At a regular meeting of the Town Board of the Town of Wappinger
on July 11, 1983.
WHEREAS an application has been submitted by Steve Ossenkop
to the Town Board of the Town of Wappinger for construction of a
recreational vehicle park, and
WHEREAS from the submissions to date it appears that environ-
mental review of the same will be necessary as provided by both the
State Environmental Quality Review Act and the local law of the Town
of Wappinger, and

WHEREAS on the t''t`r day of June, 1983 the Town Clerk of the
Town of Wappinger advised other affected agencies of the application
and solicited their consent for the Town Board .acting as lead agency,
and
WHEREAS no adverse comments as to the assumption by the Town
Board of the status of lead agency have been received,
NOW, THEREFORE, on the motion.of Councilman Johnson
seconded by Councilman McCluskey
BE IT RESOLVED that the Town Board shall be the lead agency
in the application of Steven Ossenkop to construct a recreational
vehicle park within the Town of Wappinger.

Re: Ossenkop Special Permit Application
The Dutchess County Department of Planning has reviewed subject referral with
regard to pertinent inter -community and county -wide considerations. Upon
analysis, this Department makes the following findings:
This property, comprising approximately 140 acres of land, is located on
Robinson Lane in a residential (R-40) zoning district. A special use permit
is requested to establish "private camps for seasonal use."'
A substantial part of this property is within an officially designated wetland
as proposed by the New York State Department of Environmental Conservation®
This zoning referral does not fall within this Department's jurisdiction under
the provisions of General Municipal Law (Article 123, Sections 239-1 and
239-m). Nevertheless, it is recommended that the presence of the wetland area
be thoroughly analyzed in this project review. This analysis should include
the review process set forth in Section 419 of the Town Zoning Ordinance.
Appropriate mitigation measures should be required as part of the approval of
a special permit for any proposed use on this property.
The Dutchess County Department of Planning does not Presume to base its
decision on the legalities or illegalities of the facts or procedures
enumerated in subject zoning action.

You have made inquiry as to whether or not an application
which is presently pending for a special permit for what I would
characterize as a recreational vehicle camp on Robinson Lane is
a permitted use in a residential zone. It is my understanding
that at the present time, the application is in process as such
under the belief that such a camp would constitute a "private
camp for seasonal residents only."
It is my belief that a recreational vehicle camp, presumably
open to the public in the same manner as a motel or other accom-
modations for transients, does not constitute a private camp.
The use of the word "private" to qualify the word camp is a word
of limitation, and it should be given its plain and ordinary meaning.
Such would connote a permitted use only in such circumstance where
those having access or use of the camp were not members of the
general public. The word "private" when associated with camps would
normally connote use of a camp by the owners thereof.
The zoning board of appeals is apparently presently considering
this application. It would be permissible to express your opinions
as to the interpretation of the zoning ordinance to the zoning board;
they in their deliberations could determine, if they are in agreement
with your interpretation, that they have no jurisdiction to consider
the merits of the application.
It would be my impression that the proposed use comes more
readily under our provisions for recreational use development as
use of recreational vehicles represents an evolution in the tradi-
tional. recreational activities of camping.

RE: Appeal # 655, at the request of Stephen Ossenkop - Request
for a Special Use Permit for a Campground to be located on
Property on Robinson Lane,.in the Town of Wappinger.
Dear Board Members;
With regard to the above -captioned subject, the Planning
Board would like to take this opportunity to request that should
your Board issue the Special Use Permit that you require that
site plan approval be obtained. This is asked in view of the
size of the project and the fact that this is the first submission
for a campground in the Town of Wappinger and the particular features
of the property. Further, Mr. Hawksley of the Conservation
Advisory Council has advised that this project would require the
preparation of an Environmental impact Statement.
Enclosed are copies of the comments that the Board has
received so far. However, we are still awaiting receipt of
comments from the Engineer to the Town, the Highway Superintendent,
the Fire Prevention Bureau and the Town of East Fishkill.
It is hoped that these comments will be received in the
near future and the Board will be able to forward their recommendation
to you following their March 21st, 1983 meeting.

The Dutchess County Department of Planning has reviewed subject referral with
regard to pertinent inter -community and county -wide considerations. Upon
analysis, this Department makes the following findings:
This property, comprising approximately 140 acres of land, is located on
Robinson Lane in a residential (R-40) zoning district. A special use permit
is requested to establish "a private camp for seasonal use."
A substantial part of this property is within an officially designated wetland
as proposed by the New York State. Department of Environmental Conservation.
This zoning referral does not fall within this Department's jurisdiction under
the provisions of General Municipal Law (Article 12B, Sections 239-1 and
239-m). Nevertheless, it is recommended that the presence of the wetland area
be thoroughly analyzed in this project review. This analysis should include
the review process set forth in Section 419 of the Town Zoning Ordinance.
Appropriate mitigation measures should be required as part of the approval of
a special permit for any proposed use on this property.
The Dutchess County Department of Planning does not presume to base its
decision on the legalities or illegalities of the facts or procedures
enumerated in subject zoning action.
