Dear Mr. O'Donnell:
At the August 24th; 1987 meeting of the Town of Wappinger Planning Board a
motion was made by Mr. Fanuele, seconded by Mr. Mills to waive the final public hearing.
A motion was also made by Mr. Mills, seconded by Mr. Fanuele to grant final subdivision
approval. The resolutions of approval are as follows:
WHEREAS, an application for final approval of a subdivision plat entitled,
"Subdivision for Craig O'Donnell,. Townof Wappinger.,.Dutchess County, New York",
was received by the Town of Wappinger Planning Board on August 24th, 1987, and
WHEREAS, the requirements of the Subdivision Regulations of the Town of Wappinger
have been met by said subdivision plat and application except as noted below, and.
WHEREAS, the conditions of preliminary approval of said subdivision plat, granted
by the Town of Wappinger Planning Board on July 13th, 1987 have been met, except as
noted below.
NOW, THEREFORE, BE IT RESOLVED THAT the application of Craig O'Donnell for
approval of said subdivision plat entitled, "Subdivision fro Craig O'Donnell,.Town
of Wappinger, Dutchess County, New York", and dated 6/12/87, and revised 6/25/87
and prepared by Richard G. Barger, P.E. be.approved subject to the following conditions
and that the Chairman.be authorized to -endorse approval of said subdivision plat upon
compliance with said conditions by the applicant, with conditional approval shall expire
six months from the date of this resolution if the applicant has not .complied with
the conditions set forth.
1. Approval of the Dutchess County Department of Health shall be obtained on water supply
And sewage disposal prior to final -approval.
2., Curb cuts shall be obtained from the Town of.Wpapinger Highway Superintendent prior
to final approval.

3. Drainage flow patterns shall be indicated on the individual plot plans. For any
surface waters that enter upon properties of other persons, the applicant shall obtain
letters from the same permitting such discharge.
4. The following improvements shall be required:
A. All storm water shall be conveyed by pipe to natural drainage courses.
B. No open stream will be allowed unless permission in writing is obtained from the
Town of Wappinger Highway Superintendent.
5. The Fire Prevention Bureau shall review the -plan and submit any recommendations that
they may have prior to final approval. The Fire Prevention Bureau shall also review
the proposed street names to prevent. similarities.
6. Lowest opening of all houses (windows, doors, garage doors, crawl space, etc.) shall
be at least two feet above the finished road grade unless waived by the Town of Wappinger
Highway Superintendent and/or the Engineer to the Town.
7.. All footing drains and roof leaders shall be piped into the storm drainage system
if specified by the Town of Wappinger Building Inspector.
8. For each lot an application shall be made for a.grading permit which shall meet the
Soil Erosion & Sediment Control Ordinance requirements, including submission of a plan
showing design and materials and at least a month by month schedule.
9. Downstream drainage fee of $200.00 per lot on the final plat shall be paid
prior to the signing of the plat,
10. Five copies of the filed map shall be required for Planning Board distribution.. Said
copies shall be required -from the County Clerk's Office.
11. All lot lines and dimensions shall conform with the zone that the subdivision is in.
12. The mitigation measures as specified in Part III of the Environmental
Assessment Form, and approved by the Planning Board following the SEQRA review,
shall be implemented as part of the (Site Plan/:Subdivision) and a Certificate of
Occupancy shall not be issued until all mitigation measures so specified have -been
complied with.

13. The deed for the highway taking shall be accepted by the Attorney to the Town
prior to the signing of the plat.
Upon completion of all requirements set forth in the action approving the subdivision
_plat, the plat shall be properly signed by the appropriate officers of the Planning Board,
and shall be filed by the applicant in the Office of the County Clerk in accordance
with the requirements of §278 of the Town Law. Any subdivision plat not so filed within
sixty (60) days of the date of Planning.Board signature shall become null and void.

At the July 13th, 1987 meeting of the Town of Wappinger Planning Board, a motion
was made by Mr. Parsons, seconded by Mr. Mills to grant preliminary approval. The
resolutions of preliminary approval are as follows:
TENTATIVE APPROVAL IS HEREBY GRANTED to Craig O'Donnell for a subdivision as
mshown on
-map entitled, "Subdivision for Craig O'Donnell, 'Town of Wappinger, Dutchess County,
New York", prepared by Richard G. Barger, P.E. & L.S., and dated 6/12/87 and revised
6/25/87 and subject to the following conditions:
Within twelve months of this tentative approval, the applicant is authorized to submit
an application for approval of a subdivision plat in accordance with Article II, § 22,
Article III, § 30, and Article IV of the Subdivision Regulations. In addition, the
application must meet the requirements of.the Town of Wappinger Zoning ordinance In
addition, the following improvements, reservations, changes and requirements are
pre -requisite to the approval of the plat.
