TENTATIVE APPROVAL IS HEREBY GRANTED to Pizzagalli Development Company for a subdivision
as shown on map entitled, "Subdivision to Combine Lots Owned By Pizzagalli Development
Company, Situate Myers Corners Road, Town of Wappinger, Dutchess County, New York",
and prepared by Roger A. Mastri, L.S., and dated 5/31/83, and revised 6/15/83, 12/2/83,
12/22/83, 2/24/84, 4/20/84, 5/1/84, 12/1/86, and 1/12/87, and subject to the following
conditions:
Within twelve months of this tentative approval, the applicant is authorized to submit
an application for approval of a subdivision plat in accordance with Article IT, § 22,
Article III, § 30, and Article TV of the Subdivision Regulations. In addition, the
application must meet the requirements of the Town of Wappinger Zoning Ordinance. In
addition, the following improvements, reservations, changes and requirements are
pre -requisite to the approval of the plat.
1. Five copies of the filed map shall be required for Planning Board distribution. Said
copies shall be required from the County Clerk's Office.

DESIGNATING LEAD AGENCY
Resolution Offered by Planning Board Member Mr. William Parsons.
WHEREAS, the Planning Board of the Town of Wappinger, has before
it an application by Pizzagalli Development Company for site plan
approval on a 53± acre site presently owned by it on,the North side
of Myers Corners Road, further identified by tax map numbers
6258-03-350303 and 615.8-03-278358, two existing buildings, presently
occupied by I.B.M., are presently on the site, and
WHEREAS, the proposal is a Type 1 action and therefore the
designation of the lead agency is required under the S.E'.Q.R. Laws,
and
WHEREAS, on July 28th, 1986 the Planning Board authorized the
circulation of a lead agency notice to all involved agencies, and
WHEREAS, there has been no opposition from any of the other
involved agencies to the Planning Board's serving as lead agency
on this action;
NOW, THEREFORE, BE IT RESOLVED, that the Planning Board is
hereby designated the lead agency on this proposed action, and
be it further
RESOLVED, that the Planning Board Secretary is hereby directed
to circulate and file the lead agency designation to the applicant
and all involved agencies.

COMPLEX (PHASE 3)
PLANNING BOARD
Whereas, the Town of Wappinger Planning Board, as lead agency for environ-
mental quality review of an intended office developmentknown as the
Pizzagalli Office Building Complex (Phase 3), .Myers Corners Road, adopted
the annexed resolution on February 22, 1988, which resolution provided
for the Acceptance of the Final Environmental Impact Statement for said
project and for the subsequent issuance of a Notice of Completion and the
conduct of a public hearing thereon; `-
Whereas, said Notice of Completion was filed by the Chairman in accordance
with Article 8 ECL and Title 6 Part 617 NYCRR on February 23, 1988;.
Whereas, said public hearing was duly -noticed in the Town's official
newspaper on February 24, 1988; and
Whereas, Title 6 Part 617 NYCRR further requires that the lead agency make
findings before rendering a decision on the proposed action which caused
the SEQR review to take place, i.e. the consideration by the Planning Board
of site approval in accordance with the Zoning Ordinance of.the Town of
Wappinger, which Statement of Findings must be issued within thirty (30)
days of the Notice of Completion
Now, therefore, be it resolved that pursuant to Article 8 ECL and Title 6
Part 616 NYCRR the Town of Wappinger Planning Board hereby makes the
following findings on the Final Environmental impact Statement for the
Pizzagalli Office Building Complex (Phase 3), Myers Corners Road:
1. Procedural Reauirements. Upon adoption by the Town of Wappinger Planning
Board of this Statement. of. Findings, the Town Planning Board, as lead
agency, has determined that all procedural recuirements for consideration

of a proposed action under SEQR have been met. The Planning Board has
given consideration to the DEIS, public comments thereon, and to the FEIS
and comments thereon.
2. Substantive Findings. The Town Planning Board, as lead agency, and upon
advice of its planning and engineering consultants, has determined that the
SEQR process has culminated in the setting forth in detail of substantial
mitigating measures for the various identified environmental impacts of the
Pizzagalli Office Building Complex (Phase 3) within its community setting.
These mitigating measures -- including the community -related concerns of
traffic, water supply and sewage disposal, and the site-specific concerns
of erosion control, site design and building design -- will, to the extent
within the purview of either the applicant or the Planning Board be explic-
itly incorporated by the Town Planning Board within the requested site plan
approval for the subject project. The satisfactory implementation of all
such mitigating measures, including off-site improvements, shall, as assured
by the applicant, be complete prior to any request for the issuance of a
certificate of occupancy for all, or any part of, the intended 155,000
square feet office facility expansion.
The Town Planning Board takes issue with two comments within the FEIS, as
raised by the Town Engineer's letter to the Planning Board -of December 17,
1987, to wit:
"1) Pg. 5, 49D: The applicant should be questioned how a new 'building, with
an associated cooling load will not have an additional water useage require-
ment. It was my understanding that there would 'be no new cooling towers,
no new load other than domestic load. Please have the applicant explain.
The D.E.I.S. review comment of June 29, 1987, Page 2, #9state that ""Comm-
ittment noted that there will be no new cooling towers installed"" speaks
for itself.
2) Pg. 11, Response: It is my opinion that someone has review authority for
sewage disposal of a commercial building. Normally this agency is the D.C.H.D.
The Planning Board should consider the Applicant's statement that effectively
no one has the authority to refuse an application for a proposed method of
sewage disposal. Please note I am not commenting on the Applicant's ""Zero -
discharge"" proposal, only his ""no review"" theory."
The Planning Board has determined, however, that these comments can be.
wholly addressed during the site plan review process and in no significant
way affect the determinations subsequently made in this Statement of Findings.
Furthermore, the Planning Board has the assurance of the applicant that
approval will be sought from the Dutchess County Health Department of the
sewage disposal system, whether or not specifically required 'by applicable
law, rule or regulation.

Accordingly, the Planning Board has further determined as follows:
a. Consistent with social, economic and other essential considerations,
from among the reasonable alternatives examined through the SEQR process,
the proposed action, i.e. the development of a 155,000 square feet office
facility expansion at the Pizzagalli Myers Corners Road Complex and
related improvements -- 'both on-site and off-site, minimizes or avoids
adverse environmental effects to the extent practicable; -
b. Consistent with social, economic and other essential considerations, the
proposed action, as described in the FEIS, incorporates those mitigation
measures identified as practicable during the SEQR process; and
c. The proposed action, the development of a 155,000 square feet office
facility expansion at the Pizzagalli Myers Corners Road Complex and
related improvements --'both on-site and off-site, subsequent to the
grant of all necessary permits and other approvals, will not have a sig-
nificant adverse effect on the environment if carried out in strict
accordance with the conceptual, or preliminary, site plan described within
the FEIS, including the incorporation in said permits and approvals of
the applicable mitigating measures, conditions and assurances discussed
in the FEIS.
While the Planning Board has, as set forth above, determined the suitability
under sEQR of the proposed action at the specific location on the site
described in the FEIS, the Planning Board has also examined the alternative
site location which has been presented within the FEIS and has determined
that the above determinations are equally applicable to the alternative
setting, and that the alternative location would, in fact, have significant
additional 'benefits, including the following as stated in Section V111 of
the FEIS:
"l. The majority of the area is presently a gently sloping, seeded area.
The area was previously cleared during Phase 2 construction to be a
paved parking area.
2. In comparison to the proposed location, this setting eliminates disturb-
ance of the steep slope areas which exist along the zoning line. This
steep slope area is also wooded and the trees provide a pleasant visual
'break' to the site.
3. It is approximately 1,300 feet from Myers Corners Road, as compared to
approximately 580 feet for the proposed location. The building sited in
the alternate location would not be as visually imposing as compared to
the proposed location. The proposed 'building would have the top of the
roof at elevation 253.5 (42.5 feet above the ground at the side facing
Myers Corners Road). The alternate 'building would have the top of the
roof at elevation 220.0 (28 feet above the ground at the side facing
Myers Corners Road).

4. Locating the building at the alternate location would preclude the
partial demolition of the existing link 'between Buildings 920 and
922. A portion of the existing link must 'be removed to allow for
vehicle access to the loading docks in the proposed building. The elim-
ination of this required demolition would obviously aid in reducing the
cost of the overall project.
5. Locating the building at the alternate location would preclude costly
removal and/or relocation of existing utilities in the area of the pro-
posed 'building, which would also aid in reducing the cost of the overall
project.
6. Domestic water supply would be from the Atlas Water Company, not from the
CWWTA-Hilltop system."
The Planning Board does, however, acknowledge the December 1, 1967, letter
from the Town Attorney, Thomas Wood, Esq., to the Planning Board in which
Mr. Wood advises that "....the applicant wduld'be required to file a petition
with the Town Board to have the property rezoned to 'build 'buildings in excess
of the above (274,000) square footage" if this alternative location were to
be pursued. The Planning Board would support such a petition.
Be it further resolved that pursuant to Article 8 ECL and Title 6 Part 617
NYCRR the Town of Wappinger Planning Board, as lead agency, shall distribute
this Statement of Findings to the involved agencies and shall maintain a
certified copy of this Statement of -Findings on file and-available-for-public-
inspection.

PLANNING BOARD
WHEREAS, the Wappinger Town Planning Board has received an application by

o'f'fice building (Phase 3, Myers Corners Road Complex), which application is
subject to site plan approval by this Planning Board;
WHEREAS, the Planning Board subsequently received an Environmental Assessment
Form, revised November 2.4th,.1986, concerning the proposed office building
development;
WHEREAS, pursuant to the provisions of Article 8 of the Environmental Conservation
Law and Title 6 Part 617 NYCRR, the Planning Board, as lead agency, determined
that the proposed action was a Type 1 action and that such action may have a
significant effect on the environment;
WHEREAS, the Planning Board did cause such declaration of lead agency status
and such determination of potential significant effect on the environment to be
filed and circulated as required in Title 6 Part 617 NYCRR;
WHEREAS, subsequent to the conduct of a scoping session on February 4th, 1987,
Pizzagalli Development Company did prepare through the offices of Hayward and
Pakan Associates and file a Draft EIS on April 10th, 1987, which Draft EIS was
accepted as complete by the. Planning Board, as lead agency, on May 27th, 1987;
WHEREAS, the Planning Board did, as lead agency, further accept written comments
on said Draft EIS until July 24th, 1987, and did, in the interim, conduct a
public hearing regarding the Draft EIS;
WHEREAS, the Planning Board subsequently determined on July 27th, 1987, on the
basis of comments received at the public hearing and as part of the written
record, that a Final EIS, addressing the comments received, should be prepared;
WHEREAS, Pizzagalli Development Company did continue to engage the services of
its consultants to prepare the Final EIS on its behalf and on behalf of the
lead agency, as requested by the lead agency;
WHEREAS, pursuant to a December 20th, 1987, deadline established by the lead
agency in its resolution of July 27th, 1987, Pizzagalli Development Company did
file the Final EIS on a timely basis on December 8th, 1987; and

WHEREAS, the Town Planning Board, in cooperation with its private consultants,
has reviewed the Final EIS and determined that the substantive comments offered
on the Draft EIS have been addressed in the Final EIS;
NOW, THEREFORE, BE IT RESOLVED that the Wappinger Town Planning Board, as lead
agency, hereby determines the Final EIS to be complete and accepts the Final EIS
in accordance with the provisions of Article 8 of the Environmental Conservation
Law and Title 6 Part 617 NYCRR.;.
BE IT FURTHER RESOLVED that the Planning Board hereby authorizes and directs the
Chairman thereof to provide notice of this determination in accordance with
Article 8 of the Environmental Conservation Law and Title 6 NYCRR; and
BE IT FURTHER RESOLVED that a public hearing on the Final EIS will be held on
Thursday, March 3rd, 1988, beginning at 7:30 P.M. at the Wappinger Town Hall; and
BE IT FURTHER RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law and Title 6 NYCRR, the Planning Board, as lead agency, indicates its intention
to issue a Statement of Findings regarding this Final EIS not less than ten (10),
nor more than thirty (30), calendar days from the date of this resolution.

This notice is issued pursuant to Part 617 (and local law # 2 if any) of the imple-
menting regulations pertaining to Article 8 (State Environmental Quality Review) of the Environ-
mental Conservation Law.
The lead agency has completed and accepted a Final Environmental Impact Statement on the
proposed action described below.

Description of Action:
Site Plan approval by the Town of Wappinger Planning Board to authorize
construction of 155,000 square feet office building on 53± acre tract
occupies in part by two office buildings which are presently leased to
IBM. New construction would increase square footage of office/research
facilities on the tract from approximately 506,500 square feet to
661,500 square feet, and be the third stage of development at the location.
Water demand and sewage treatment requirements will be approximately
12,000 GPD. Additional traffic will total approximately 250 vehicle trips
either entering or exiting the site during the AM peak hour and 152 such trips
during the PM peak hour. In addition to the site plan approval by the Town
Planning Board, project approvals will be nedessary from the Dutchess County
Department of Health and the Dutchess County Department of Public Works.

The Planning Board of the Town of Wappinger has received an
application from Pizzagalli Development Company for site plan approval
of an approximately 155,000 square foot building on a 53t acre site
presently owned by it on the north side of Myers Corners Road,
further identified by tax map numbers 6258-03-350303 and
6258-03-278358. Two existing buildings, presently occupied by I.B.M.,
are presently on the site.
The Planning Board has received the site plan application,
together with a long form environmental assessment form. Copies of
these documents are enclosed. Additionally, the Board has received
certain larger scale maps which are on file and available for your
inspection and review.
This project is a Type I action.
PLEASE TAKE NOTICE that within 30 days of the date that these
documents are mailed to you, a lead agency for this project must be
designated by agreement among the involved agencies.
The Town of Wappinger Planning Board concludes that under the
criteria set forth in Title 6 NYCRR Section 617.6(d), it is appropriate
to designate the Town of Wappinger Planning Board as the lead agency
in this project, and the Planning Board hereby requests that you
consent to this designation and notify us of your consent as soon as
possible. If, however, you do not agree that the Town of Wappinger
Planning Board be designated as the lead agency, you may follow the
procedures outlined in 6 NYCRR 617.6(e).
We welcome any comments that you may have. Please submit to the
Planning Board any comments with respect to lead agency status or any
other comments and concerns you may have.

The Town of Wappinger Planning Board has received a site plan
application from Pizzagalli Development. Company for a 156,600
square foot office --research building on a 30.8 acre parcel
located on Myers Corners Road. The application and proposed
building are Phase II of a project for which an Environmental
Impact Statement was accepted by the Town of Wappinger Board
on March 7, 1983. The parcel is zoned OR --10A and the
building as proposed requires two variances. One for loading
docks and one for floor area ratio.
This application exceeds the following Town of Wappinger
locally established thresholds for Type .I actions:
1. Utilization of greater than 10,000 gallons per day of
ground water.
2. Non-residential building greater than 50,000 square
feet in gross floor area.
The Town of Wappinger Planning Board finds that it is the
agency with the most direct review responsibility for the
proposed action and thereby seeks designation as Lead Agency
under the New York State Environmental Quality Review Act
(SEQRA).
The purpose of this letter is to obtain your agreement with
that designation. To facilitate your decision, we have
enclosed a copy of the Environmental Assessment Form prepared
by the applicant.
If you have no objection to the designation of the Town of
Wappinger Planning Board as Lead Agency in this matter,
please complete and sign the statement at the bottom of this
letter and return it to my office within 30 days. If you

BE IT RESOLVED THAT THE PLANNING 130ARD OF THE TOWN OF WAPPINGER
HEREBY GRANTS SITE PLAN APPROVAL to Pizzagalli Development Company
for site plan entitled "Proposed Office Facility, Myers Corners
Road, Wappingers Falls, New York, Pizzagalli Development Company,
South Burlington, Vermont", consisting of sheets I thru 4, prepared
by Hay -ward and Pa an Associates, dated 2 May 63, and subject to the
following conditions:
1. Approval of the Dutchess County Department'of Health
on water supply and sewage disposal shall be obtained prior
to the issuance of a building permit.
2. Erosion control plan,shall be submitted to the Conservation.
Advisory Council for review and then shall be approved by the

It has come to my attention that the board is not fully aware
of the circumstances associated with the above situation. I feel
that under such circumstances a few observations should be made.
The rezoning of the Cornell -Drake property at the request of
Pizzagalli is unique in the anals of zoning practice within the
Town of Wappinger. This uniqueness has an affect upon the scope
of discretion you might otherwise enjoy. When the property was
rezoned, a number of specific additions were attached. Elaine can
provide you with a copy,of the text of the ordinance. These con-
ditions are mandatory conditions as they are legislative in nature.
As they are mandatory conditions, they set up a specific framework
within which you must undertake.your review. The conditions were
imposed in large part by the environmental review process in which
a representative of your board participated (Vic has a copy of the
various FIS documents). In essence, the conditions seek to minimize
any potential adverse environmental impact (although no specific
adverse impacts were identified by the process). Accordingly, any
discretion you might exercise has to be within the framework of
the specific conditions.
