Dear Mr. Davis: At the June 7th, 1982 meeting of the Planning Board, a motion was made by Mr . Parsons, to adopt the resolutions of preliminary and final approval and to waive the final public hearing . The motion was seconded by Mr. Rubenstein . The resolutions of approval are' afollows: TENTATIVE APPROVAL IS HEREBY GRANTED to Jack Davis for subdivision as shown on map- entitled "Subdivision of Land of Jack Davis, Town of Wappinger, Dutchess County, New York", prepared by Milton Chazen, P.E. & L.S. , and dated April 5, 1982, revised 5/3/82, subject to the following requirements: Within six months of this tentative approval, the applicant is authorized to submit an application for approval of a subdivision plat in accordance with Article 11, Section 22; Article III, Section -70 ,, and Article IV of the Subdivision Regulations . In addition, the application must meet the requirements of the Town of Wappinger Zoning ordinance . In addition, the following improvements, reservations, changes, and requirements are pre-requisite to the approval of the plat . 1 . Approval of the Dutchess County Department of Health shall be obtained prior to the signing of the plat. 2 . Downstream drainage fee of $200 . 00 per lot for the newly created lots ($400 . 00) shall be paid prior to the signing of the plat . Curb cut permits shall be obtained from the New York State Department of Transportation prior to the issuance of any building permits. 5 . Five copies of the filed map shall be submitted for Planning Board distribution,. Said sopies shall be obtained from the County Clerk's office. WHEREAS, an application for final approval of a subdivision plat entitled "Subdivision of Land of Jack Davis, Town of Wappinger, Dutchess County, New. York" was received by the Town of Wappinger Planning Board on June 7th, 1982, and WHEREAS, a Final pdidic hearing is waived by the Town of Wappinger Planning Board, and WHEREAS, the requirements of the Subdivision Regulations.. of the Town of Wappinger have been met by said subdivision plat and application, except as noted below, and WHEREAS, the conditions, of the' preliminary approval of said subdivision plat, granted by the Town of Wappinger Planning Board on June 7th, 1982, have been met, except as noted; below. ' NOW, THEREFORE, BE 1.T RESOLVED THAT the application of Jack Davis for approval of said subdivision plat, prepared by i Milton Chaaen, P.E. & L.S., and dated 4/5/82 and revised 5/3/82, be approved subject to the following conditions, and that the Chairman . be authorized to endorse approval on said subdivision plat upon compliance with said conditions by the applicant, which conditional approval shall expire six months from the date of this resolution if the applicant has not complied with the conditions set forth. WHEREAS Davis is the owner of a certain parcel of real property located at the narthwest corner of the intersection of Route 9 and Middlebush Road in the Town of Wappingers , and WHEREAS Davis has Mmitted a site plan to the Tamil of %ppingers Planning Board for approval of a commercial, development of such property, and, WHEREAS the Toof Wappingers Planning Board granted a permit to such site plan or or about 1974 and WHEREAS CHEMICAL BANK, HUDSON VAII&Y, N.A. , a tenant. at such property by virtue of as written lease , has applied to the Town of Wappingers Building Inspector for as building permit U) construct a building in accordance with such site plan ,and VTIEREAS the Town, upon advice of its Town Engineer, has demanded that as a condition to the issuance of such building permit that Davis hold the Town harmless from any damages sustained by—�he Tawn as a result of the approval of such site plan by the Town of Wappingers Planning Board and the issuance by the Town of a building permit as the same may apply to water damage caused by a change in excess surface water, f f 2- NOW THEREFORE the PartM agree as follows : Ii 1 . Davis now and hereafter agrees to hold the Tawti harmless from any and all claims , damages , losses , and expenses including reasonable attorney' s fees arising out of or resulting from a change in excess surface water runoff created by the commercial development of the real property owned by Davis at Route 9 and Middlebush Road in accordance with a site plan approved by the Town of WAppingers Planning Board and a building permit issued by the Town of Wappingers , Building Inspector ; provided that any such claim, damage , loss and expense (1) is attributable to bodily injury, sickness , disease or death, or to injury to or destruction of tangible property including the loss of use resulting therefrom, and (2) is caused in whole or in part by a change in excess surface water ruTaoff resulting from the caminercial development hereinbefore described. 2 . Definitions (a) "Town" as defined in paragraph one above shall be deemed to include the Town of Wappingers , The Town of Wappingers Planning Board , the Town of Wappingers Building Inspector and the individual members of the Town Board and Towri Planning Board and any otber employees or agents of th.e Town not specifically named. (b) "Danagea" shall be defined as any costs incurred by the Town as a result of a claim as described- in paragraph one and incurred in the defense of such claim herein , including reasonable attorney' s fees , court filing fees and stenographic minutes , court costs and awards to claimants by verdict , settlement or otherwise paid. .,LKV, (YJ 1" 3 .
