Simonetty the following resolution was adopted : WHEREAS in accordance with the Planning Eoc�rd ' s Subdivision Regulations adopted. June 6 , 1361 , and as last revised , a formal and complete application For approval of a final plat titled : LANDS OF ELEVADO prepared by : BARGER GRAY & RAILING dated NOVEMBER 1987 and last revised FEBRUARY 15 , 1989 was submitted to the Board on APRIL 10 , �,1-989"� _ by : MAURO & ADORNACICON ELEVADO , and WHEREAS the applicant has represented to th`i's board that they are the owner of the lands within said subdivision , or,, Have a ;vel id contract of sale for said lands , and WHEREAS an application fee- or $50 . 00 covering 4, lots on 3 .4 acres. has been received by this Board ; and r WHEREA:� the SEQRA process has been completed prior to the approval Of the Pr•el i mi nar-•.y Plat , and WHEREAS the applicant has submitted to this Board as part of said appl icEtion for plat ,appr•ov.al , the fol loWi ng con'struc'tion Plans ( improvement plans) entitled WHEREAS the Planning, Board has referred this proposal to 'the following agencies and has received input from same : Town Engineer Planning Consultant . B ) 3 mi l ar deeds of conveyance giving rights of ''nasement and use for all drainage and public facilities shown on said plt , have been tendered to the town to be held in escrow until formal acceptance by resolution of the Town Board . C) The deeds offer of dedication and certificate of title insured by an approved title company for the fee title to ,all streets has been tendered to the town to be held in escrow until formal accapta'rice of the. roads by resolution of the Town Board . 't D ) An inspection fee to be estimated by the Town Engineer shall have been given to the town by paying said sum to the Town . E ) The following additional requirements or conditions are met : 1 ) Submi s'si on of a statemW nt si fined by the Towns Tax Col 1 ector that taxes due on this parcel have been paid . 2) Submission of fees as per town requirements , in the form of separate checks made payable to the Town of Wappinger Downstream Drainage - $300 . 00 ( $200 . 00/lot ) 3 ) Submission o? an erosion control . bond and inspection fee as per the Town Engin ar.., , s requir•• ;mant'_7 f . BE IT FURTHER RESOLVED that no cern fi catty of occupancy will be issued until the lot bounds are stakedout and possession survey of premises is filed with the Building Inspector containing legend that stakes have been set as shown thereon . BE IT FURTHER RESOLVED that upon due consideration by the Board the following requirements of these regulations are waived . a) Dedication of Recreation lands due to :size of subdivision ( less than 5 lots ) . BE IT FURTHER RESOLVED that upon due consideration by the Board no other requirements of these regulations. be modified . i 1.
