Dear Mr. Kessler:
At their April 16th, 1979 meeting, the Planning Board of the
Town of Wappinger adopted the following resolutions:
TENTATIVE APPROVAL IS HEREBY GRANTED to Samuel Kessler for
subdivision as shown on map entitled "Subdivision of Lands of Kessler,
Town of Wappinger, Dutchess County, New York", prepared by Morris
and Andros, P.E.s and Richard N. Carlson, L.S., and dated January 1979,
subject to the following requirements:
within six months of this tentative approval, the applicant
is authorized to submit an application for approval of a subdivision
plat in accordance with Article II, Section 227 Article III, Section 307
and Article IV of the Subdivision Regulations. In addition, the
application must meet the requirements of the Town of Wappinger
Zoning ordinance. In addition, the following improvements, reservations,
changes, and requirements are pre -requisite to the approval of the
plat.
1. Approval of the Dutchess County Department of Health
shall be obtained.
2. Driveway permits shall be obtained from the Town of Wappinger
Highway Superintendent.
3. Size of culverts to be located under proposed driveways
shall be indicated along with stream on the property.
4. Notes on the plat regarding the common well shall be revised
to the satisfaction of the Attorney to the Town per his letter
dated 4/11/79.

5. Setback of structures on the proposed lots shall be
indicated to determine conformance with the requirements
of.the Town of Wappinger zoning Ordinance.
6. Downstream drainage fee is waived as structures presently
exist and no new construction is contemplated.
WHEREAS, an application.for final approval of a subdivision
plat entitled "Subdivision of Lands of Kessler, Town. of Wappinger,
Dutchess County, New York" was received by the Town of Wappinger
Planning Board on April 16th, 1979, and
WHEREAS, a final public hearing is waived by the Tower of
Wappinger 'planning Board, and
WHEREAS, the requirements of the Subdivision Regulations of
the'Town of Wappinger have been met by said subdivision plat and
application, except as noted below, and
WHEREAS, the conditions of the preliminary approval of said
subdivision plat, granted by the Town of Wappinger Planning Board
on April 16th, 1979, have been met, except as noted below.
NOW, THEREFORE, BE IT RESOLVED THAT the application of
Samuel Kessler for.approval of said subdivision plat, prepared by
Morris and Andros, P.E.s and Richard N Carlson, L.S., and dated
January 1979, be approved subject to the following conditions, and
that the Chairman be authorized to endorse approval on said subdivision
plat upon compliance with said conditions by the applicant, which
conditional approval shall expire six.months from the date of this
resolution if the applicant has not complied with the conditions set
forth.
Upon completion of all requirements set forth in the action
approving the Subdivision Plat, the Plat shall be properly signed
by the appropriate officers of the Planning. Board, and shall be
filed by the applicant in the Office of.the County Clerk in
accordance with the requirements of Section 278 of the Town Law.
Any Subdivision Plat not so filed within sixty days of the date of
Planning Board signature shall become null and void.

The conditions of final approval are the same as indicated,
in the preliminary approval with the following addition:
7. Four copies of the filed map shall be submitted for
Planning Board files. Said copies shall be obtained from.
the County Clerk's office.'
