At their February 7th, 1977.P1anning Board meeting, a motion
was made by Dr. Miller, seconded by Mrs. Keeler, that based upon
paragraph 3 of.the New York State Department of Transportation's
letter dated February 1st 1977 it is premature to accept the
application and hereby reject the application based upon a lack
of site distance and the possibility of the elimination of left
turns
The motion was unanimously carried.

Dear Board Members:
As indicated in your transmittal letter of January 18, 1977, we have field
reviewed the subject site, located on the north side of Route 82 (east of
A11 Angels Hill Road)., and offer the following comments:.
1. The "unused. County roadbed" area, referenced on the plan dated
January 15, 1977, is actually State right--of-way, acquired from
the County when the roadway over Sprout Creek was realigned to
its present position.
2. To eliminate the existing hazardous parking practices and to meet
our minimum requirements for a commercial drive, we recommend the
following as shown in red: provide. a 10+ foot paved shoulder
with cast -in-place concrete curbing; increase the drive width to
.22+ feet with -10+ foot radii and align it at a: 900 angle to .Route,
82; provide a 5+ foot property line offset to the east„ and. con=.
tinue the curbing internally.
3. Due to the existence of a house on the inside of the horizontal
curve West of this site,.vehicles eastbound on Route 82 may not
have sufficient rear -end sight distance to brake safely for stopped
vehicles"awaiting a gap in traffic to make aleft turn into this
site. Therefore, the applicant should be advised that it may be
necessary to prohibit left turns in the future, should a problem
develop.
We suggest that any approvals granted by the Town be contingent upon the
owner obtaining a Highway Work Permit from the Department. .At that time,
we will request that detailed plans be submitted to our Maintenance office
