Resolution Declaring Highway Equipment Surplus And Authorizing Its Sale At Public
Auction
At a Regular Meeting of the Town Board of the Town of Wappinger, Dutchess County,
New York, held at Town Hall, 20 Middlebush Road, Wappingers Falls, New York, on May 13,
2019.
The meeting was called to order by Richard Thurston, Town Supervisor, and upon roll
being called, the following was recorded:

The following Resolution was introduced by Councilman Beale and seconded by
Councilwoman Bettina.
WHEREAS, the Town of Wappinger Highway Department currently owns old, worn out and
obsolete equipment that cannot be repaired, or is too costly to repair, but may have some value; and
WHEREAS, in a memo from the Town Highway Superintendent, Vincent Bettina, to the Town
Board, dated May 3, 2019, he determined that the below listed equipment is no longer useful for
Town purposes and he recommended that the surplus equipment be sold and the proceeds from the
sale be returned to the Town Highway Equipment Fund as required by Highway Law §142(5);
NOW, THEREFORE, BE IT RESOLVED:
1. The Town Board hereby authorizes the Town Superintendent of Highways to sell the
surplus equipment listed below:

2. The Town Board hereby authorizes the Town Superintendent of Highways to sell the
surplus equipment in a manner that will obtain the best price possible which includes public
auction, trade in or a private sale for value.
3. The Highway Superintendent is authorized, but is not required, to set minimum bids for
each surplus equipment item to be sold at public auction.
4. Proceeds from the sale of the surplus Highway Department trucks shall be first used to pay
any debt service that is outstanding for the items; and any balance that remains shall be paid
into the Highway Equipment Fund as required by Highway Law §142(5).
Proceeds from the sale of the surplus Town Patrol Cars shall be first used to pay any debt service
that is outstanding for the items; and any balance that remains shall be paid into the B Fund.
The foregoing was put to a vote which resulted as follows:
