At the August 2nd, 1982 meeting of the Planning Board,
a motion was made by Mr. Fanuele, to amend the Board's resolution
of May 3rd, 1982 to allow the lot line to go up to the right-of-way.
The motion was seconded by Mr. Lawrence.

At the May 3rd, 1982 meeting of the Planning Board, a
motion was made by Mr. Parsons, seconded by Mr. Rubenstein,
to adopt the resolutions of preliminary and final subdivision
approval and to waive the final public hearing.
The resolutions of approval are as follows:
TENTATIVE APPROVAL IS HEREBY GRANTED to Salvator A. Rega
for subdivision as shown on map entitled "Realignment of Property
Lines, S.D. & R.C. Rega, Town of Wappinger, Dutchess County,
New York", prepared by Ernest Martin, L.S., and dated 19 MAR 1982
and revised 3 MAY 1982, subject to the following requirements:
Within six months of this tentative approval, the applicant
is authorized, to submit an application for approval of a subdivision
plat in accordance with Article II, Section 22; Article III, Section 30;
and Article IV of the Subdivision Regulations. In addition, the
application must meet the requirements of the Town of Wappinger
zoning Ordinance. In addition, the following improvements, reservations,
changes, and requirements are pre -requisite to the approval of the
plat.
1. Approval of the Dutchess County Department of Health shall
be obtained prior to the signing of the plat.
2. Curb cut permit shall be obtained from the Town of Wappinger
Acting Highway Superintendent prior to the issuance of a building
permit.

3. Drainage flow patterns shall be indicated on the
individual plot plan. For any surface waters.that enter
upon properties of other persons, the applicant shall obtain'.
a letter .from the.same permitting such discharge.
4. No structure is to be built where the.lowest opening j
(windows, doors, garage doors, crawl space,. etc.) are lower
than two feet above the road surface unless approved by the
Acting Highway Superintendent and/or the Engineer to the Town.

5 All footing drains and roof leaders, if specified by.the
Building Inspector, shall be piped into the storm drainage
system...:.
6. Downstream drainage fee of $200..00 shall be paid before
the Planning Board chairman signs the plat..
7. Four copies of the filed map shall be submitted for
Planning Board distribution. Said copies shall be obtained
from the County Clerk's office.
WHEREAS, an application for final approval of a subdivision
plat entitled "Realignment of Property Lines, S.D. & R.C. Rega, Town
of Wappinger, Dutchess County, New York" was received by the Town
of Wappinger Planning Board on April 19th, 1982,- and
WHEREAS, a final public hearing is waived by the Town of Wappinger
Planning Board, and ,
WHEREAS, the.requirements.of the Subdivision Regulations of 1
the Town of.Wappinger have been met by said subdivision plat and
application, except as noted below, and
WHEREAS, the conditions of the preliminary approval of said j
subdivision plat,, granted by the Town of Wappinger Planning Board }
on May 3rd, 1982, have been met, except as noted below.
NOW, THEREFORE, BE IT RESOLVED THAT the application of
Salvator A. Rega for approval of said subdivision plat, prepared
by Ernest Martin,.. L.S., and dated 19 MAR 1982 and revised 3 MAY, 1982,
be approved subject to the following conditions, and that the Chairman
be authorized to.endorse approval of said subdivision plat upon

compliance with said conditions by the applicant, which conditional' '
approval shall expire six months from the date.of this resolution
if the applicant has. not complied with the conditions set forth.
Upon completion of all requirements set forth in the action ;
approving the Subdivision Plat, the Plat shall be properly signed
by the appropriate officers of the Planning Board, and shall be
filed by the applicant in the office of the County Clerk in
accordance with the requirements of Section 278 of'the Town Law. '
Any Subdivision Plat not so filed within sixty days of the date
of Planning Board signature shall become null and void.
