Route 9, SH 5154 Peterson Auto & welding Supply Tovm of wappinger, Dutchess County Attached is a Notice of Order dated October 22, 1982 restricting the new driveway to the Peterson Auto and welding Supply property, being constructed in the northwest quadrant of U.S. Route 9/Smithtown Road intersection, to a one-way operation. The developers submitted a site pl an to the Department which proposed the one-way operation. When the site plan was revised to reflect the, Departments geometric and signing standards, we issued Highway Work Permit #882-0656. -ib insure that the driveway will operate as intended, we have issued this legal order which restricts the driveway to a one-way entrance only. The appropriate signs will be installed by the applicant under the terms of the Permit and when officially accepted by the Department, the Order will be legally binding and enforceable. When the plans were .reviewed by the Town Planning Board, it was -recommended that the drives be angled in the direction of traffic to discourage left turn movements. During our review, we agreed with this requirement and issued Highway Work Permit #8T6 -069T which authorized a right turn ingress and a right turn egress. To insure that the drives will operate as intended, we have issued legal Orders which will enable proper signing and enforcement. The appropriate signs for the one way restrictions will be installed as part of the Permit procedures and when approved by the Department, the Orders will be legally binding. No Orders have been issued for the left turn prohibitions since the dividing median along Route US 9 physically prevents the movements. Sparkling Seasons House,.located on the west side of Route US 9 and the existing drive to Bottino's Used Cars, located on the east side of Route. US 9. The two -Orders ha*e.been.included.under,the same cover since they are both within the Town limits and were reviewedby the Department concurrently, although independently. When the preliminary site plan for the Sparkling Seasons House was submitted. to the Department for approval, the developers proposed.a two-way drive onto Route US 9. However, the Town required the drive be skewed and restricted to right turn ingress as part of their approval. Since Route US 9 is a di- videdhighway in this area and all left turns can be: funnelled to the median opening at Smithtown. Road, onto which this site has unrestricted -access, we agreed with the concept and issued a Highway Work Permit accordingly. The Town Planning Board recommended that ingress to.Bottino`s Used. Cars be via Route US 9 with all egress being funnelled onto.a Town road (Smithtown.Road). Due to the high speed, heavy volume traffic and the fact that Route US 9 is a divided highway, we agreed with their proposal and issued a Highway Work Permit with the stipulation that the drive be skewedto favor the right turn entrance movement. Accordingly, we -felt that the geometries of the drive and the traf- fic.characteristics of Route US 9 would discourage wrong -way movement and legal orders .were not requested -at that time. However, since the drive was opened: to. traffic,it has beenobserved that vehicles are utilizing it incorrectly and it was decided to_legally restrict the movements. Elaine H. Snowden, Town. For right turns, the appropriate signal face is the one furthest to the right and for left turns, the appropriate signal face is the one furthest to the left. Additional signs may be installed adjacent to other signal faces controlling the.same approach. At an overhead signal, the sign should be installed immediately to the right of the signal face where a right turn on red is authorized, or immediately to the left of the signal face where a left turn on red is authorized. At a post or pedestal mounted signal, the sign should be.installed immediately below the signal face. Where the sign is installed as -a roadside sign, it should be placed at the far right c.orrEr of the intersection for right turns and at the far left corner for left turns. Black legend CHILD Not reflectorized AREA (a) This sign is intended for use on a residential street near the home and play area of a deaf child. The purpose of the sign is to advise motorists traveling in the area of the need to be especially alert fora child who may not be normally aware of the presence of traffic or who may be incapable of responding to audio warning signals. (b) Prudent and discriminate use of thissign is.necessary to retain its effectiveness. The authority having jurisdiction for the signs should keep informed on the residences and ages of deaf children so thatthe sign can be promptly removed when they are no longer pertinent or needed. The desire of the deaf child's parents is.also an important consideration and -this sign should not be installed without the consent.of-the child's parents or legal guardian. (c) Figure WS -3 (see Appendix 3) may be used as a guide to determine the advance posting distance from the deaf child's residence, However, the appropriate sign locations, and the extent of the area around the child's residence the signing can be expected to cover, may vary considerably with differing local conditions. Competent traffic engineering evaluation on an individual basis is recommended in determining sign locations. During the site plan review process for the Lloyds project, the Department worked closely with the Town Planning Board in developing a traffic control plan along Route US 9 in the area of the Osborne Hill Road and Smithtown Road intersections. It was concluded that the Route US 9 median opening at Osborne Hill Road would be closed and a traffic signal and related improvements would be provided at the Smithtown Road intersection with Route U5 9. We subsequently issued Highway Work Permit #887-1136 authorizing the aforementioned improvements. In order that the new signal at Smithtown Road would operate efficiently and safely, it was necessary to restrict the northerly lane on the westerly approach, to left turns only. The attached Order hereby effectuates that control. When the owner of the property submitted a plan to the Department for access to Route US 9, we agreed with a right turn entrance only which is consistent with the treatment of all properties along the west side of Route US 9 in this area. We subsequently issued Highway Work Permit #887-0420 authorizing the construction. To insure that the drive will operate as intended, we have issued this legal Order which restricts its use to an entrance only, (The center dividing median along Route US 9 controls the left turn movements so it was not necessary to prohibit the northbound left turns). The appropriate signs will be installed by the applicant under the terms of the Permit and when officially accepted by the Department, the Order will be legally binding and enforceable. The Department recently issued Highway Work Permit (HWP) #886--0982 authorizing improvements to the existing driveways servicing the Hans Schnieder property, to provide access to the new Friendly Acura Auto Dealership. To limit the number of driveways along the State highway, we have required the Permittee to reconstruct the existing exit drive to allow both ingress and egress movements, thus providing access to the Auto Dealership and to the undeveloped parcel of land abutting to the south. Under terms of the Permit the applicant will remove the existing One Way signs. At that time, the One Way restriction will no longer be legally enforceable. Town of Wappinger, Dutchess County Attached is a Notice of Order dated Noverber 18, 1983 restricting the driveway to the D'Agostino's Nursery, on the west side of U.S. Route 9, to one-way operation. The developers submitted a site plan to the Department which proposed the one-way operation. Since the dividing median restricts all access to right turns only and this proposal eliminates the right turn exit turning movement, thereby reucuing a potential point of conflict to the U.S. Route 9 motorist, we agreed with the design and issued Highway Work Permit #8-83-0476. Tb insure that the driveway will operate as intended, we have issued this legal order which restricts the driveway to a one-way, entrance only. The appropriate signs will be installed by the applicant under the terms of the permit and when officially accepted by the Department, the order will be legally binding and enforceable.
