However, it should be noted that you would have to obtain reapproval from the Dutchess County Department of Health prior to September 7th at which time that approval would expire . Please note that pursuant to Section 276 of the Town Law there is only a period of one year in which to comply with the conditions of approval and filing of the map. if yotr plat is not filed within the one year period, the approval becomes null and void and a new application would have to be submitted and would be subject to any new fees or other requirements. Rubenstein, to grantan extension of final approval to run until September lst, 1980. The motion was unanimously carried. It should be noted that this plat was signed by the Health Department on September 7th, 1979 and this approval will, therefore, expire on September 7th, 1980 . This is to advise that the necessary steps should be taken to have the plat reapproved and resigned if the applicant does iaot intend to .f-ile the plat prior to the September lst, 1980 date. Noto: At their October 15th, 1.9.79 meeting, the Planning Board of the Town of Wappinger adopted the following resolution: WHEREAS, an application for final approval of a subdivision plat. entitled "Subdivision Plat for Compa Felice, Inc. , Town of Wappinger, Dutchess County, New York" was received by the Town of Wappinger Planning Board on September 17th, 1979, and WHEREAS, a public hearing was held on said subdivision application and plat at the Town, Hall, Mill Street, Wappingers Falls, New York, on Monday, October 15th, 1979 at 8 : 05 p .m. , and WHEREAS, the requirements of the Subdivision Regulations of the Town of Wappinger have been met by said subdivision plat .and application, except as noted below, and WHEREAS, the conditions of the preliminary approval of said subdivision plat, granted by the Town of Wappinger Planning Board on May 21st, 1979, have been met, except as noted below. No structure is to be built where the lowest openings (windows, doors, garage doors, crawl space, etc. ) are lower than two feet above the road surface unless approved by the Highway Superintendent and/or Engineer to the Town. 8. . All footing drains and roof leaders, if installed, shall be piped into the storm drainage system unless waived by the Highway Superintendent and/or Engineer to the Town.
