At a regular meeting of the Planning Board of the Town of Wappinger, Dutchess
County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York
on the-2L day of , 2008 at 7:00 P.M.
The meeting was called to order.by Chairman Victor Fanuele and upon roll being
called, the following were:

WHEREAS, the Town of Wappinger Planning Board received an application of the
Community Baptist Church (the "Applicant" and "Owner") for Special Permit and Site
Development Plan approvals for the developed ± 5.23-acre where the `existing church
building and associated parking areas are located (the "Project" or "Proposed Action"); and
WHEREAS, the Proposed Action does not involve any construction on the lot; and
WHEREAS, the property is known as Tax Lot 6257-02-774966 on the Town of
Wappinger Tax Map and is located at 226 All Angels Hill.Road across from the intersection
with Edgehill Road in the R--40 zoning district (the "Site" or"Subject Property"); and
WHEREAS, the Applicant has submitted Application for Site Plan Approval, dated
April 16, ,2007; Application for Special Use Permit, dated April 16, 2007; a Full
Environmental Assessment Form, dated March 1.8, 2007 and a site plan entitled, "Survey,
Proposed Parcel. A - Prepared for Community Baptist Church," prepared by Raymond E.
Heinsman, Professional Land Surveyor, P.L.L.C., Wappinger Falls, New York, dated
December 28, 2006, and last revised November 30, 2007; and

RESOLUTION OF SPECIAL PERMIT AND SITE DEVELOPMENT PLANT APPROVALS
WHEREAS, the Planning Board determined that the Project is an Unlisted Action
with respect to SEQR and WEQR; and
WHEREAS, a duly advertised public hearing on the special permit and site
development plan was held on April 7, 2008 at the Wappinger Town Hall, 20 Middlebush
Road, Wappingers Falls, Now York at which time all those wishing to be heard were given
the opportunity to be heard and the hearing was closed on that date; and
WHEREAS, the Planning Board is familiar with the Site and all aspects of the
Project and is satisfied that the. Project will comply with the Zoning Law including
without limitation the Special Use Permit, Site Development Plan, Parking and
Performance standards of Articles VII through X1 respectively of the Zoning Law as well
as other applicable laws and regulations subject to the conditions below. .
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
L The Planning Board hereby adopts and incorporates the recitations and statements
set forth above as if fully set forth and resolved herein.
2. Pursuant to the State Environmental Quality Review regulations, the Planning Board
hereby adopts a Negative Declaration on the grounds that the proposed action will
not result in any significant adverse environmental impacts since there is no
construction and/or land disturbance associated with the proposed action.
3. The Planning Board hereby grants Special Use Permit and Site Development Plan
Approvals to the Project as defined above on the Subject Property in accordance
with the provisions of Articles VII, V111 and IX of the Zoning Law subject to the
following conditions and modifications:
The Property Owner and Applicant shall endorse a copy of this resolution and
submit it to the Planning Board for its files.
b. The Applicant shall submit a statement signed by the Town's Tax Collector
that all taxes due on the Subject Property have been paid in full.
All comments in the Dutchess County Department of Public Works
November 21, 2007 letter and any subsequent letter(s) issued; shall be
f satisfied to the satisfaction of the Town Engineer.

I Tow Engineer's March 17, 2008 memorandum. to the Planning Board, to the
satisfaction of the Town Engineer.
e. P? The plans shall be signed- and sealed by a licensed surveyor and engineer,
all metes and bounds shall be finalized and al.1 required signature nature blocks 9 g
shall be endorsed to the satisfaction of the Town Engineer.
f. The Applicant'shall amend the above mentioned plans to the satisfaction of
the Town Planner as follows:
{a) The site plan shall be revised to be named as "Site Plan."
(b The site plan shall be revised to provide the corrected lot coverage
and floor area ratio calculations for the subject property.
(c) The site plan shall be revised to show shrubs that are 3 to 4 feet high
d of such type and. spacing along the front property kine to
adequately screen the parking area to the satisfaction of the Building
Inspector,
C(d))The site plan shall be revised to include a note indicating that
"Within twelve (12) months of when the house on the Church's
adjacent property to the north is sold, the Applicant shall provide
shrubs that are 3 to 4 feet high and of such type and spacing along
the front property line to adequately screen the. parking area to the
satisfaction of the Building Inspector."
4. In accordance with the Town's Schedule of Fees, the Applicant shall be
responsible for the payment of all application review fees incurred by the Planning
Board in the review of this Project which are in excess of the application review
fees paid by the Applicant to-date. Such fees shall be paid within thirty (30) days
of the notification to the Applicant that such fees are due. If such fees are not paid
within this thirty (30) day period and an extension therefore has .not been granted
by the Planning Board, this Resolution shall'be rendered null and void. Refunds of
any remaining funds within the escrow account for the applications will only made
in accordance with the provisions of Chapter 240 Attachment 6:1., Planning and
Zoning Departments Fees and Escrow Funds.
5. In accordance with Article IX of the Zoning Law, unless otherwise extended by the
Planning Board for good cause.shown, this Site Development Plan Approval shall

expire and become void one (1) year from the date of the adoption of.this resolution
if an application for a Building Permit has not been made, or three (3) years from the
date of the adoption of this resolution if construction in conformance with the
approved Site Development Plan has not been completed, if the construction is not
prosecuted with reasonable diligence, or if the premises has been substantially
vacant or inactive for more than three (3) years.
6. In accordance with Article VII of the Zoning Law, unless otherwise extended by the
Planning Board for good cause shown, this Special Use Permit Approval shall expire
and become void if the approved use of the Site shall cease for more than one (1)
year for any reason, if Site Development Plan Approval expires, or if all required
improvements are not maintained and all conditions and standards complied with
throughout the duration of the approval use.
7. The continued validity of the Site's Certificate of Occupancy shall be subject to
continued conformance with the approved Special Use Permit and Site Development
Plan.
8. The Planning Board Chairman shall endorse a copy of this resolution certifying its
correctness. The Applicant shall also sign a copy of this resolution after it has
been initially endorsed by the Chairman acknowledging his receipt of a copy of the
resolution. When all of the conditions set forth above have been satisfied, and
when the Applicant has funded the application review escrow account established
for the Project to its original amount, nine (9) sets of the above referenced plans,
revised as necessary, shall be submitted for endorsement by the Planning Board
Chairman, certifying that the plans comply with the terms of this resolution, at
which time, the Chairman shall also endorse this resolution in the space provided
below, certifying that the Applicant has complied with the above conditions of
approval,
One (1.) set of the endorsed plans will be returned to the Applicant, one (1) set will
be retained by the Planning Board, and one (1) set each will provided to the Town
Building Inspector, Town Engineer, Town Planner, Town Highway
Superintendent, Town Assessor, Town Fire Prevention Bureau and the Dutchess
County 911 Addressing Office.
9. The Applicant must return for approval from the Planning Board if any changes to
the endorsed plans and/or this Resolution of Approval are subsequently desired,

WHEREAS, the Town of Wappinger Planning Board received applications of the
Community Baptist Church (the "Applicant" and "Owner") for preliminary and final
subdivision approval for the subdivision of an ± 6.72-acre developed lot into 2 lots; ± 5.23
acres (Parcel A) and ± 1.48 acres (Parcel B) in size (the "Project" or "Proposed Action");
and
WHEREAS, the existing church building and associated parking areas are proposed
to be located in Parcel A while the existing two-story brick building and detached garage
are proposed to be located in Parcel B; and
WHEREAS, the Proposed Action does not involve any construction on either lot;
and
WHEREAS, the application has only been made in order to sell the proposed 1.48-
acre Parcel B; and

WHEREAS, the applicant has submitted an Application for Preliminary Subdivision
Plat Approval, dated January 22, 2007; Application for Final Subdivision Plat Approval,
.dated January 22,. 2007; a Full.Environmental Assessment Form, dated March 18, 2007 and
a subdivision plan, "Subdivision Prepared for Community Baptist Church," prepared by
Raymond E, Heinsman, Professional Land Surveyor, P.L.L.C., Wappinger Falls, New
York, dated December 28, 2006, and last revised January 29, 2008; and
WHEREAS, the Planning Board is familiar with the Subject Property and its
surroundings, and has reviewed the Project in accordance with the standards for approval
contained in the Zoning Law and the Land Subdivision Regulations; and
WHEREAS, the Planning Board determined that the proposed 2-Lot Subdivision
would result in the creation of one (1) new building lot but not one (1) new home within
the Town of Wappinger; and
WHEREAS, the Planning Board determined that the Project is an Unlisted' Action.
with respect to SEQR and WEQR; and
WHEREAS, a duly advertised public hearing on the preliminary 2-lot plat was held
on April 7, 2008 at the Wappinger Town Hall, 20 Middlebush Road, Wappingers Falls,
New York at which time all those wishing to be heard were given the opportunity to be
heard and the hearing was closed on that date.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The Planning Board hereby adopts and incorporates the recitations and statements

5. The Planning Beard hereby waivesthe public.hearing on the Final Subdivision Plat
in that itis in substantial conformance with the Preliminary Plat,

modifications which must be satisfied prior to the signing of the final plat by the

(b) The subdivision plan shall be revised to provide the corrected lot
coverage and floor area ratio calculations for both proposed lots.
(c) The site plan shall be revised to show shrubs that are 3 to 4 feet high
and of such type and spacing along the front property line to
adequately screen the parking area to the satisfaction of the Building
' Inspector.
(d) The subdivision plan shall be revised to include a note indicating that
"Within twelve (12) months of when the house on Parcel B is sold,
the Applicant shall. provide shrubs that are 3 to 4 feet high and of
such type and spacing along the front property line to adequately
screen the parking area to the satisfaction of the Building inspector.
7. Conditional approval of the final. plat shall expire one hundred eighty (180) days
from the date of this resolution unless all requirements have been certified as
completed or unless a written request for an extension of Final Subdivision Plat.
Approval (not to exceed two (2) ninety (90) day periods) is granted.
8. In accordance with the Town's Schedule of Fees, the Applicant shall. be responsible
for the payment of all application review fees incurred by the Planning Board in
review of this.Project which are in excess of the application review fees paid by the
Applicants to-date. Such fees shall be paid within thirty (30) days of the notification
to the Applicant that such fees are due. If such fees are not paid within this thirty
(30) day .period and an extension therefor has not been granted by the Planning.

At their February 7th, 1,977 meeting, the Planning Board of
the Town of Wappinger adopted the following resolution :
BE IT RESOLVED THAT THE PLANNING BOARD OF THE TOWN OF WAPPINGER
HEREBY GRANTS final site plan approval to the Community Baptist
Church for site plan entitled "New Multi-Purpose Building, Community
Baptist Church, All Angels Hill Road, Wappingers Falls, N.Y. ", prepared
by Edmond G . Loedy, Registered Architect, and dated revised 1/18/77
and subject to the following conditions :
1 . Approval of the Dutchess County Department of Public Works
shall be obtained per their letter dated November 9th, 1976
and prior to the issuance of a building permit.
2 . Approval of the Dutches,s County Department of Health
shall be obtained prior to the issuance of a building- permit.
3 . Downstream drainage fee is waived.
4 . _ Final disposition of the drainage flow shall 'be indicated
can a revised map. For any surface waters that enter_ upon
properties of others, the applicant shall obtain letters
from the same permitting such discharge.
5 . Approval of the Zoning Administrator shall be obtained
if any new signs are to be located on the premises.

This department- gives preliminary approval for
the use of two driveways by Community Baptist Church and pro-
posed multi-purpose building as shopm on plans dated I0-22--76,
subject to the following conditions:
1. Both driveway entrances roust be paved
from edge of the road to property line.
71his is necessary due to increase use of
drive%rays.
2. An application should be submitted to
this office in order to obtain a work permit.

RE Community Baptist Church
Dear Sirs :
In regard to the .above site plan the New Hackensack Fire Company
: has the following recommendations :
1 . The area of the parking lot in front of the building
where no parking is permitted should be labeled as
such by appropriate signs .
7 . Each exit from the building shall be equipped with
panic hardware and be identified by an illuminated
exit sign. Such illumination shall be continuous .
3 . Emergency lighting shall be provided in all areas
of public assembly.
4 . The following fire extinguishers shall be located and
maintained in the following locations :
a ten-pound ABC dry _chemical extinguisher
In the utility- room .
three -two and.-one-half -gallon- type A eater
extinguishers to be . Located .throughout the
building .
S . An ionization. type detector to be installed in the .
utility room. The detector is to be battery operated
and shall emit a minimum 85 decibel alarm.
