Our field personnel have completed an investigation of traffic conditions. This highway, signed as and co=only known as Henry Road, is a 20 - foot roadway with pavement in poor condition. There is one right - angle curve in this highway which is only 0.15f miles in length. Marginal development consists of eight residences and there is one intersecting dirt road which leads a short distance to an additional home. The short length of roadway, the right - angle curve and the poor condition of the pavement tend to make speeds in excess of 30 MPH virtually impossible. Therefore, a lower maximum speed restriction would serve no real purpose and the posting of a speed restriction would be a redundant and unnecessary effort. Dean Mrs. Banks: We are in receipt of your January 30, 1982 letter concerning the various speed[ limits recently established within the Chelsea area. Your letter raised var- ious points which T would .life to try to respond to in the Order which they Vere presented. The first point raised in your Letter dealt with the Town Board promising you a 30 14PH speed limit. Under the Vehicle and Traffic Lara the :Mate Department of Transportation makes the final, decision on the appropriate speed limits to set on Town and -County roads. When a Town feels that there is a need for a change in a speed limit, they file an application with the County Department of Public Works for that agency's review. After the County makes their re- commendations they forward the application to this office for a final de- termination. This procedure: is outlined in the Vehicle and Traffic Law and must be adhered to. The Town is not in the position to promise any particular limit for ,any particular highway. A second point than you made is that on Chelsea Road we have approved a speed limit of lO MT over the p"ted recommended speed.. The maximum legal speedL limit ou Chelsea Road prior to our investigation was 55 MPH. The 35 MPH re-- eammended posted .speed signs are only used to supplement various curve warning signs on Chelsea Road. They are just what you referred: to them. as: recom.- men ed speed signs. These types of signs (black on yellow) are used to advise motorists that at a forthcoming segment of highway a condition exists where the driver should proceed at a speed lager than the posted Limit, or in Chelsea Road's rase, the Statewide speed limit of 55 MPH. What this Depart- ment dict was to loser the -maximum overall legal speed limit of 55 IM to 45 IiPH on Chelsea Road, Old State load. and River Road. SHHwnEH We have investigated conditions along Spook Hill Road with respect to a request by the Town of Wappinger to reduce the existing 40 MPH linear speed limit to'30.MPH. This is the latest of several requests for the same purpose. -The town road is a connecting link between two county roads whose speed limits are 40 MPH or higher. Marginal develop- ment along Spook Hill Road is light to moderate and field conditions have not changed significantly since the last requestfinvestigation in 1976. The field inspection reveals that the entire town road is marked for no passing and the intersections are controlled by regulatory signs. Although some of the curves have been posted and two of the sharpest curves are delineated with chevron signs, it is recommended that additional warning signs be posted for all condi- tions on the balance of Spook Hill Road. it is noted that sight dis- tances are very limited for left turns from Spook Hill Road into the intersecting residential straets--widening and clearing of brush is recommended. Based on the above comments and previous investigations, it is recommended that the request be denied. We have completed our review of onnditions on old State Fuad and River Road to determine it speed limit reductims would be appropriate. We apologize for the delay in this response. As you are aware, 40 MFH speed limits were established on these two roads in ..1986. This resulted in a reduction from. 45 MPU on River Road and as increase from 35 MPH or dial State Read.. The reasoninq was to create consistency in the speed l.imIts since these are connecting roads which provide access to Route 9D. At that time we felt that a 40 MESH speed limit on €aid State Road was reasonable provided that the necessary guide and warming signs were in place. Our feelings are now that although the 40 MPH limit is not unreasonable,. a 35 PIPS speed limit would be more appropriate due to the increased development in this area and the variable alignment of the roadway. 1n regard to the speed limit on Forth River_ Road, we do not feel. that a reduction from 40 MPH to 35 MPH is warranted. Although there may be an increase in traffic due to new development, the roadway itself is for the most part straight .and flat and not, conducive to loner speeds. Therefore, a 35 MPH speed limit, would not be voluntarily complied with by the majority of motorists. At the same time some motorists would obey the limit and the recml.t would be a l,arce variation in speeds rather than the desired consistency in speeds. (Specify) RESOLUTION OF TOWN BOARD OF TOWN OF WAPPINGER REQUESTING NEW YORK. STATE TRAFFIC COMMISSION TO SET MAXIMUM SPEED LIMITS ON ALL TOWN HIGHWAYS AT 35 MPH. WHEREAS the Town Board of the Town of Wappinger has received report from its Town Highway Superintendent and the Engineer to e Town recozending a Town wide speed limit of 35 miles.per hour all Town Highways and also upon the County Road known as elsea Road between Route 9--D and the Hamlet of Chelsea, and Whereas the Town Board of the Town of Wappinger concurs in report, now therefore BE IT RESOLVED, that the Town Board of the Town of Wappinger' hereby request the New York State Traffic Commission to establish a maximum speed at which vehicles may proceed on all Town Roads, outside the corporate limits of the Village of Wappinger Falls, at the rate of 35 miles per hour and BE IT FURTHER RESOLVED -that the Town Boar also requests the County Highway Superintendent and the New York State Traffic Commission to establish a maximum speed at which vehicles may proceed on Chelsea Road between"Route 9-D and the Hamlet of Chelsea at the rate of 35 miles per hour, and BE IT FURTHER RESOLVED that the Town Clerk is hereby authori and directed to execute all documents to effectuate this request. JOHNSON moved that this request be tabled until the nl regular Town Board meeting. Seconded by Mrs. Mills Motion Unanimously Residents of Smith Crossing Road forwarded a petition to Town Board for a speed limit reduction from 55 MPH to 30 on that road due to new construction in the area which reg` in an increase of children and additional traffic. The also being used being used as a thoroughfare connecting Mai and Diddell Roads. The Highway Superintendent recommended that the Board cone �re requesting a speed limit reduction for the entire North En section of the Town. MR. JOHNSON moved to request the Dutchess County Department'. Public Works and the New York State Department of Transport to lower the speed limit in the North East section of the of Wappinger, inclusive of Maloney Road, Diddell Road and ROAM Lane to 30 MPH. A letter was received from Dr. Hannigan requesting an incre1 in his present agreement for the care and feeding of dogs tp $7.00, in or stray cats, $4.00 and the rent for the leox of the Animal Shelter from $300.00 to $350.00 monthly. s c MRS. The following letter was received from Mr. Gonzalez on NoveTN, 23, 1983:
