Dear Mr . Noto:
This letter is to advise that pear your discussion with the
Board, at their August 18th, 1980 meeting, you have until
October 15th to comply with the conditions of final approval .
However, it should be noted that you would have to obtain
reapproval from the Dutchess County Department of Health prior
to September 7th at which time that approval would expire .
Please note that pursuant to Section 276 of the Town Law
there is only a period of one year in which to comply with
the conditions of approval and filing of the map.
if yotr plat is not filed within the one year period,
the approval becomes null and void and a new application would have
to be submitted and would be subject to any new fees or other
requirements.

Dear Mr . Barger:
At their June 2nd, 1980 meeting, a motion was made by
Mr . Mills, seconded by Mr . Rubenstein, to grantan extension of
final approval to run until September lst, 1980. The motion
was unanimously carried.
It should be noted that this plat was signed by the
Health Department on September 7th, 1979 and this approval will,
therefore, expire on September 7th, 1980 . This is to advise
that the necessary steps should be taken to have the plat
reapproved and resigned if the applicant does iaot intend to .f-ile
the plat prior to the September lst, 1980 date.

Dear Mr . Noto:
At their October 15th, 1.9.79 meeting, the Planning Board of
the Town of Wappinger adopted the following resolution:
WHEREAS, an application for final approval of a subdivision
plat. entitled "Subdivision Plat for Compa Felice, Inc. , Town of
Wappinger, Dutchess County, New York" was received by the Town of
Wappinger Planning Board on September 17th, 1979, and
WHEREAS, a public hearing was held on said subdivision
application and plat at the Town, Hall, Mill Street, Wappingers
Falls, New York, on Monday, October 15th, 1979 at 8 : 05 p .m. , and
WHEREAS, the requirements of the Subdivision Regulations
of the Town of Wappinger have been met by said subdivision plat
.and application, except as noted below, and
WHEREAS, the conditions of the preliminary approval of said
subdivision plat, granted by the Town of Wappinger Planning Board
on May 21st, 1979, have been met, except as noted below.
NOW, THEREFORE, BE IT RESOLVED THAT the application of
George Noto - Compa Felice, Inc. for approval of said subdivision
plat, prepared by Richard G . .Barger, P.E . & L.S . , and dated
revised August 3rd, 1979, be approved subject to the following
conditions, and that. the Chairman be authorized to endorse approval
on said subdivision plat upon compliance with said conditions by the
applicant, which conditional approval shall expire six months. from
the date of this resolution if the applicant has not complied with
the conditions set forth.
Upon' c.ompletion of all requirements set forth in the action
approving the Subdivision Plat, the Plat shall be properly signed
by the appropriate officers of the Planning Board, and shall be

filed by the applicant in the Office of the County Clerk in
accordance with the requirements of Section 278 of the Town Law.
Any Subdivision Plat not so filed within 60 days of the date of
Planning Board signature shall become null and void.
1 . Driveway .permits shall be obtained from the Town of
Wappinger Highway Superintendent prior to the issuance of
any building permits.
2 . Highway takings .shall .be indicated on the plat prior. to
its signing -by the Planning Board chairman.
3 . Drainage flow patterns shall be indicated on the. individual
plot plans. For any surface waters that discharge upon properties
of other persons, the applicant shall obtain letters from the
same allowing such discharges_
4 . Downstream drainage fee of $200.00 per lot (5 lots - lots
1 'thru 6, 2 & 3 combined) shall be paid prior. to the signing
of the plat.
5 .. Recreation fee of $300.00 per lot (5 lots - lots 1 thru 6,
2 & 3 combined) shall be paid prior to the signing of the plat.
6 . Note shall be placed on the plat that lot 7 is not a
building lot. .
7 . No structure is to be built where the lowest openings (windows,
doors, garage doors, crawl space, etc. ) are lower than two feet
above the road surface unless approved by the Highway Superintendent
and/or Engineer to the Town.
8. . All footing drains and roof leaders, if installed, shall be
piped into the storm drainage system unless waived by the
Highway Superintendent and/or Engineer to the Town.

9.. At least two street trees of the Sugar Maple variety
and/or Evergreen type shall be placed' on each lot.. These
trees shall measure at least two inches in diameter at a point
one foot aboveground planting level,. Said trees shall not
be placed in the street right-of-way.
10. Five copies of the filed map shall be submitted . for
Planning Board files. Said copies shall be obtained from
the County. Clerk' s office.

Dear Mr . Noto :
At their May 21st, 1979 meeting, the Planning Board of the
Town of Wappinger adopted the following resolution:
TENTATIVE APPROVAL IS HEREBY GRANTED to George -Noto - Compa
Felice, Inc. for subdivision as shown on map entitled "Preliminary
Subdivision Plat for Compa Felice, Inc . , Town of Wappinger, Dutchess
County, New York" , prepared by Richard G . Barger, P .,E , & L.S. , and
dated March 14th, 1979, subject to the following requirements :
within six months of this tentative approval, the applicant
is authorized to submit an application for approval of' a subdivision
plat in accordance with Article II, Section 22 ; Article III, Section 30,
and Article IV of the Subdivision Regulations . In addition, the
application must meet the requirements of -the Town of Wappinger
zoning ordinance. In addition, the following improvements, reservations,
changes, and requirements are pre-requisite to the approval of the
plat .
1 . Approval of the Dutchess County Department of Health
shall be obtained.
2 . Driveway permits shall be obtained from the Town of Wappinger
