APPROVAL
At a regular meeting of the Planning Board of the Town of Wappinger, Dutchess
County, New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New l
York on the 6th day of May, 2002 at 7:30 P.M.
The meeting was called to order by Chairman Philip J. DiNonno and upon roll
being called, the following were:

The following resolution was moved by ,?� and

WHEREAS, the Town of Wappinger Planning Board received an application from
Fred Straub (the "Applicant") on behalf of Ultra-Craft Homes (the "Owner") for preliminary
and final subdivision plat approval for the realignment of lot lines between two lots 0.9631 (Lot
2) and 0.9156 (Lot 3) acres in size resulting in the transfer of 0.0286 acres from Lot 3 to Lot 2
(the"Project"); and
WHEREAS, the properties are known as Tax Lots 6257-01-015933 and 6257-01-
027938 on the Town of Wappinger Tax Assessment Maps and are located in the northeast
corner of the intersection of Roberts Road and Spook Hill Road within the R-20 Residential
Zoning District(the"Property" or"Site"); and
WHEREAS, the Applicant has submitted a Short Environmental Assessment Form
and the following plan prepared by Richard G. Barger, Wappingers Falls, New York:
"Realignment of Lot Lines for Lots 2 & 3 (filed map #11195)Deanna Estates," dated 4/2/02;
and
WHEREAS, the lots involved are Lots 2 and 3 of the three-lot Deanna Estates
subdivision approved by the Planning Board by resolution dated 11/20/00; and
DEANNA ESTATES LOTS 2 AND 3 LOTLINE REALIGNMENT
RESOLUTION OF PRELIMINARY AND FINAL SUBDIVISION PLAT APPROVAL
WHEREAS, the proposed lotline realignment corrects an existing violation of the
minimum side yard setback; and
WHEREAS, the Planning Board is familiar with the Site and all aspects of the
Project and has been satisfied that the Project will comply with the Zoning Law as well as
other applicable laws and regulations; and
WHEREAS, the Planning Board determined that the Project is an Unlisted Action
in accordance with the State Environmental Quality Review Law; and
WHEREAS, a duly advertised public hearing was held on May 6, 2002 at the
Wappinger Town Hall, 20 Middlebush Road, Wappingers Falls,New York at which time
all those wishing to be heard were given the opportunity to be heard and the public
hearing was closed on that date;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. The Planning Board hereby adopts and incorporates the recitations and statements
set forth above as if fully set forth and resolved herein.
2. Pursuant to State Environmental Quality Review regulations, the Planning Board
hereby adopts a Negative Declaration on the grounds that the proposed action will
not result in any significant environmental impacts and no new building lots will
be created within the Town of Wappinger and there will be no construction or land
disturbance as a direct result of the project.
3. The Planning Board hereby finds that a proper case does not exist for requiring
that additional parklands be suitably located for playground and other recreational
purposes within the Town of Wappinger, since no new building lots will be created
within the Town of Wappinger, and therefore neither land nor a fee in lieu of land
for recreational purposes will be required.
4. The Planning Board hereby finds that the final plat will not be substantively
changed from the preliminary plat and hereby determines that a public hearing on
the final plat is neither warranted nor required.
5. The Planning Board hereby grants both Preliminary and Final Subdivision Plat
Approvals for a lotline realignment and land transfer as herein defined to the
Applicant subject to the following conditions and modifications which must be
satisfied prior to the signing of the final plat by the Chairman of the Planning
Board:

a_ The Owners shall endorse a copy of this resolution and submit it to the
Planning Board for its files.
b. The Applicant shall prepare a final subdivision plat in accordance with
Appendix A of the Town of Wappinger Land Subdivision Regulations. 11
C. The Applicant shall submit a statement signed by the Town's Tax Collector
that all taxes due on the subject property have been paid.
6. Conditional approval of the final plat shall expire one hundred eighty (180) days
from the date of this resolution unless all requirements have been certified as
completed or unless a written request for an extension of Final Subdivision Plat
Approval (not to exceed two (2) ninety (90) day periods) is granted.
7. In accordance with the Town's Schedule of Fees, the Applicant shall be
responsible for the payment of all application review fees incurred by the Planning
Board in review of this Project which are in excess of the application review fees
paid by the Applicants to-date. Such fees shall be paid within thirty (30) days of
the notification to the Applicant that such fees are due. If such fees are not paid
within this thirty (30) day period and an extension therefor has not been granted by
the Planning Board, this resolution shall be rendered null and void. Refunds of any
remaining funds within the escrow account for the applications will not be made
until six(6) months after the filing of the subdivision plat.
8. The Planning Board Chairman shall endorse a copy of this resolution certifying its
correctness. The Applicants shall also sign a copy of this resolution after it has
been initially endorsed by the Chairman acknowledging his receipt of a copy of the
resolution. When all of the conditions as set forth above have been satisfied, a
copy of the final subdivision plat, revised as necessary, shall be submitted for
endorsement by the Planning Board Chairman, certifying that the plans comply
with the terms of this resolution, at which time, the Chairman shall also endorse
this resolution in the space provided below, certifying that the applicants has
complied with the above conditions of approval and that the Final Plat is
authorized for filing with the County Clerk, Division of Land Records.
The question of adoption of the foregoing resolution was duly put to a vote on roll call,
which resulted as follows:

We are proposing a five lot. subdivision called Deanna
Estates . The sewage from this subdivison would flow to the pump
station on Roberts Road. Engineering testing on the station
indicates that with the additional homes the station is marginal
during peak periods. Additionally the station is a source of
high maintenance to the Town. It was suggested that the station
be replace by a 8" gravity line from Roberts Road to Rosewood
Court.
I have received the June 5, 2000 letter from Paggi , Martin
& Del Bene detailing the cost of installing this line. The cost
came in at $116 , 000 with $22 ,800 for material and $93, 000 for
labor. It was the intent of the developer to pay the labor cost
with the Town paying the material and any other costs associated
with the line. This would allow the developer to maintain the
5 lot subdivision. However the labor component came in much
higher than anticipated and at this time it does not make
economic sense to pursue the five lot subdivion.

Dear Supervisor Smith&Board Members:
At the Town's request,this office has computed the estimated cost to install an 8" diameter
gravity sewer main from Roberts Road to Rosewood Court. This line would serve the newly
proposed Deanna Estates lots, and would allow the Town to abandon the existing Roberts Road
pump station.
As outlined in the enclosed correspondence,the Developer has proposed that they install the
line at their expense, with the Town paying the cost for materials to perform the work. This is
contingent on testing for rock prior to final agreement.
This office has estimated the cost to perform the work at$116,000.00 ($22,800.00
materials/$93,200.00/labor). This represents a total installed cost of approximately$140.00
per linear foot(see enclosed).
Please note the following:
1. This cost estimate is based on a publicly bid project utilizing New York State
Prevailing Wage Rates. The unit prices, where applicable, have been taken from the
most recently bid sanitary sewer projects for the Town.
2. The cost estimate includes 150 cubic yards of rock removal. This estimate was arrived
at after analyzing the location and depth of the proposed main, and is subject to what .
actual test pits may reveal.
3. The cost estimate does not include any soft costs (i.e. design, inspection, additional
easements, legal).
4. The cost estimate does not include any costs for storm sewer improvements, which
have been mentioned during the Planning Board review of this project.

Next is Deanna Estates, a five lot subdivision located at the intersection of
Spookhill and Roberts Road. The owner, Mr. Shulkin wishes to tie into the
existing sewer line on Roberts Road. Mr. Paggi explained that tying into the
existing sewer would be very close, it is difficult to determine the nature of
sewage flows but its very close to being at capacity. There may be room for
five, four, three, its not a black and white calculation. Mr. Paggi explained,
that perhaps this could be a joint venture between the town and the
developer to accomplish this work. He has not put a price tag on the work.
Discussion followed.

Dear M' s Smith:
The applicant, Fred Staub is planning to subdivide a parcel of
land at the intersection of Spook Hill Road and Roberts Road into
some 5 building lot. At this time there exists two water services
to this parcel.
Conference with the Town Engineer, J. Paggi, indicates that the
applicant cannot use the existing services nor can the applicant
tie into the existing mains which are in the roads adjacent to the
property.
At this time the applicant is requesting permission to drill well
on this property so that he can obtain approval from the Dutchess
County Health Department to have well within the limits of a Town
Water District. (SEE ATTACHED LETTER FROM THE DUTCHESS COUNTY
HEALTH DEPARTMENT CONCERNING WELLS WITHIN A WATER DISTRICT)
The applicant is willing to drill wells and also provide a water
service line and shut-off from the proposed dwelling to the street
line so that future tie-in to municipal water can be made once water
is available. Once water is available the home owner would have 6
( six) - months to. tie in. Note could. be placed on ' map;: also, words
in deed to this fact-.
This project will be served with central sewage, existing manholes
and mains are within the limits of the Town Roads.
At this time the applicant is requesting a letter from the Town of
Wappinger indicating they have no objection to the drilling and use
of wells within the Water Service Area due .to pressure, transmission,
storage or non-availability of wate at this time; however, once .
water is available the home owner mist tie-into the serevice lines
,...within 6:.- (-six) months.
The applicant would request a meeting with the .Town Board of the
Town of Wappinger concerning this matter; however, if a letter is
forthcoming the meeting would not be necessary.

1 . The Dutchess County Health Department approval will be required
for the sewer, and water facilities, including the using of existing
wells.,
2. The area .generally consists of steep slopes. This wi..Il „need to be
taken into account in design of the house, driveway and sewer and
water connections.
3. The Applicant has shown land to be deeded to the Town of
Wappinger adjacent to Spookhill Road, in front of the proposed
parcels. It is recommended that this area be cleared, grubbed and
graded to the downhill level of Spookhill Road to better existing sight
distance.
4. All existing sewer/water connections and mains should be mapped,
including elevations.
5. All driveway connections must be approved by Graham Foster,
Highway Superintendent. .The proposed driveway connection for Lot
No. 1 must haye;ail' sight distances determined. Sight distances on
Robert Road will need to be identified and determined -if they are
adequate. Possibly, the Board might what to consider the joint
driveway detail as shown on one of the sheets.
6. The additional sewer flow to the ejector station located on Roberts
Road will need to be identified and determined if the station has
capacity.

_ Next are proposals from D. Silvestri&Sons, Inc., for the installation of low
ambient kits (material and labor)for the Emergency Services Building. The
cost to install two low ambient kits for the State Troopers Suite is $1,150,
and the cost to install three low ambient kits for Sloper Willen Ambulance is
$966.00
COUNCILMAN RUGGIERO moved to accept the proposals from D. Silvestri
&Sons to install low ambient kits at the Emergency Services Building at a
cost of$1,150 for the State Troopers Suite &$966 for Sloper Willen
Ambulance.

Next is a report from Mike Tremper of CAMO Pollution on the Water Service
at 19 Sherwood Heights. On September 9, 1999, CAMO responded to a
water leak in the front yard of the above location, and upon operating the
curb valve in the homeowner's front yard, and turning the curb valve off,the
leak stopped. An indication of a leak after the curb valve. According to the
Town of Wappinger Town Code,the Town is responsible for the water main
and the water service to the Town's side of the curb valve, and in,is the
homeowner's responsibility. CRMO informed the homeowner it was their
responsibility to repair the leak. The homeowner did not believe this
information was correct. On September 14, 1999 CAMO received a call from
the Highway Superintendent that he had received a call in regards to the
water leak on 19 Sherwood Heights. Our personnel met him there and
repeated the same procedure that took place on September 19th. Again the
homeowner was informed that it was her responsibility to repair the leak. It

the Town, Jay Paggi, indicated that the applicant cannot use the existing
services nor can the applicant tie into the existing mains which are in the
roads adjacent to the property. The applicant is requesting permission to
drill wells on this property so he can obtain approval from the DC Health
Department to have a well within the limits of a Town Water District. The
applicant is willing to drill wells and also provide a water service line and
shut-off from the proposed dwelling to the street line so that future tie-in to
municipal water can be made once water is available. Once water is
available the home owner would have six months to tie in.At this time the
applicant is requesting a letter from the town of Wappinger indicating they
have no objection to the drilling and use of wells within the Water Service
Area due to pressure, transmission, storage or non-availability of water at

this time. However, once water is available, the home owner must tie into
the service lines within six months. SUPERVISOR SMITH reminded the
board that we do not have enough water for extra hook-ups. Mr. Paggi
informed the Board that at the last meeting he was authorized to draft a
report on Keenan Acres with the same request. Perhaps he can lump these

into one,but he is waiting to see how the second well comes out before he
drafts a report. The reason the engineers draft the letter is the health
department requires that the governing body accept responsibility for
supplying water before they approve it.
COUNCILMAN RUGGIERO moved to authorize the Supervisor to send a
letter to Deanna Estates, as well as Keenan Acres, informing we can not
provide water at this time,but are entertaining a proposal for a proposed
water improvement.
