised in the Southern Dutchess News and the
Poughkeepsie Journal, the official newspapers of the Town; and
WHEREAS, a Public Hearing was held on November 13, 2018 and all parties in attendance were
permitted an opportunity to speak on behalf of or in opposition to said proposed Local Law or any
part thereof; and
WHEREAS, based on the comments received at the public hearing, the Town Board revised the
Local Law to restrict its scope to prohibit parking during snow emergencies, as they are defined in
the Local Law; and
WHEREAS the revised Local Law is now entitled "Local Law Amending Chapter 230 of the Town
Code Prohibiting Parking During Snow Emergencies"; and
WHEREAS, the Town Board of the Town of Wappinger after due deliberation, finds that it is in
the best interest of the Town to adopt said Local Law; and
WHEREAS, said Local Law has been in pdf form and received by the members of the Town Board
of the Town of Wappinger for at least ten (10) days, exclusive of Sunday, prior to the adoption of
this Resolution;
NOW, THEREFORE, BE IT RESOLVED, as follows:

The Town Board of the Town of Wappinger hereby adopts the Local Law entitled "Local Law
Amending Chapter 230 of the Town Code Prohibiting Parking During Snow Emergencies" a copy
of which is attached hereto and made part of this Resolution.
The Town Clerk is directed to enter said Local Law in the minutes of this meeting and into the
Local Law book for the Town of Wappinger and to give due notice of the adoption of said Local
Law to the Secretary of State of New York.
The Town Highway Superintendent is authorized and directed to place new signs describing the
parking restrictions at all principal entrances to the Town of Wappinger as required by New York
State Vehicle and Traffic Law.

Resolution Awarding Contract For Water & Electrical Service Replacements For
Carnwath Farms Administration Building
WHEREAS, the Town Board authorized the Engineer to the Town to prepare bid
specifications and contract documents for work to provide replacements for the water service and
electrical service supplying service to the Carnwath Farm Administration Building; and
WHEREAS, bids and specifications were prepared by Morris Associates Engineering &
Surveying Consultants, PLLC, Engineers to the Town, for the required construction work; and
WHEREAS, bids were duly advertised and solicited for the work to be done and three bids
were received by the Town Clerk and were opened on November 30, 2018; and

WHEREAS, the bid from Stoneykill Contracting, Inc. is conforming and is reasonable;

WHEREAS, the Engineer to the Town has investigated the contracting history of
Stoneykill Contracting, Inc. and determines that it is a responsible bidder; and
WHEREAS, the Engineer to the Town recommends that the Town Board should award
the contract to Stoneykill Contracting, Inc. in the amount of $41,600 all as set forth in the
aforementioned recommendation letter, a copy of which is affixed hereto.
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town of Wappinger hereby awards the contract for the Camwath Farms
Administration Building Water & Electrical Service Replacements to Stoneykill Contracting, Inc.,
113 Stoneykill Road, Wappingers Falls, New York 12590 in the amount of $41,600.
2. In accordance with the authorized bid specifications, the Town Board hereby
authorizes the Supervisor to execute the contract documents as prepared by the Engineers to the
Town including the Notice of Award and Notice to Proceed and forward a copy Stoneykill
Contracting, Inc., after the Attorney to the Town has confirmed that Stoneykill Contracting, Inc.,
has duly executed the contract documents, has supplied the necessary Performance Bond, Payment
Bond and provided insurance certificates as required by the bid specifications.
Funding for this project shall be appropriated from a line item based on the recommendation from
the Comptroller/Town Accountant.

RESOLUTION: 2018-279
Resolution Authorizing Transfer Of Funds For Purchase Of Trailer
WHEREAS, Supervisor of Buildings and Grounds, Steven Frazier, has advised that his
department needs a trailer for transporting the department's equipment; and
WHEREAS, the Supervisor of Buildings and Grounds identified a trailer which fits the needs of
the Department manufactured by Kaufman Trailers; and
WHEREAS, the Supervisor of Buildings and Grounds attempted to solicit quotes from other
vendors, however no other vendor had a comparable product; and
WHEREAS, the Town Board has agreed that it is in the best interest of the Town to purchase the
trailer; and
WHEREAS, in order to cover the cost of the trailer, it will be necessary to transfer funds
between budget lines.
NOW, THEREFORE, BE IT RESOLVED, as follows:
The Supervisor of Buildings and Grounds is hereby authorized to enter into a contract
with Kaufman Trailers for the purchase of a FP -8K -30D trailer at a price of $7,640.00 in
accordance with attached quote dated November 9, 2018;
2. The following budget transfer is hereby authorized to fund the purchase.

RESOLUTION: 2018-281
Resolution Authorizing Refund Of Unused Road Inspection Escrow In Connection With
Tuscany Subdivision
WHEREAS, on or about February 2, 2006, David Stenger of Creekview Holdings, LTD.
(hereinafter the "Applicant") made a deposit in the amount of Seventeen Thousand Dollars
($17,000.00) with the Town of Wappinger for road inspections; and
WHEREAS, all work was completed, inspected and approved; and
WHEREAS, the Applicant has requested that the unused balance of the Road Inspection
Escrow Account be returned; and
WHEREAS, the Town Accountant has audited the escrow account and has
verified the amount due to the Applicant.
NOW, THEREFORE, BE IT RESOLVED:
The recitations above set forth are incorporated in this Resolution as if fully set
forth and adopted herein.
2. The Town Board hereby authorizes a return of the unused balance of the Road
Inspection Escrow in the amount of Eleven Thousand Nine Hundred Ninety -Six 60/100 Dollars
($11,996.60) to Creekview Holdings, LTD.

Resolution Promoting Seasonal Laborer To Full Time Laborer
WHEREAS, Stephen Lewis has been employed in the Buildings and Grounds Department as a
Seasonal Laborer; and
WHEREAS, the Director of Buildings and Grounds advises that Mr. Lewis exhibits an excellent
work ethic and eagerness to learn and he is an asset to the operation of the Department; and
WHEREAS, there is a vacant full time Laborer position that is funded by the Budget; and
WHEREAS, the full time Laborer position is a Labor position under Civil Service Law which is not
subject to competitive examination; and

Agreement between the Town of Wappinger and Teamsters Local 445 ("CBA");
NOW, THEREFORE, BE IT RESOLVED:
1. Stephen Lewis is hereby appointed to the full-time civil service job tide Laborer, effective

Resolution Awarding Contract For Repair To Emergency Services Building Sanitary
Sewer Pipe
WHEREAS, a sanitary sewer pipe in the Emergency Services building frequently clogs
under the floor; and
WHEREAS, the Engineer to the Town investigated the blockage and conducted a video
inspection of the pipe which identified an area of pipe that is not pitched properly to permit proper
flow of sewage; and
WHEREAS, the Engineer to the Town obtained a quote from Herring Sanitation Service,
Inc. to make the needed repairs; and
WHEREAS, the repair work needs to be done on an emergency basis to maintain proper
sanitary service for the ESB;
NOW, THEREFORE, BE IT RESOLVED, as follows:
1. The Town of Wappinger hereby awards a contract for repairs to the sanitary sewer line in the
Emergency Services Building to Herring Sanitation Service, Inc. in the amount of $4,850.00 in
accordance with the attached quote.
2. The Town Board hereby authorizes the Supervisor to sign the attached quote sheet.

electric, using the funds from the United Wappinger Water District Fund Balance.
In a December 10th email Jim wrote:
According to the 2019 Budget there is a $2.3 million fund balance in the UWWD. I looked at the 2019
Budget and there does not appear to be a $535,000 appropriation for the work, so it would come from
Fund Balance. Much of the fund balance has been accumulated from payments from NYC DEP. It was
anticipated that those buy -in fees would be used to pay for the improvements to the Meadowwood
Wells.
No resolution was provided for this by the Attorney.

LOCAL LAW NO. 10 OF THE YEAR 2018
A Local Law entitled "Local Law Amending Chapter 230 of the Town Code Prohibiting
Parking During Snow Emergencies."
BE IT ENACTED by the Town Board of the Town of Wappinger as follows:
Section L• Title.
This Local Law shall be known and cited as "Local Law Amending Chapter 230 of the
Town Code Prohibiting Parking During Snow Emergencies."
Section IL• Legislative Intent.
The Town Board of the Town of Wappinger finds and declares that the expeditious removal
of snow from the public highways in the Town of Wappinger is required to keep the highways open
for emergency vehicles during snow emergencies to protect the health, safety and welfare of the
inhabitants of the Town. The Town Board enacts this Local Law to prohibit parking on public streets
and highways in the Town of Wappinger, outside the corporate limits of the Village of Wappingers
Falls, pursuant to the authority granted by New York State Vehicle and Traffic Law §1660 (18) &
(27). A snow emergency shall exist when the National Weather Service has issued an advisory or
warning that winter weather conditions are expected to be severe, hazardous or cause significant
inconvenience to the traveling public. This Local Law also grants authority to local officials to declare
a snow emergency in circumstances where the National Weather Service has not issued advisories
for the Town of Wappinger.
The Local Law also reorganizes Chapter 230 Article III of the Town Code to include the new
section and make the Article internally consistent.
Section III: Amendment of Parking Prohibited at All Times
§ 230-16 entitled "Parking prohibited at all times; parking of commercial vehicles." is
hereby deleted and replaced with a new § 230-16 to read as follows:

"§ 230-16. Parking prohibited at all times.
A. No person shall park a vehicle at any time upon any of the streets or parts thereof
described in Schedule XII (§ 230-46), attached to and made a part of this chapter
Section IV: Amendment of Parking Prohibited Certain Hours.
§ 230-19 entitled "Parking prohibited certain hours; all-night wintertime parking." is hereby
deleted and replaced with a new § 230-19 to read as follows:
"§ 230-19. Parking prohibited certain hours.
A. No person shall park a vehicle between the hours specified in Schedule XV
(§230-49) of any day, unless otherwise indicated, upon any of the streets or parts
of streets described in said Schedule, attached to and made a part of this Chapter
Section V: Prohibiting Overnight Parking of Commercial Vehicles
Chapter 230, Article III is hereby amended by the addition of a new § 230-19.1 to read as
follows:
"§ 230-19.1 Overnight Parking of Commercial Vehicles Prohibited
A. No person shall park a commercial vehicle between the hours of 7:00 p.m. and 7:00
a.m. the next day on any Town road in any residential zoning district, except in the
event of an emergency.
(1) For the purposes of this section, a "commercial vehicle" shall be a vehicle
which exceeds 18,000 pounds in gross vehicle weight, and includes tractors,
road tractor -trailers, rollers, tractor and truck cranes, power shovels, road -
building machines, snowplows, road sweepers, sand spreaders, tank trailers and
buses, and any other such vehicle used for, intended to be used for, registered
for or potentially registered for commercial purposes.
(1) Notwithstanding the above, the following shall be exempt from this
section:
Any authorized emergency vehicle as defined by New York State
Vehicle and Traffic Law §101.

ii. Any vehicle owned by a municipality or corporation engaged in
repairs or improvements to any utility provided by the Town of
Wappinger or its authorized agents.
iii. Any vehicle owned by a municipality or corporation engaged in
repairs or improvements to any street or right-of-way maintained by
the Town of Wappinger.
iv. Any vehicle which is in the process of picking up or delivering
merchandise or other property.
V. The temporary parking of any vehicle on a road while the driveway
where said vehicle is normally parked is being repaved.
Section VI: Wintertime Parking Restrictions
Chapter 230, Article III is hereby amended by the addition of a new § 230-19.2 to read as
follows:
"§ 230-19.2. Wintertime Parking Restrictions
A. Overnight Parking Prohibited During Wintertime.
(1) Between November 1 of each year and March 31 of the following year, no
vehicle shall be left standing or allowed to remain parked upon any public
highway of the Town of Wappinger, outside of the corporate limits of the
Village of Wappingers Falls, between the hours of 12:00 midnight and 8:00
a.m. during such months.
B. Snow Emergency. Declaration and Duration
(1) A snow emergency shall automatically exist when the National Weather
Service issues any of the following advisories for a forecast area that includes
the Town of Wappinger:
(a) BLIZZARD WARNING
(b) ICE STORM WARNING
(c) SNOW SQUALL WARNING
(d) WINTER STORM WARNING
(e) WINTER WEATHER ADVISORY

(2) When the National Weather Service has not issued an winter advisory listed in
subdivision B(1) above, the Town Supervisor, the Superintendent of Town
Highways or their designees may declare a snow emergency for the Town of
Wappinger whenever road conditions become hazardous such that the free
movement of fire, health, police or other vehicular traffic may become impeded
by reason of snow, freezing rain, sleet or other natural causes.
(a) Upon the declaration of a Snow Emergency, the Town of Wappinger
shall contact the media and issue public announcements about the snow
emergency by any reasonable means available.
(b) It shall not be a defense to a charge of violating snow emergency
regulations that the vehicle operator or owner was unaware of any such
snow emergency announcement.
(3) Duration of Snow Emergency.
(a) Any snow emergency declared as a result of a National Weather Service
Advisory described in subdivision B(1) above shall commence at the
issuance of the weather advisory or one hour prior to the commencement
of the warned time period stated in the NWS advisory and shall cease
48 hours after the expiration of the NWS advisory, unless otherwise
extended or terminated by the Town Supervisor, the Superintendent of
Town Highways or their designees.
(b) Any snow emergency declared by the Town Supervisor, the
Superintendent of Town Highways or their designees shall commence
within 30 minutes of the issuance of the declaration, or at such time
stated in the declaration, and shall cease 48 hours after the issuance of
the declaration of emergency, unless terminated earlier by the Town
Supervisor, the Superintendent of Town Highways or their designees.
(c) Continuation of the emergency beyond the 48-hour time period shall be
conveyed to the public by the Town Supervisor, the Superintendent of
Town Highways or their designees through the media and the Town of
Wappinger website.
C. No Parking During Snow Emergency
(1) No vehicle shall be left standing or allowed to remain parked upon any public
highway of the Town of Wappinger outside of the corporate limits of the
Village of Wappingers Falls during a snow emergency.
D. Signs. Signs giving notice of the parking restrictions set forth in subdivisions (A)
and (C) of this section shall be posted at all principal entrances to the Town of
Wappinger.
E. Removal and storage of vehicle. Any vehicle parked in violation of this section is
subject to removal and storage in accordance with the provisions of § 230-32."
Section VII: Numbering for Codification.
It is the intention of the Town of Wappinger and it is hereby enacted that the provisions of
this Local Law shall be included in the Code of the Town of Wappinger; that the sections and sub-
sections of this Local Law may be re -numbered or re -lettered by the Codifier to accomplish such
intention; the Codifier shall make no substantive changes to this Local Law; the word "Local Law"
shall be changed to "Chapter", "Section" or other appropriate word as required for codification; and
any such rearranging of the numbering and editing shall not affect the validity of this Local Law or
the provisions of the Code effected thereby.
Section VIII: Separability.
The provisions of this Local Law are separable and if any provision, clause, sentence, sub-
section, word or part thereof is held illegal, invalid or unconstitutional, or inapplicable to any
person or circumstance, such illegality, invalidity or unconstitutionality, or inapplicability shall
not affect or impair any of the remaining provisions, clauses, sentences, subsections, words or parts
of this Local Law or their application to other persons or circumstances. It is hereby declared to
be the legislative intent that this Local Law would have been adopted if such illegal, invalid or
unconstitutional provision, clause, sentence, subsection, word or part had not been included
therein, and if such person or circumstance to which the Local Law or part thereof is held
inapplicable, had been specifically exempt therefrom.

Section IX: Effective Date.
This Local Law shall take effect immediately upon adoption and filing with the Secretary
of State as provided by the Municipal Home Rule Law.

This office has completed our review of the above bid proposals and found that the
apparent low bidder's (CDE Electric Inc.) bid did not include the pricing for the water
installation portion of the project. Since their bid did not cover the work required by the
contract, we do NOT recommend that they be awarded the contract. This office has
previously worked with Stoneykill Contracting Inc. (Stoneykill) on prior municipal
,projects. To the best of our knowledge Stoneykill has suitably performed work on the
prior projects and so we would expect that they would also be able to perform the work
specified in this, contract. This office reviewed: the Stoneykill bid submission and found
that it was in general conformance with the bid submittal requirements.
It is therefore recommended that the Base Bid contract be awarded to Stoneykill

By submission of this bid, the bidder agrees and represents that it has visited the site prior
to the time of submitting the bid and has inspected and given consideration to the
conditions under which the work is to be performed. In addition, the bidder has carefully
examined the site of the proposed work and all premises adjacent thereto. The bidder has
satisfied and fully informed itself from its own investigation or research as to:
the nature and location of the work,
• the general and local conditions,
• the various means of approach to the sites,
• the sites and facilities for delivering, unloading, storage, and handling of
materials and equipment,
• the character, quality, and quantity of existing materials,
a the kind and extent of equipment, labor, materials, and facilities needed,
and all other items, which may in any way affect the work or the bidder's performance in
accordance with the contract requirements.
In consideration of, and to induce the award of this contract to itself, the bidder represents
and warrants that:
(a) If this bid is accepted by the Town Board, Town of Wappinger, as evidenced by
issuance of a Notice of Award by the Owner, and mailed by registered mail with
return receipt requested to the address of the bidder as indicated on hislher bid, the
bidder will execute a contract on the form of agreement herein provided and will
comply with all provisions of said Notice of Award.
(b) This bid is made without any understanding, agreement or connection with any other
person, firm or corporation making a bid for the same work, and that it is in all
respect fair and without collusion or fraud.
(c) The bidder has carefully examined and fully understands all of the parts of the
contract documents, and that the bidder will execute the contract and will completely
perform it In strict accordance with the provisions thereof for the sum set forth on the
bid.
(d) No officer or employee of the Town Board, Town of Wappinger, or any person
whose salary is payable in whole or in part by the Town Board is, shall be, or shall
become interested directly or indirectly as a contracting party, partner, stockholder,
surety or otherwise in this bid or in the performance of the contract or in the
supplies, materials or equipment, or to work or labor to which it relates, or in any
portion of the profits thereof.

(e) The bidder is not in arrears to the Town Board upon debt or contract and is not a
defaulter as surety, contractor, or otherwise upon any obligation to the Town Board,
Town of Wappinger.
(f) All work shall be completed within the time allotted, from the date specified in the
Notice to Proceed or set by the contract documents, mailed to the undersigned by
registered mail with return receipt requested to the legal address of the bidder as
indicated on its bid.
(g) If the bid documents contain any unlawful provision not an essential part of the bid
and which shall not appear to have been a controlling or material inducement to the
making thereof, the same shall be deemed of no effect and will upon notice by either
the Owner or the bidder be deemed stricken from the bid documents without
affecting the binding force of the remainder.
(h) Each and every provision of any law and clause required by law to be inserted in the
bid documents shall be deemed to be inserted herein and the bid documents shall
be read and enforced as though it were included herein; and if through mistake or
otherwise any such provision is not inserted or is not correctly inserted, then upon
the application of either party, the bid documents shall forthwith be physically
amended to make such insertion.
(i) The bidder is financially solvent and sufficiently experienced and competent to
perform the work.
(j) The work can be performed as called for by the proposal and that the plans and
specifications are in all respects suitable and adequate for the work.
(k) . The facts stated in its bid and the information given by the bidder are true and
correct in all respects.
(1) The bidder is fully informed regarding all the conditions affecting the work to be done
and labor and materials to be furnished for the completion of this contract, and that
its information was secured by personal investigation and research.
(m) In the event of a lawsuit, the bidder agrees that said suit shall be filed in the
Supreme Court, State of New York, County of Dutchess.
(n) The Contractor has received, reviewed and carefully examined all of the documents
which make up this Contract Agreement, and has found them in all respects to be
complete, accurate, adequate, consistent, coordinated and sufficient for
construction.
