At the January 5th, 1.976 meeting, the Town of Wappinger
Plerning Board adopted tho tollowing resolution:
WHEREAS, an application for final approval of a subdivision
plat entitled "Lands of Michael Oles, Town of Wappinger, Dutchess
County, New York" was received by the Town of Wappinger Planning Board
on December 29th, 1975, and
WHEREAS, a final public hearing is waived by the Town of Wappinger
Planning Board, and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Wappinger have been met by said subdivision plat and
application, except as noted below, and
WHEREAS, the conditions of the preliminary approval of said
subdivision plat, granted by the Town of Wappinger Planning Board
on August 4th, 1975, have been met, except as noted below.
NOW, THEREFORE, BE IT RESOLVED THAT the application of
Michael Oles and William Machoff for approval of said subdivision
plat, prepared by Richard G. Barger, P.E. & L.S., and dated latest
revision 1/5/76, be approved subject to the following conditions, and
that the Chairman be authorized to endorse approval on said subdivision
plat upon compliance with said conditions by the applicant, which
conditional approval shall expire six months from the date of this
resolution if the applicant has with the CODditiono salt.:

Upon completion of all requirements set forth a.n the action
apprcming the Subdivision PlaL, the NaL shall be properly signed
by the appropriate officers of the Planning Board, and shall be
filed by the applicant in the Office of pax 2 County Clerl, in accordance
with the requirements of Section 278 of the Town Law. Any Subdivision
Plat not so filed within ninety days of the date of Planning Board
signature shall become null and void.

1. Road opening permits and curb cuts shall be obtained from
the Town of Wappinger Highway Superintendent prior -to the
issuance of building permits.
2. An agreement, in a form approved by the Attorney to the
Town, shall be submitted with regard to the Town obtaining
a blanket easement on said property. Said agreement be
accepted by the Town prior to the signing of the plat.
3. The following improvements shall be required.
A. All storm water shall be conveyed by pipe to natural
drainage courses.
B. No open streams shall be permitted unless permission
in writing is ontained from the Town of Wappinger Highway
Superintendent.
4. Pee of $100.00 per approved lot on the final subdivision
plat shall be paid in lieu of a land contribution for recreation.
Said fee shall be paid prior to the signing of the plat.
5. inspection fees for storm drainage lines shall be collected
before the Planning Board chairman signs the plat.
6. Downstream drainage fee of $200.00 per approved lot on the
final subdivision plat shall be paid before the Planning Board
chairman signs the plat.
7. At least one street tree, of the Sugar Maple variety, shall
be placed on each lot. These trees shall measure at least two
inches in diameter at the point one foot above ground planting

8. For any surface waters that enter; upon the properties, of

TENTATIVE APPROVAL IS HEREBY GRANTED to Michael Lyles and
William Mackoff for subdivision as shown on map entitled "Lands
of Michael Lyles, Town of Wappinger, Dutchess County, New York"
prepared by Richard G. Barger, P.E. & L.S., and dated 4/5/75,
latest revision 6/16/75, subject to the following requirements:
Within six months of this tentative approval, the applicz.,-ryt

plat in accordance with Article II, Section 22; Article III,
