Dear Mr. Klassen;
At the May 17th, 1982 meeting of the Planning Board of the
Town of Wappinger, a motion was made by Mr. Mills, seconded by
Mr. Parsons, to adopt.;.7the following resolution of final approval:
WHEREAS, an application for final approval of a subdivision
plat entitled "Subdivision Plat of Pine Hollow, Town of Wappinger,
Dutchess County, New York" was received by the Town of Wappinger
Planning Board on April 19th, 1982, and
WHEREAS, a final public hearing was held on said subdivision
application and plat at the Town Hall, Mill Street, Wappingers Falls,
New York, on May 17th, 1982 at 8:00 p.m., and
WHEREAS, the requirements of the Subdivision Regulations of
the Town of Wappinger have been met by said subdivision plat and
application, except as noted below, and
WHEREAS, the -conditions of the preliminary approval of said
subdivision plat, granted by the Town of Wappinger Planning Board
,on March 2nd, 1981, have been met, except as noted below.
NOW, THEREFORE, BE IT RESOLVED THAT the application of
Otto Klassen - Auklo Realty for approval of said subdivision plat,
prepared by Richard G. Barger, P.E. & L.S., and dated April 28, 1978,
revised 5/31/79, 3/1/82 and 3/24/82, be approved subject to the
following conditions, and that the Chairman be authorized to endorse

Pine Hollow Subdivision as of the June 16th, 1980 meeting.
The motion was unanimously carried.
Please note that the Planning Board expects to establish a.
policy whereby only two 90 -day extensions would be granted and
after that 180 -day time period, the applicants would have to
reapply.
in view of this, it is suggested that you make every effort

the Town. Amount of said bond is to be determined by the Highway
Superintendent and the Engineer to the Town and shall be approved
by the Planning Board.
15. The developer will be required to keep the roads of the
subdivision clear from snow and ice and make the roads otherwise
passable until such time as the roads have been accepted by the
Town. Upon failure to do so, the Town may authorize, after
determination that an emergency exists, a private contractor to
clear the roads or make the roads passable, and the expense of
such work will be assumed by the developer.

shall contact Central Hudson, New York Telephone, the town
franchised cable tv company and the Town Board to negotiate
an agreement whereby cable tv facilities will be installed with
underground utilities. Should these negotiations be unsuccessful,
the developer shall provide a statement indicating why agreement

At their June 21st, 1.976 meeting, the Planning Board of the
Town of Wappinger adopted the following resolution:
TENTATIVE APPROVAL IS HEREBY GRANTED to Herbert Stenger - Venture
Associates for subdivision as shown on map entitled "Pine Hollow,
Town of Wappinger, Dut,chess County, New York", prepared by
Richard G. Barger, P.E. & L.S., and dated 1/15/76 and revised 5/17/76,
subject to the following requirements:
Within six months of this tentative approval, the applicant
is authorized to submit an application for approval of a subdivision
plat in accordance with Article II, Section 22; Article III, Section 30;
and Article IV of Subdivision Regulations. In addition, the
application must meet the requirements of the Town, of Wappinger
Zoning ordinance. In addition, the following improvements, reservations,
changes and requirements are pre -requisite to the approval of the
plat.
1. Approval of the Dutchess, County Department of Health shall
be obtained.
2. Road opening permits and curb cuts shall be obtained from
the Town of Wappinger Highway Superintendent.
3. Approval of road plan and profile and plan and profile
of the drainage system must be obtained from the Engineer to

12. At least two street ' trees of-.the:4Sugar Maple variety and/or
Evergreen type shall be placed on each lot. These trees shall
measure at least two inches in diameter at a point one foot
above the ground planting level. Said trees shall not be placed
in the street right-of-way. Location of the trees shall be
shown on the individual plot plan.
13. Prior to the issuance of any building permits, a bond of
sufficient amount for the road and drainage and in a�form approved
by the Attorney to the Town shall be approved and accepted by the
Town. Amount of said bond is to be determined by the Highway
Superintendent and the Engineer to the Town and shall be approved
by the Planning Board.
14. Minimum basement elevations for lots 6,7,8,9,10 and 11
be determined, and approved by the Engineer to the Town prior to
final approval and shall be shown on the subdivision plat.
15. A twenty-five foot utility easement shall be provided along
the back lots of all the properties on De Garr.o Hills Road abutting
the Pine Hollow subdivision.

RE: Pine Hollow - Myers Corners Road'& De Garmo Hills Road.
Dear Mr. Barger:
The Planning Board of the Town of Wappinger rejects the
proposed 124 half -acre lot subdivision as it is not in conformance
with the zoning ordinance regarding the requirements of the one -
acre parcel R-40 district. Recreation area size in unacceptable.
The applicant has not shown acceptable sewage treatment plan and
has not produced evidence that the Town Board would approve sewer
and water hookups.
In view of the above, the Planning Board recommended that
the applicant resubmit under the PUD ordinance for cluster
development. As submitted the PUD plan is unacceptable for
the following reasons.
1. Density must conform to the R-40 districting. The plan
does not conform to the Wappinger Development Plan as density
is based on population rather than, dwelling units. Due to
the wet areas on the property, it cannot be.developed to the
maximum theoretical density.
2. Access on Myers Corners Road should be at a point east of
the Scheule Shopping Plaza.
3. Proposed method of drainage should be shown but need not
be in engineering detail.
4. Commitment from -the Town Board should be obtained on
water and sewer.
