Upon analysis, this Department makes the following findings: This property, comprising approximately 140 acres of land, is located on Robinson Lane in a residential (R-40) zoning district. A special use permit is requested to establish "private camps for seasonal use."' A substantial part of this property is within an officially designated wetland as proposed by the New York State Department of Environmental Conservation® This zoning referral does not fall within this Department's jurisdiction under the provisions of General Municipal Law (Article 123, Sections 239-1 and 239-m). Nevertheless, it is recommended that the presence of the wetland area be thoroughly analyzed in this project review. This analysis should include the review process set forth in Section 419 of the Town Zoning Ordinance. Appropriate mitigation measures should be required as part of the approval of a special permit for any proposed use on this property. The Dutchess County Department of Planning does not Presume to base its decision on the legalities or illegalities of the facts or procedures enumerated in subject zoning action. Review of Stephen Ossenkop proposed campground - preliminary plan 'y The following are -general comments/concerns I would have on the campground proposed'. 1 - Recreation areas not shown or designated 2 toilets/shower buildings not shown or designated. 3 will there be several wells and septic areas or one of each centralized 4 -- the large proposed pond is presently a "wooded area' -.my concern is how wooded is it (see item L on check list) 5 - a suitable marked and fenced off buffer area should be established along the east side of the property to the residentail sub- division and provisions. for future buffer on the west side if that property is developed into residential uses 5 - a copy of State regulations for campgrounds should be submitted for local review 7 - a copy of National Fire Code Standard 5-01L--7 "Recreation Vehicle Parks" is.attached for Planning and Zoning Board review and 13ossible use in developing standards for this use. It is my understanding that at the present time, the application is in process as such under the belief that such a camp would constitute a "private camp for seasonal residents only." It is my belief that a recreational vehicle camp, presumably open to the public in the same manner as a motel or other accom- modations for transients, does not constitute a private camp. The use of the word "private" to qualify the word camp is a word of limitation, and it should be given its plain and ordinary meaning. Such would connote a permitted use only in such circumstance where those having access or use of the camp were not members of the general public. The word "private" when associated with camps would normally connote use of a camp by the owners thereof. The zoning board of appeals is apparently presently considering this application. It would be permissible to express your opinions as to the interpretation of the zoning ordinance to the zoning board; they in their deliberations could determine, if they are in agreement with your interpretation, that they have no jurisdiction to consider the merits of the application. It would be my impression that the proposed use comes more readily under our provisions for recreational use development as use of recreational vehicles represents an evolution in the tradi- tional. recreational activities of camping.
