On December 27th, 2006 this office received Site Plans Sheets 1-9, and Sewage Disposal
Sheets 1-3 for the Getty Gas Station #169 Site Plan. All Plans were prepared by High Point
Engineering and are stated last revised December 40i, 2006, as prepared by
All outstanding engineering related concerns from our October 24" 2005 review letter have
been addressed.
We have also reviewed the November 21St, 2005 Resolution of Site Development Plan
Approval and would note the following:
• 2.b.1):The Zoning Administrator should verify that the Resolution has been signed.
• 2.b.2): Satisfied The Town Tax Collector has verified that the taxes have been paid.
• 2.b.3): Satisfied. The Applicant obtained DCHD approval on June 20"', 2006. We would
note that this approval is just for a septic tank/ holding tank setup. No subsurface sewge
disposal system is proposed_
• 2.b.4): Satisfied In his July 26h, 2006 Compliance letter, the Town Planner indicated
that the traffic signage is satisfactory.
• 2.b.5): Sadsfied. In his July 26"', 2006 Compliance letter, the Town Planner indicated
that the onsite truck turning movements are satisfactory.
• 2.b.6): Satisfied. In his July 26"', 2006 Compliance letter, the Town Planner indicated
that the landscape plans are satisfactory.

indicated that the location of the wetlands on the Plans is satisfactory.

This office had received an Acknowledgement of Assignment from Forth Bork Bank, 210
Mineola Boulevard, Mineola, New York, that an account had been established by
Montgomery Distributors LLC in the amount of$18,000.00 to be held as security for the
construction of a sidewalk at the above referenced location. (see attached copy) The
construction of said sidewalk was required as part of the Site Plan& Special Use Permit
approvals.
The sidewalk has been installed. Mr. George Kolb, Director of Code Enforcement, has
inspected the work and has deemed it acceptable. The account can therefore be released
and I ask that the Town Board authorize this release in written form.

Comments:
Our office is in receipt of the following information regarding the above referenced
Site. All information was prepared by C2G Environmental Consultants, LLC I
Catapano Engineering, P.C.
• Remedial Action Work Plan dated May 2005.
• Tank Closure and Remedial Action Report dated September 16th 2005.
• Potable Water Well Sampling Report dated June 18th, 2005.
The basic findings of these Reports are summarized as follows:
1. A spill of approximately 5000 gallons of regular gas occurred on April 28th, 2005.
The New York State Department of Environmental Conservation (DEC) was
noted, and Spill No. 05-01208 was assigned to the site.

2. A Closure Plan was prepared on May 16th, 2005, and accepted by the DEC on
June 22"d, 2005.
3. Tank Closure and Remediation activities were conducted from April through
June, 2005.
4. Remediation activities resulted in the recovery of 3200 gallons of free product,
33,000 gallons of gas contaminated groundwater, and 7,400 tons of gas
contaminated soil. All recovered materials were hauled offsite and disposed of
properly,
5. 49 soil samples were then taken. 46 of these samples came back clean. The
following samples exceeded the DEC Recommended Soil Objective Level: 1 for
acetone, and 2 for MTBE.
6. One (1) groundwater sample was taken. Said sample exceeded the DEC
Recommended Soil Objective Level for BTEX and MTBE.
7. One (1) potable water sample was taken. No contaminants were found above
NYS drinking water standards.
8. The Report concludes "Based upon the findings of the Tank Closure activities, it
appears that the impacted soil in the area of the former US Ts, pump islands and
dispensers has been successfully raemediated. As per the Remedial Action Work
Plan dated May 16, 2005, a series of groundwater monitoring wells will be
installed at the site in strategic locations in order to characterize the nature of the
groundwater quality. Based upon the analytic data obtained from the monitoring
wells a determination will be made as to the need for further remediation."

5. The Fire Prevention Bureau shall inspect the premises prior to the issuance of a
Certificate of Occupancy.
6. Any signs to be located on the premises and/or bdilding shall comply with the
requirements of the Town of Wappinger Zoning Law.
7. Adequate screening shall be required for the refuse enclosure as determined by
the Planning Board.
8. Site lighting shall be submitted and reviewed by the Zoning Administrator prior
